Board 'met in regular session at 7-I5 P. T,% All members present. T-I. G.
y11ray, City igineer, also present.
The Board signed and approved the minutes of meetings held December I8th. ,
and December I9th., I928.
The Board approved the continuation certificate for the 'I0,000.00 bond
for Lantz Bros., for the Garbage contract.
The Board approved the Guarantee Bond of Rocco Simeri for the construction
of the sewer in Yerry ixenue from Grant street to Eleade Street under improvement
Resolution No.2023 in the amount of $428.23 signed by the Columbia Casualty Company.
The Board approved the Guarantee. Bond of C. +;. Reesh for the construction
of the -Elwood Avenue Sub-trun,sewer under Improvement Resolution No.2096 in the
amount of =I,226.58, signed by the United.8tates Guarantee Company.
The Board approved the following Excavation Bonds in the amount` of I,000.00
each;
Louis Niezgodski signed by Hartford Accident and Indemnity Co. ,
Thomas lrcGrath signed by United States Fidelity and Guaranty Company,
Aslin Plumbing Co., signed by American surety Company of New York.
Arthur W. Deppert signed by 11aryland Casualty Company
Jacob Hawblitzel signed by.Aetna Casualty and Surety�6ompany,
Harvey T.. Hager signed by Aetna Casualty and Surety company.
Ernest Traver signed by Columbia Casualty Company.
Unon the recommendation of i7m. F. �nalls,'the Board approved the petition
of the Indiana Bell Telephone Company to place aerial cable in the alley north of
Indiana Avenue, in Dubail and Prairie Avenue and to remove cable and -poles in Indiana j
:venue, as shown on print attached to petition of '�ecember 29th. , 1928.
Upon the recommendation of N. F. Qualls, the Board approved the petition
of the Indiana Bell Telephone Company to place I5-`feet of 2 inch iron pipe in the
alley,, in the rear of the New Indiana Lumber Company building in 0outh Michigan Street,
the uor'c being necessary in order to place a telephone cable between the new and old
buildings.
City -Engineer, H. G. 7Tra.y, submitted the following reports on remonstrances
filed:
' 1171ith the return of the attached remonstrance against the improvement on
Catalpa 'venue, I submit the following report:
There are I2 resident property owners residing on this street, 3of whom
have signed the remonstrance. This number does not constitute a majority and I would,
therefore, recommend that this improvement be advertised for bids.

'iNith return of the. attached retonetanance against the improvement of
Bartlett Street from 1.7ichigan street to Riverside Drived, I submit the following re
port:
There are 6 resident freeholders residing along this proposed improvement,
5 of ,jhom have signed the remonstrance. This constitutes a majority -and I would,
therefore recommend that no further action be taken in the matter.

In the ratter of the report against the improvement of Bartlett It.reet
• which shows that a majorty of resident property owners have signed the remonstrance,
the Board approved the ecommendation of amity engineer, H. Ct. `:''dray, and rescinds
all former action taken on said resolution and declares saY:ie null and void and the
rroceedings closed.
In the matter of the report on the rernonstra,nee against the -,�a verient of
Catalpa Avenue, the Board approves the recommendation of City -Engineer, and hereby
orders bids to be opened for said improvement in so far as the remonstrance did
not carry a majortty of resident property owners and sustains all former action to -en
on said improvement resolution.
This being the date set, hearings -were had on the following improvement
reso lotions ;

Improvement Resolution No.2I7I for the pavement of longley Avenue
from Wilber Street to -Johnson

In all of the above named improvement resolutions, no remonstrators
appeared and no written remonstrances were filed and the Board, being fully advised
in the premises, finds that the benefits to the..several lots and parcels of land
liable to be assessed for said improvements will be equal to the estimated costs of
sarge as reported by the City Engineer. The Board, therefore, decides to to to final
action on all of the above named improvement resolutions and declares same in all
things ratified, confirmed and approved without modification.
In all of the above named improvement resolutions numbered 2I7I,
2I69 and 2I70, the Board hereby orders that of the I5th., day of January I929; this
Board.will receive, open,land read sealed proposals for Vae construction of said
improvements up to Ie-00 A. M. The Board further orders that notices ofsaid proposals
shall be published on the 4th. January of day
and on the IIth. , day of January I929
in the South Bpnd News Times and Tribune according to law.
This being the date set, hearing was had on Improvement Resolution
No.2I73 for the ra-Tement of Portage Avenue from noint southerly line of Lot TT3 'Portage
Park Addition bro�jected to [eller Street.
In the above named improvement resolution, remonstrators appeared
but no written remonstrance -was filed and after he:!�=,ring all persons present Ao were
interested in said improvement and being fully advised in the premises, the Board
finditethat the benefits to the se-reral lots and parcels of land liable to be assessed
for said improvement will be equal to the estimated cost of same as re -ported by the
City - gineer. The Board, -
therefore, takes final action on said improvement resolution
and declares same in all things ratified, confirmed and approvedwithout modification.

This being the date set, hearing was had on Revised Zodified
Resolution No.4 for Grade 6eparation Mork as adopted on November 2-Ist. , I928.
In the above named Revised Fflodified Resolution No. 4, no remonstrat
ors appeared and no written remonstrances were filed and the Board decides to take
final action on said resolution and decla-es same in all things ratified, confirmed
and a -proved as originally adopted. The Board now orders said modified resolution
referred to the Common council of the `it:r of South Bend for ratification and approval
by the city Council.

r This being the date set, hearing was had on the assessment roll
for the sewer and pavement improvement in Belleville Ist., Unit under Improvement
Resolution N0.2062, and also for the pavement of the north 3 of Ford Street under
Improvement Resolution No.2093; and also for the pavement of -the east Al of Ford street
under Improvement Resolution No.2095.
In the above named assessment rolls, no remonstrators appeared and
no written remonstrance was filed and the Board, being fully advised in the premises
finds that the several lots and parcels of land have been benefited in -the amounts
named on said primary assessment roll. The Board, therefore, decides to take final
action on said primary assessment roll and declares same in all things ratified,
confirmed and ar_proved without modification and the proceedings closed. The Board
now orders said assessment roll delivered to the Lepartment of finance.
This being the date set, hearing was had on the assessment roll

Improvement Resolution 11o.2096.
In the above named assessment roll no re-onstrators appeared and
on written remonst~°anee was filed by Jones and Obenchain, attorneys, for George J.
Hoffman et al.
After hearing all rersons interested in said assessment roll and
being fully advised in the premises, the Boa °d finds that the several lots and parcels
of land primarily assessed for said improvement have been benefited in the amounts
named on said primary assessment roll. The Board, therefore, ta`ces final action on
said assessment roll and declares same in all things ratified, confirmed and approved
without modification and the proceedings closed. The Board now orders said assessment
delivered to the Department of Finance.

strance against the assessment for said railroad. After hearing all persons inter- ."
ested in said assessment roll and being fully advised in the-ore-mises, the Board
finds that the several lots and parcels of land have been ben;ited in the amounts
named on said primary assessment roll. The Board, therefore, decides to over rule
said remonstrance, and takes final action on said primary assessment roll and declares
same in all things ratified, confirmed and approved without modification and the
roceedings closed. The Board now orders said assessment roll 'delivered to the
