Improvement Aesolution No.2074. 1 In the above named assessment roll, remonstrators appeared and the following written remonstrances were filed; �! After hearing all persons interested in said assessment roll and being fully advised in the premises., the Board finds that the several This and parcels of land primarily assessed for said improvement are specially benefited in the amounts named on primary assessment roll. The Board, therefore, decides to paver rule said remonstrances, and takes final action on said assessment roll, declaring same in all things ratified, confirmed and approved without modification and the proceedings closed. The Board now orders said assessment roll delivered to the Department of Vinanc e. This being the date set, hearing was had on the assessment roll for the sewer and pavement improvement in Summit Place Fifth Addition under Improvement Resolution No.2078. In the above named assessment roll, one remonstrator appeared and filed a written remonstrance against the assessment levied against Lot No. I495 Summit Place Fifth Additi-on, in the hamef_of Clement Studebakerip Estate. Said remonstrance was filed by Feig and T-iurwich, attorneys. After hearing all persons interested in said improvement assessment roll, and being fully advised in the premises, the Board decides to ever rule said remonstrance, and finds that the several lots and parcels of land primarily assessed for such improvement, have been benefited in the amounts named on said assessment roll and therefore, the Board takes final action on said roll, and declares same in all things ratified, confirmed and approved without modification and the proceedings closed. The Board now orders said assessment roll delivered to the Department of Finance. This being the date, hearing was had on the awsessment roll for the Iavement on Jefferson Street from Walnut Street to Cherry Street under Improvement Resolution No.204I. In the above named assessment roll, no remonstrators appeared and no written remonstrance was filed and the Board, being fully advised in the premises, finds that the several lots and parcels of land primarily assessed for said improvement have been benefited in the amounts named on said roll. The Board, therefore, decides to ta'ce final action on said assessment roll and declares same in all things ratified confirmed and ap1roved without modification and the proceedings closed. The Board now orders said assessment roll delivered to -the Department of Finance. This being the date set, hearing was had on the assessment roll for the pavement on Kinyon Street from east 1 i4e of Portage Avenue to east line of Lot 181 ftortlz west Addition under Improvement Resolution No.2I03. In the above named assessment roll, no remonstrators appeared and no written remonstrance was filed and the Board, being fully advised in the premises, finds the.t the several lots and parcels of land primarily assessed for said improve went have been benefited in the amounts named on said primary assessment roll. In the above named assessment roll, no remonstrators appeared and no written remonstrance was filed and the Board, being fully advised in the premises, finds that the several lots and parcels of land have been benefited in the amounts named on said primary roll. The Board, therefore, decides to take final action on said primary assessment roll and declares same in all things ratified, confife,zed i! and approved without modification and the proceedings closed. Barnes for the improvement { in Summit, Place fifth Addition under Improvement Resolution No.2078, signed by the United States Fidelity and Guaranty Co., in the amount of 7,644.14. i The Board approved the renewal certificate for the Contractors Bond in: favor i 2,70 Itednesday, November 2Ist., 1`928. of Hay Wesver Co., signed by the American Surety Company n the amount of I,000.00. The Board signed the contract with Eston� Tial 1 for the grading of the alley west of Tfiami Street from rairview Avenue tocenter line of Ist., alley south of Fairview Avenue and the construction of retaining wall under Improvement Resolution No.2130 in the amount of 212.-50. The Board also approved roved the construction bond of same for I50� of the contract price signed by Maryland Casualty Co.* The Board approved the recommendation of 'Wm. F. walls for the -installation of'4000 lumen light at IN-1.1ber Street between Humboldt and 'i,'lwood Avenue at a cost of 45.00 per year. City Engineer, '1R. Bids having been received for the grade, curb and walk improvement on 35th., Street under Improvement Resolution No.2145, the Board this 2Ist., day of November 1928, hereby awards the contract for said Improvement to Harry X. Barnes at his bid of 3,078.20. Bids having been received for the pavement of Sample Street from west line of Olive Street to west property line of N.J. I.; I. R. R., under Improve meat resolution No. 2144, the Board this 2Ist., day of November 1928, hereby makes a preliminary order or concrete pavement heavy traffic as the type of pavement with which said -street shall be improved and sets the 4th. , day of December 1928, as the time when said Board shall either act on petitions for a change in the type of pavement other than that specified in the preliminary order, award the contract or reject all bids. Wray, filed the following primary assessment rolls: Assessment roll for the pavement on Napier Street from Walnut Street to east curb line of Cherry Street under Improvement Resolution No.2044. Assessment roll for the pavement on Altgeld Street from west line of Yarine Street to east line of 1,iarni Heights Addition under Improvement Resolution No.2087. In both of the above named assessment rolls, the Board, hereby, orders that on the 5th., day of December 1928, this Board will meet in their office in the City Hall at 7-15 P. (2) The grade of Division street where the sane intersects the northerly rail of the old west cound main track and the southerly rail of the olt east bound main track of the New York Central Railroad Company shall be raised not more than three and twenty five hundreds (3.251) feet above the top of the southerly rail of the old west bound main track, the elevation of said track being 62.3I when referred to aouth Bend Datum and 147.52 ;,then referred to New York Central Railroad datum. Clearance shall be twelve and one half feet (I21) below the surface of the street as fixed above and the superstructure over said !, street; the grade of said street under the superstructure shall be level; the grade of the approach of said street north from a point thirty feet (30') north of said old west bound main track shall be a descending grade of nine hundredths feet (.091) in t each one hundred feet (I001) until it intersects t -e present grade of street at the center line of Dunn Street. (8) Prairie Avenue; At the intersection of Prairie Avenue and the tracks of said railroad, the surface of said avenue from a 'point eleven feet (III) north, to a point one hundred ninety-seven feet (197t) south of the center line of the old west bound main track, shall be depressed one and eighty three hundredths feet (I.831) below the top of the south rail of the old west bound main track, the elevation of said south rail being 64.28 when referred to South Bend datum and 149.49 when referred to New York Central datum. Clearance shall be twelve'mnd one half feet (12.51) between the surface of the avenue as fixed above and the bottom of the superstructure over said avenue. The grade of said avenge under the superstructure shall be level. The grade of the approach of said avenue from a point eleven feet (III) north of the center line of old wrest bound main track shall be an ascending grade along the two (2) vertical curves each fifty feet (501) in length and the grade of the approach south from a point one hundred and ninety-seven feet (1971) south of the center line of said old west bound main track shall be an ascending grade along two (2* vertical curiren each fity feet (501) in length. That prairie Avenue has been increased in width ten feet (I01) south of the right of way of said vailroad to a total width of seventy feet (70) and it is orders that said avenue be opened to a width of seventy feet (701) across said right of way, and that a subway shall be construction for said width of seventy feet (701). (9) The grade of South Street which intersects Scott Street and Prairie Avenge shall be changed and the grade of said South Street east from the east line of Scott Street, as established at No.6 above, shall be an ascending grade along two (2) vertical naves each sixty feet (WI) in length, and the grade of the .said South Street west of Prairie Avenye, as established at No.8 above, shall be a level grade, until it intersects the present grade of South Street. (JO). The grade of Taylor, which intersects Prairie Avenue shall be changed to conform to the north approach grade of prairie Avenye as fixed in No.8 above, and the grade of Taylor Street north of the intersection of said streets shall be an ascending vertical curve fifty feet (501 ) long. (II) Lafayette Street; At the intersection of Lafayette Street and the tracks i ,j �f said railroad, the surface of said street from a point forty three feet (43 ) !' north of the center line of old west bound main track to a point one hundred and fifty two feet (I521) south of center If said track shall be depressed one and fifty one hundredths feet (I.5I1) below the top of the south rail of the old west bound main track, the elevation of said track being 64.52 when referred to South Bend datum and 149.73 when referred to New York Central datum. Vettisal curves i sixty feet (601) in length shall be provided at the upper and lower ends of the I south approach. I (M . Train Street: At the intersection of Frain Street and the tracks of said railroad the surface of said street at a point twenty-two feet (221) south of the I center line of the old west bound main track shall .be depressed three and ninety-seven hundredths feet (3.97t) below the top of the south rail of the said track, at said intersection, the elevation of said rail being 65.32 when referred to South Bend datum ,and 150.53 when referred to New York Central datum; clearance shall be twelve and one half feet (12.01) between the surface of the street and the superstructure ove said street; the grade of the approach north from a point fifty-two feet (52�1) south of the center line of said track shall be an. ascending grade of one and two hundredths feet (I.021) to each one hundred feet (I001) until it intersects the present street grade. The grade of the south approach from a point fifty-two feet (521) south of the center line of said track shall be an as cending grade of three and twenty-two hundredths feet (3.22t} to each one hundred feet (IOOt) until it intersects the present street grade. !,Vertical curve sixty feet (60t) in lengthshallbe provided at lower and of approaches Wand fifty foot (50t) vertical curves at upper ends. ! The elevation of said track being 67.66 when referred to South Bend datum and.I52.87 when referred to New York Central datum; clearance shall be fourteen feet (I41) between the surface of the street as fixed above and bottom of the surer "structure over said street. The grade of the north approach from a point eighty - .seven feet (871) north of said center line of the old west bound main track shall be an ascending grade of two and one-half feet_(22') to each one hundred feet (IOO') until it intersects the -present grade of Fellows Street, except that vertical curves • sixty feet (601) in length shall be provided at the upper and lower ends of said ;grade. The grade, of Raymond Court shall be changed so as to conform to the grade of Tiami Street and shall ascend on a grade of five feet (51) to each one hundred feet (1001 ) from a point twenty feet (201 ) each of the east line of Yiami Streetuntil it intersects the present grade of Raymond Court. (now Pennsylvania Railroad Company), Indiana Northern Railway Company, Oliver Chilled Plow Company, and Studebaker Corporation, whose tracks intersect or connect with the tracks of the New York- Central Railroad Company, if said comranies or any of them shall desire to keep and maintain said -connection, shall be raised so as toconform to the grades of said New York Central Riilroad Company as herein established and make rroper connections with same. (35) That the said improvement shall be made and paid for accord- ing the method and manner provided for in an Act of the General Assembly of Indiana of 1923t Page 110, or any other law applicable thereto.
