238 4ednesday.., . October 3rd. , .2928. k absent. rolls: Board met in regular session at 7-15 P. Y. John J. Ole jniczalc City Engineer, H. G. Wray, filed the following primary assessment Assessment roll for the pavement of the firs alley east of 23rd. Street from Mishawaka -Avenue to `Fall Street under Improvement `esolution No:.2098. Assessment roll for the resurfacing of North Shore *rive from`, `a point 150 feet west of the west line of Lafayette Street to the west line of Irquois Street under Improvement Resolution No.2076. In both of the above named assessment rolls, the Board hereby orders; that on the 9th., day of October 1928, ,this Board will meet in their office in the City Hall at I0:00 A. Y. , to hear and .receive remoras trances from all persons whose property has been assessed for said improvements and will decide whether the several lots and parcels of land primarily assessed for said improvement have been or will be benefited in the amounts named on said rolls, or in a greater or less sum than that named on said rolls. The Board further orders that notices of. said hearings shall be published on the 5th. , da�yy of October and on the 6th. , day of October 1928 in the South Bend News Times and ``wribune according to law. This being the date set, hearings were had on the following assess- men t rolls: Assessment roll for the pavement on Chapin Street from Calvert Street to Ewing Avenue under Improvement Resolution No.2079. Ass ssment roll for the .pavement on Kendall Street from alley north of Orchard Street to '�unham Street timder Improvement Resolution No.2042. Assessment roll f r the pavement of the south one half of �destmoor street- from the west line of Olive 11treet to the Fast line of Lincoln Manor Third Addition under Improvement Resolution No.2094. In all of the above named assessment rolls, fib :r6mons.trators appear ed and no written remonstrance was filed and the Board being fully advised in the premises, finds that the several lots and parcels of land have been benefited in the amounts named on said assessment rolls. The Board, therefore takes final action on said assessment rolls, declaring same in all things ratified, confirmed and appr owed without modification and the proceedings closed. The Board now orders said assessment. rolls delivered to the department of Finance. 0ity Nagineer' , submitted Partial estimate No.I for the light traffic' sheet asphalt pavement improvement on Napier Street from Vialnut Street to the east curb line of Cherry Street, in accordance with the terms of the contract between the City and the Rieth Riley Construction Company, Contractors, under Improvement Resolution N0.2044. The Board signed and approved same in the amount of 3,I48.74. City Engineer submitted Partial estimate No.I for the heavy traffici. sheet asphalt pavement improvement on Victoria Street from the east curb line of Yi ami Street to the east line of Viami Heights Addition, in accordance with the terms of the contract between the City and the Rieth Riley construction Company under Improve ment Resolution No. 2088. The Board signed and approved same in the amount of 9, I48.34. The Board approved the driveway at IZI East Madison Street. This being the date set, bids were received, opened and read for the grade, curb and walk on the South Side of florin Street from a point 131.37 ft., west of the east line of Madison Park Addition t n the east line of Madison Park Addition under Improvement Resolution No.2I36. Bids are as follows: H. N. Barnes Frame and Zimmer walk . I8 .20 curb .50 .50 grading .90 1.00 City. Engineer, filed plans, specifications and estimates and the Board adopted said plans and specifications together with the following improvement resolution: Improvement Resolution No.2I47 for the pavement of the alley between Lot I in Millers Addition and Lot 8 in Flaerbringer's Furst Addition from Oak Street to the first alle�T south of Oak Street. In the above named improvement resolution No.2147, property owners waived all right of objections on and in defense to any defect in said proceedings, and to any violation in procedure for the construction of street improvements as fined by law. The Board approved a driveway at the corner of Michigan and tgeld Street for the Shell American Petro laum (343:. The Board approved the Guarantee bond of I. W. Staples for the local sewer system in Lincoln Manor Ad�it ion, under Improvement Resolution No.I982 in the amount of 3,006.91 signed by the, ommercial Casualty Company. Claims amounting to 269.37 signed and approved by the Board. The Board approved pay roll claims in the engineering department in the amount of 72.00 and hereby orders the City Controller to pay same out of track elevation fund. The Board approved the extra order No.I to Rieth Riley Constructin Company for the alteration of street grades dated September 4th., 1928, in connection with opening temporarily of Sample and Fellows Street beneath the subway structures/for traffid: The items of work to be done at the above locations will be Taid for at the unit prices. breva ling in _gad ©ontract of September 4th. , 1928.
