Board met in regular session at 9 A. M. Mr. ff. R. Hinkle and Mr. John
J. Ole jniczak absent.
Due to the lack of a quorum, no business was transacted and all business
i scheduled for this time will be taken up .at the regular meeting on Wednesdar evening
at 7-15 P. V.

Board met in regular session at 7-15 P. Y* All members present.
Mr. H. G. 'dray, City Engineer, and Charles 4. Cole, engineer, also present.
This being the date set, continued hearing was had on Vacation Resolution
No.2140 for the vacation of the first alley east of Stanfield Street (a strip of land'al
along the east line of Harter Heights End., Addition) from Napoleon Street to Angella"
Avenue.
In the above named vacation resolution,- remonstrators appeared and
a written remonstrance was filed and the Board, after hearing all persons interested
in said vacation resolution, decides to continye hearing on same until Tuesday,
October 23rd., I928, at I0:00 A. M.
City Engineer, H. G. Wray, filed primary assessment roll for the pave
meat on 22nd., Street from Jefferson Blvd., to south line of Pleasant Street under
Improvement Resolution No. 2064.
In the above named assessment roll, the Board hereby orders that on
the 24th. day of October 1928, this Board will meet in their office in the City;
Hall at 7-I5 P. M., to hear and receive remonstrances from all persons whose property
has been assessed for said improvement and will decide whether the several lots and
parcels of land have -been or will be benefited in the amounts named on said roll.
The Board further orders that notices of said hearing shall be published on the
I9th. , ray of October and on the 20th. , day of October 1928, in the South Bend News
Times and Tribune according to law.
This being the date set, continued hearing was had on the following
assessment rolls:
Assessment roll for the pavement of Iadison Street from Palmer Blvd.,
to Harriett/Street under Improvement Resolution No.2083.

Assessment roll for the pavement and sewer improvement in Lincoln banor
Third Addition under Improvement Resole-tion No.208I.
In both of t he above named assessment rolls, no remonstrators appeared
and no written remonstrances were .filed and the ,Board, being fully advised in the
premises, finds that the several lots and parcels of land primarily assessed for said
improvements have been benefited in the amounts named on said primary rolls. The
Board, therefore, takes final action on said assessment rolls, and declares same in
all things ratified, confirmed and aplx-oved without modification and the proceedings
closed. The Board now orders said assessment rolls delivered to the department of
Finance.

and no written remonstrance was filed and the Board,, being fully advised in the
premises,, finds that the benefits to the several- lots and parcels of land `liable to
to be assessed for said improvement will be equal to the estimated cost of same, as
reported by the City Fmgineer. The Board, therefore,,. tares final action on said
Improvement Resolution No.2141 and declares same in -all things ratified, confirmed
and approved without modification. The Board now orders that on the 30th.' day
of
October 1928, this Board will receive, open and read selaed proposals up to 10:00
�• A. IT., for the construction of said improvement. The Board further orders that

notices of said proposals shall be published on the 19th., day of October and on
the 26th., day of October 1928, according to law.

to the south line - of N. Y. C. R. R., under Vacation Resolution No.2085.

In the above named assessment toll, no remonstrators appeared and no written
remonstrance was filed and the Board, being fully advised in the premises, finds that
have been benefited and damaged in the amounts shown on said assessment roll, and the
Board, therefore, decides to take final action on said primary assessment roll and
declares same in all things ratified, confirmed and apPr otred without modification
and- the proceedings closed. The Board now orders said assessment roll delivered to
the Department of Finance.
This -being the date set, continued hearing was had on the assessment roll for
the condemnation for opening alley south of Bronson Street from Michigan Street, to
Ist., alley east of Michigan Street under Condemnation Resolution No.2086.

ment roll and being fully advised in the premises, the Board finds that said lots Li

ment roll, declaring same in all things ratified, confirmed and approved without , i

In the above named Vacation Resolution No.2149, the .Board orders that on the 11

to hear and receive remonstrances from all nersons whose property may be affected by 1j
such vacation. The Board further orders that notices of said vacation shall be publishli

the pavement improvement in Lincoln Yanor and 4aley Is Lincoln Highway Addition under
Improvement Resolution No.2092.
In the above named assessment roll, remonstrators appeared but no written
remonstrance was filed and the Board after hearing all persons interested in said
assessment roll, decides to continue hearing on said assessment until ,October 24th.,
1928, at 7-15 P. Jr...
The Boa-rd approved the -purchase of filing equipment for the Controller -Is
office from the Book Shop at a cost of 198.00. Same ordered.
Upon the recommendation of 71m. F. Qmaj]Ls, the Board approved the installation
of six I000-lumen lamps at the cuossing of Division and Walnut Streets and the New
Yor1c Central tracks at a cost of 132.00 per year. Same ordered.
The Board approved tae following renewal certificates:
0. X. Plumbing Co., for 4xcavati6n Bond in the amount of $I,000.00,
Ben W. Mumaw, for Excavation Bond in the amount of 31.000.00,
The Board approved the contr'aetors, bond for one permit for L,. A. Wieezorek
in the amount of $I,,000,00.

The Board approved the Guarantee bond -of the Albert Construction
Companyfor the sewer and pavement improvement in Lincoln Manor Third addition under
I' Improvement Resolution No.208I in the amount of $4,349 86 signed by Inland Bonding doil
The Board approved the Guarantee Bond of the Albert Construction Co.
for the pavement improvement in Lincoln Manor and Xa ley ► s Lincoln Highway Add it ion ,
under' improvement Resolution No.2092 in the amount of $I5,419.95 signed by the
�! Inland Bonding Company.

Upon the recommendation of I. S. Romig, the Board accepted and - •
appr oved the deed from 'Rhitcomb and Keller for a tract of land sixty feet in width
measured at right angles and Northerly of the following described line: Beginning
j at a point on the hest line of Greenlam Avenue 1233.3 feet north of the North line
of Mishawka Avenue as now located; thence westerly curbing to the North on a 7 degree
I' and 37minute curiae 189.5 feet (the tangent to, said curve makes a left angle with

Greenlavm Avenue - of 82 dbgr0a .and 45 minutes'); thence curving to the South on a I
degree curve 429.5 feet; thence curbing to the South on a 2 Degree an&srM minute
curge 528.5 feet • , thence curving to the North on a 8 degree and 7 minute curve 107
1' feet to the east line of Harriett Street, the west 400 feet of said tract is _to be 63
feet wide instead of 60 feet wide, to be used. for highway purposes. (The above descrip

�i RFSOLVTD:
I I. That the Board of Public 'florks of the City of South Bend, Indiana
does hereby adopt the attached plans and specifications for lighting Chapin Street
from Washington Street to Ford Street, Miami Street from Lincoln Jay Wasi to Irving
Avenue, College Street from Erlwood Avenue to Keller Street and Angella Avenue from
Deeper Avenue to Notre Dame Avenue, all in the City of South Bend, Indiana, and the
Form of Contraek emboStying the same which the Board p providing a
proposes to enter into
satisfactory bid for said �! lighting is received. Copies of this resolution and of said plans and specifications shall be kept on file at the office of the Board for

the use of bidders and other interested persons.

light and the necessary maintenance of same for the lighting of Chapin O'treet from
Washington Street to Ford Street, Miami Street from Lincoln Way 'Ihst to Ewing Avenue,
College Street from Elwood Avenue to Keller Street and Angella Avenue from Leeper
.venue to Notre Dame Avenue, all in the City of South Bend, in accordance with plans

the City of South Bend; _ Indiana, endorsed "Proposals for Public Lighting" with the name
of the person or coporation making the bid, will be received by the Foard of Public
Works when called:; for during the meeting of said Board of Public `forks to be held at
its meeting place in the City Building in the City of South Bend at the hour of I0:00
O' Clock A. M. , on -the 30th. , day of October 1928, and immediately thereafter, at said
time and place and during said session of said Board of Public 'forks, all bids received
will be publicly opened and read and the awarding -of the contract, if awarded, will'
i 'be made by reso;ution of the Board of Public Works as soon thereafter as practicable.
All bids shall be upon the attached form prepared therefor by the Board of Public Works
I� or upon a form siibstantailly similiar thereto. The Board reserves the right to reject
any and all bids.
3. That each bidder shall file with the Board of Public Works of the
City of South Bend, with hid bid, an affidavit as required by law, stating that sue
it bidder has not directly or indirectly entered into any combination, collusion, under-
taking or
agreement with any other bidder to main the price of the service' or contract
herkin specified or to prevent any other bidder or bidders from bidding on such
service or contract; and that such bid is made without regard or reference to a#y other:
bid of bids and without any agreement, undertaking or combination either diredttly or

persons, firm or corroration with reference to such bidding
in any way or manner whatsoever.
4. That the said Board, on behalf of -the City, cause to be published
in the South Bend Tribune and the South Bend News Times, newspapers

lation printed and published in said City of South.Bend, a notice informing the public,
and contractors of the general nature of the proposed lighting and of the fact that
plans and specification therefor and the form of contract to be entered into with the u
successfuly bidder, and form of ordinance approving same, are on file in the office of ' '
said Board of Public Works for the use of bidders and otherinterested persgms, and
that sealed proposals for such lamps and light and the maintenance t'.iereof in accordance
with plans and sneeifications =rill be Balled for and received during the meeting of
said Board of Public I -Yorks to be held in its office At the time and place above
fixed. Said notice shall be published in said newspapers once each week for two
successive weeks, the first publication to be at least ten days prior to the date fixed'
for receiv6ng bids. The Clerk of said Board is hereby ordered to cause publication of
notice to be made in accordance herewith.
