Construction ompany at their low bid of 3,785.02

The Board sued the contract with the Albert Construction,
�? Company for the pavement on SMth Street from Huey Street to Olive Street under
l� Improvement Resolution No.2I67 in the amount of $5,518.90. The Board also approved j
the construction bond of same for 50% of the contract price signed by the Inland
i Bonding Company.

Bids baying been received for the pavement of ;'fan Buren Street
street to Lawndale Avenue under Improvement -Resolution No.2I68, the
Board, -this 5th. day of February 1929, hereby, makes a preliminary order for sheet
asphalt ravement heavy traffic as the 1pe of pavement with which said street shall
b,e improved and sets the I9th., day of ebruary 1929, as the time when said Board
shall either pass on petitions for a change -in the type of pavement ether 'than that
specified in the preliminary order, award the contract or reject all bids.
Upon the request of the Board, I.r. I. S. Romig, - City attorney,
bmltted the following written recommendation with reference to the repairs on
the grin Street Sewer:
"Board of . Public `storks,
South Bend, Indiana.
Gentlemen:
lir. Wray has asked me to give you a letter advising what to do
in the case of the crumb Ting away of the Sorin Street Sewer at its .mouth. He states
that it *J11 cost more than $5,000.00 to make the repairs and that each day's delay
enlarges the defect and increases the cost of repair .and in the event of a thaw or e
rain there might, besid-s a suddne great increase in expense of repair, be disastre

results as the washing away of homes.
It is understood, of course, that you do not have the money
appropriated for that purpose and the expense exceeds that which you are authorized
to contract under the law without furst having an appropriation therefor. It is also
understood that you have no way of making assessments and placing the cost against
properties. However, this is an emergency. You can get as low bids by direct
submission to contractors as you can by going through the formal rountine of publica-
tion amd advertising for bids. The only question then is, will the Council stay by
you and apt opriate the money and are you taking any chances by entering into this
contract without the us0al formalities?
In addition to fir. adray's statement, he had Councilman Thornton
of the fourth Ward. in which the improvement is situated, investigate and the CouncfZx
man bears out Mr. *ray's statement that the matter is serious and needs immediate
attention. He made this statement to the other members of the Council last night
and all members were there excepting one and they unanimously stated that your Board
should proceed forthwith and they would appropriate whatever sum was necessary to
bear the expense. It is a time when you cannot delay in order to comply with
formalities and with this s'^owing every Court will protect you.
I would, therefore, advise that you proceed at once to remedy
the defect and prevent further loss.

At the request of Ir.-. H. G. Wray, the following proposals t,,vere
received for the repairing of the Sorin Street Sewer:

George Pontarelli agreed to make. the necessary repairs_. at a cost of 7,400.00.
l.ward 'DiJuli.o* agreed to m ke the necessary repairs at a cost of I5,000.OJ provided
not more than 30 linealifeet of pipe would be necessary.
Rocco Simeri submitted an estimate only in the amount of 18$500.00 but would take
the contract on a time and material basis only.
J. J. Dunnegan Construction Company agreed to make the necessary repairs at a cost
of 7, 500,.00.
after considering said proposals, the Board _decides to
reject all of .said proposals and asked the above contractors to reconsider same and
submit new bids on Wednesday afternoon at 3 P.R.

and estimates and the Board adopted same together wi�h the following improvement
resolutions:

the west one half of Ernsperger Street from Lincoln Way East to a point 45 feet

Improvement Resolution No.2177 for the pavement of

Improvement Resolution No,2I80 for the pavement of
We-rwinski Court from the west curb lin of Johnson Street to O'Brien Street. (See file s
for copy of resolution.)
In all of the above named improvement resb.lutions, the
Board hereby orders that on the 27th.., day of February 1999, this Board will meet in
their office in the City Hall at 7-I5 P. V., to hear and receive remonstrances from
all persons whose property is liable to be assessed for such improvements and will
decide whether the benefits to the several lots and parcels of land liabletto be
_assessed for said improvements, will be equal to the estimated costs of same as report
ed by the City 'lligineer. The Board further orders that notices of said hearings shall'
bepublished on the 8th., day of February and on the I5th., day of February 1929 in
the South Bend News Times and Tribune according to law,, and that notices be mailed to
property owners according to law.
The Board approved the estimate of the Smoger Lumber
Company for making certain changes In the office of the City Controller and in the
Police Squad Ro!Qm and instructed cler't of the board to order said work done at once.
The Board approved the plan for the erection of a marquis
over -the entrance to the First National and Union Trust.Building on Jefferson Boulevard.
Olaima in the amount of $977.83 signed and apt oved by
the Board.
Ideeting adjourned at 12 O'Clock.
