Assessment roll for the pavement of the Ist. , alley north of ZaSalle Avenue from Laporte Avenue to Cottage Grove Avenue under improvement Resolution No.2115. ; In all of the above named assessment roll$, the Board.hereby orders that on the 3Ist. , day of October 1928, this Board will meet in their -office in the. City Hall at 7-15 P. Y., to hear and receive remonstrances from all. persons whose property has been assessed for said improvements and will decide whether the several lots and parcels of land have been or will be benefited in the amounts shown on said primary assessment rolls or in a greater or less sum than that shown on said rolls. The Board further orders that notices of said hearings shall be published on the 26th., day of October and on the 27th., of October 1928 in the South Bend News Times and Tribune according to law. City Engineer H. G. 111ray, filed primary assessment roll for the pave- ment of the alley between Lot I R.Tiller Addition and Lot 8 ' Fuerbringers Addition from Oak Street to alley south of Oak Street under Improvement. Resolution .No.2I47. In the above named assessment roll, the Board hereby orders that on the 3lst. , day of October I928, this Board will meet in their office in the City Hall at 7-I5 P. Y., to hear and receive remonstrances from all persons whose property has been assessed for said improvement and will decide.whether the several lots and parcels of land primarily assessed for said improvement have been benefited in the amounts named; on said roll or in a greater or less sum than that named on said roll. This being the date set, hearings were had on the f ollowin improvement resolutions: Improvement Resolution No.2I45 for the grade, curb and walk improvement on 35th. , Street from Grand Trunk destern R. R. to the north line of Lots II2c and 94 in Berton Addition. (see files for resolution.) 11 Improvement Resolution No.2I44 for the pavement of Sample Street from the west line of Olive Street to the west property line of the X. J. & I. R. R. (see files cor cop_;r of res olution. ) In both of the above named improvement resolutions, no remonstrators appeared and no written remonstrance was filed and. the Board, being fully advised in the premises, finds that the benefits to the several lots and parcels of land liable to be assessed for said improvement will be equal to the estimated cost of same as reported by the City Engineer. The Board, therefore, decides to tal final action on _said impro .11 vement resolutions No..2145 and No.2144, and declares same in all things ratified, confirm- ed and approved withg4t modification...., • • 0 • 251 1ednesday Evening, Oc' ober 24th. 1928. 0 • 1�• U • i In both of the above named improvement resolutions, the Board hereby. orders that on the 7th. , day of govember 1928, this Board will receive, open and read sealed ;.proposals for the construction of said improvements up to 7=I5j P.7. The Board further orders that notices of -said proposals. shall be published on the 26th. , day of !Octob.er and on the 2nd. day of November T928, according to law. This being the date set, hearings were had on the following improvement resolutions: Improvement Resolution No.2I42 for the local sewer improvement in Southwood Avenue from Harriett Street to Gr eenlawn avenue. ( See files for copy of resolution.) Improvement Resolution No.2I46 for the local sewer improvement in PtBrien Street from Werwinski Court to the first alley north -of Werwinski Ct. ; also, Werwinski Court from Johnson street to O'Brien Street. (See files for copy of resolution.) Improvement Resolution No.2I43 for the local sewer in Olive Street from Lincoln `day �Alest to Elwood Avenue. ( see files for copy of resolution.) In all of the above named improvement resolutions, no remonstrators appeared and no written remonstrance was filed and the Board, being fully advised in the premises finds that the benefits to the several lots and parcels of land liable to be assessed for said sewers will be equal to the estimated costs of said sewers and that these improvements are necessary. The Board, therefore, takes final action on said improvement resolutions No.2142, No.2I46 and No.2I43, and declares same in all things ratified, confirmed and approved without modification. The Board further order that notices of said proposals shall be published on the 26th. , day of aato:bbr; and on the 2nd., day of November 1928, according to law, in the South Bend News Times and Tribu This being the dat* set, hearing was had on the assessment roll for the grade, ;curb and walk improvement on Orange Street from Birdsell Street to alley west of Birdsel ,Stre6t under Improvement Resolution No.2OI8. In the above named assessment roll, no remonstrators appeared and no written ;remonstrance was filed and the Board, being fully advised in the premises, finds that ,the several lots and parcels of land have been benefited in the amounts named on said •assessment roll. The Board,therefore, takes final action on said assessment roll and declares same in all things ratified, confirmed and approved without modification and ,the proceedings closed. The Board now orders said assessment roll delivered to the Department of Finance. City Magineer, H. G. 7&av, submitted the following partial estimates: Partial estimate No.2 for the light traffic sheer asphalt pavement on Napier Street from�lalnut Jtreet to the east curb lineof Cherry Street, in accordance with the ,terms of the contract between the City and the Rieth Riley Construction Company, contract °ors under Improvement Resolution No.2044. the Board signed and a -proved same in the ;amount of 12,999.0.7. Partial estimate No.2 for the h�,avy traffic sheet asphalt pavement on Victoria 'Street from the east curb line of Miami treet to the east line of Miami Heights Addi- ti on, in accordance with the terms of the contract between the City and Rieth Riley Construction Company, contractors, under Improvement Resolution No.208a.. The Board signed and approved same in the amount of 7,512.47. Partial estimate No.I for the light traffic sheet asphalt pavement improvement on Jefferson Street from Walnut Street to Cherry Street, in accordance wit the terms of the contract between the City and Rieth Riley Construction company, contractors, under Improvement Resolution No.204I. The Board signed and approved same in the amount of I14,49I.74. The Board approved the redommendation of H. G. Wray to allow Rocco 0imeri install a house connection -at I7I4 South Scott Street at his price of 48.00. City Engineer, H. G. Wray, filed plans and the Board adopted said plans together with the following vacation Resolution: Vacation resolution No.2153. Resolved by the Board of Public iIorks of the City of South 'Bend, Indiana, that .,it is desired to vacate the following: Beginning at the southeast corner of Division Street abd Sheridan Avenue thence ii !east albhg the south line of Division Street I237 feet, thence north 20 feet, thence ,rest 44 feet, thence southwest 85.37 feet to point of beginning. Also beginning at the intersection of the north Zinc of Division street and the ,east line of Sheridan Avenge produced, thence east along the north line of Division Stree� 111127 feet thence south 20 feet, thence west 44 feet thence northwest 85.37 feet to point of beginning. 2 2 "Wendesday 11,rening October 24th. , f928. Notice of this resolution shall be published on the 26th., day of October and on the 2nd. ip day of November 1928, in the South Bend News Times and Tribune according to law. Kass" The Board approved of the New York Central Railroad in the amounts of 8,506.28 and $52,505.28 for track elevation work and hereby orders gity Contrbll�p? to pay same out of track elevation fund. The Board also approved the claim of Edward Pfeiffer for Work in. connection with the sale, of the property on Ohio and Marietta Streets for track elevation work and the Board hereby orders Sity- Controller to pay said claim in the amount of $40.00 our of track elevation fund. This being the date set, continued hearing was had on assessment roll for the ravement in Lincoln 1anor and Kaley's Lincoln '-iighway Addition under Impro- vement Resolution No.2092. In the above named assessment roll, remonstrators appeared but no written remonstrance was filed and after hearing all persons interested in said assessment roll, the Board decides to modify said roll by reducing the assessments on all inside lots in said additions and spreading the increase on all corner lots as shown on said roll. in red. with this modification, the Board finds that the several lots and parcels of land are beneffted in the amounts. shown on said modifie roll and therefore the Board takes final action on said roll and declares same in all things ratified, confirmed and a pprotred •as modified and the proceedings closed. The Board now orders said modified assessment roll delivered to the Department of Finance. .This being the date set, hearing was had on the assessment roll for the pavement on 22nd. , Street from Jefferson street to the south line of Pleasant Street under Improvement Resolution No. 2064. In the above named assessment roll, remonstrators appeared but no written remonstrance was filed and the Board, after hearing all persons interested in said roll and being fully advised in the premises, orders City Engineer to investigate the charges on certain lots for 6 inch pipe, which charges were claimed by property owners to be unjust, and if found to be incorrect to deduct from the original assessments the amounts erroneously charged. With these modifications, the Board finds that the several lots and parcels Of land have been benefited in the amounts shown on said assessment roll, and the Board, ,_therefore, takes final action on said roll and decla-es same in all things ratified, confirmed and approv- ed as modif-iedaand the proceedings closed.
