Schwartz was present in the interests of his client and granted permission to Block Bros.ftr doing.business.as the Shaw Jewelry Company to erect the marquise according to •the plans and specifications presented. With reference to the signs on saiS marquise, attorney Schwartz appealed.to the Board from the decision of the Building C;ommissioner and;` after hearing the facts of the case, the Board ruled in favor, of the pet .t&n.nrr, Treeting adjourned at II-30 A. (; The Board approved the renewal certificate of Noah Malott of Vishawaka for excavation in streets signed by the Aetna Casualty and Surety Company. The Board approved the renewal certificate of the Vishawa'c PktLtbing Shop for excavation of streets, signed by the Aetna Casualty and Surety ompany. ' No. petitions having been filed for a change in the type of ravemeAt other than that specified in the preliminary order for the ravement of vanBuren street from the west line of Cushing Street to Lawndale Avenue under Imrrovement Resolution No.2I68, the Board, this I9th., day of February I929, hereby makes a final order for sheet asphalt heavy traffic pavement as the ty-oe of pavement with which said street shall be improved and awards the contract for said improvement to Albert Construction Company at their lour bid of $20,554.42 for sheet asphalt. The Board approved the revised plat of Lincoln Highlands Addition with the following Dedication:+ LINCO .-N HIGHLANDS ADDITION TO THE CITY OF II SOUTH BMID INDIANA. ' The annexed plat of Lincoln Highlands Addition to the City of South Bend, St. Joseph County, Indiana, is a subdivision of the suthwest one quarter of the southeast one -quarter of eetion 32, Twonship 38 North, Range 2 East, excepting the Plat of Vount Pleasant Cemetery, and is more particularly described as follows: i Beginning at the south one quarter of said Section 32, thence north along Vie north and south center line of said section, 1321.6 ft., to the center line of Keller'Street; thence east 1319.6 feet to the center line of Pearse Street; thence south III.8 feet to the north line of Mount Pleasant Cemtery; thence west, along the north lire of Yount Pleasant Cemetery 929.8 feet to a point 23.0 feet east of the east Tine of Charles street; thence south 209.2 feet to the south line of said Section 32, thence west 388.0 feet to the -place of beginning. The plea contains I45 lots numbered from I to 145. These to be thirty foot poles for the purpose of carrying a feeder line from the Colfax steam plant to Jefferson Street. �t the present we have a poleline erected between Colfax and this terminating point in the alley between Washington and Colfax..' I am asking that you take this up and ask for permission to erect these doles. Yours very truly, A. T7. Buckley, Sept of Power." The following recom-endation of tm. F. 'yualls, superintendent of poles and wire was approved by the Board: "As the trolley feeder referred to carries high voltage current and would endanger other circuits if rlaced on same poles with them, I think it advisable to have the feeder i3t placed on separate poles and as the alley between Niles and Hill Street is convenient for this construction, I recommend that this petition be zranted. This being the date set, hearing was had on the assessment roll for the award of damages and the assessment of benefits in the matter of the Vacation of the Ist., alley east of Stanfield Street from Napoleon Street to Angella Avenue under Vacation Resolution No.2I40. i In the above named assessment roll, no remonstrators appeared and no written remonstrance was filed, and the Board, being fully advised in the premises, finds that the several lots and parcels of land have been benefited or damaged in the I. amounts named on said assessment roll. The Board, therefore, decides to take final action oig said assessment roll, filed January 2nd., 1929, and declares same in all things ratified, confirmed and approved and the proceedings closed. . This being the date set, hearing was had on the assessment roll for the award of damages and the assessment of benefits to the matter of the Vacation of a portion of Pine Street; and the first alley south of Monroe Street; a portion of the alley west. of Pine jtreet; and a portion of Laurel.Street under Vacation Resolution. No.2058. In the above named assessment roll, no remonstrators appeared and no written remonstrances were filed, and the Board, being fully advised in the premises, finds that the several lots and parcels of land have been benefited or damaged in the amounts named on said assessment roll. The Board, therefore, decides to take final action on said assessment roll, filed January 2nd., I929, and declares same in all IIthings ratified, confirmed and approved and the proceedings closed. Wray for traveling expenses in the amount of $48.74 and hereby orders City Controller to pay same out of Tracy Elevation -Fund .
