'Tuesday, July 24th. , 1928.
Board met in regular session at 9 A. Tr. All members present.
Minutes of :Imeetings held July 17th. , and July 18th. , 1928, read and
i approved.
The Board signed the contract with Albert Construction Company for the
pavement on O'Brien Street from Lincoln `ray 4est to Elwood. Avenue under Improvement
Resolution No.20351 in the amount of 27, I73.20. The Board also approved the con-
struction bond of same for 50% of the contract price signed by Inland Bonding Co.
l'he Board. approved the excavation bond of Robert Thorpe in the amount
of 1,000.00 signed by Fidelity and Casualty CO., of New York.
The Board approved the renewal certificate fzr the excavation bond
of Louis Stoll signed by Lletropolitan Casualty Insurance o.
The Board approved the Guarantee Bond of 41iilistoq Construction ompany
for the improvement on 2Tst. , Street from Jefferson to }Wilson treet under Improve-
ment Resolution No.2056 in the amount of 1,069.03 signed by Inland Bonding Co.
In the matter of Improvement Resolution No.2068 for the pavement on
Angella Avenue from Leeper Avenue to Bast line of Harter 'Heights Addition, the
Board hereby rescinds all former action taken on said resolution and declares same
null and void and the proceedings closed. -
This being the date set, hearing was had on Supplementary Resolution
No. Ii74B with reference to Northwest Irunk and 'pub -trunk Sewer Improvements.
In the above named improvement resolution No.1774B, no remonst_:,tors j
appeared and no written remonstrance was filed and the Board, being fully advised
in the premises, finds that the district or area is properly bounded f4 the purpose';
of such drainage and that the sub -trunk districts or areas are properly bounded
for the purpose of draiina-gb-bfhimkch subtrunks; that the real estate included in such !,
district will be benefited by such drainage; that the special benefits to the
several lots and parcels of land within such area or sub -trunk areas and the City
by reason of such proposed improvement, will be equal to the estimated cost of said
improvement. The Board, -therefore, decides to take final action on said supplemental
resolution No.1774B, and declares same in all things ratified, confirmed and approved
and the proceedings closed.
This being the due set, hearing was had on Improvement Resolution
No.2I08 for the Bergan and Johnson *4treet Trunk Sewer.
In the above named improvement resolution, no remonstrators appeared
and no written remonstrance was filed and the Board, being fully advised, in the
-premises, finds that the district or area is properly bounded for the purpose of
such drainage; that the real estate included in such district will be benefited by
such drainage; that the special benefits to the several lots and parcels of land
within such area or district and to the City by reason of such proposed improvement
will be equal to the estimated cost of said improvement. The Board, therefore,
takes final action on said improvement resolution No.2I08 and declares aame in all
things ratified, donfirmed and approved without modification.
InXthe matter of Improvement Resolution l:To.2I08 for the Bergan and
Johnson Street trunk Sewer, the Board, hereby orders that on the 7th., day of
August, 1928, this Board will receive, open and consider sealed proposals for the
construction of said trunk sewer up to I0:03 A. Y. The Board, further orders that
notices of said proposals shall bepublished on the 26th. , day of July and on the
2nd. , da-r of August, 1928, in the South Bend News Times and Tribune according to
law.
This being the date s>et, hearing was had on the assessment roll for
the pavement and sewer improvement on Adams, College and Brookfield Streets in
C. R. Smiths Subdivision under Improvement Resolution No. I976.
In the above named assessment roll, no remonstrators appeared and no
written remonstrance was filed and the Board, being ful],y advised in the premises,
finds that the several lots and parcels of sand have been benefited in the amounts
named on said assessment roll. 'The Board therefore, takes final action on said
assessment roll filed July IOth., I928, and declares same in all things ratified,
confirmed and approved without modification and the proceedings closed. The
Board now orders said assessment roll delivered to the Department of Finance.
j� City Lngineer, H. G. Wray, filed -lans, specifications and estimates
and the Board adopted said plans and specifications together with Improvement
Resolution No.2I26 for the pavement of Angella Avenue from east line of Harter
iHeights Addition to Notre Dame Avenue.
it In the above named improvement resolution No.2I26, property owners
waived all objection on and in defense to any defect in said pr oceedings,and to any
violation in procedure for the construction of street improvements as fixed by law.
Whereupon the Board received, opened and read sealed proposals for the construction

At the request of 'Whitcomb and Keller, the Board rejected all bids
for the grading on Tasher Avenue under Improvement Resolution No.2075.
No petitions having been filed for a change in type of pavement other
than that specified in the preliminary order for the pa ement of the north I of Oakwood
Blvd., from Portage Avenue to Beverley Place under Improvement resolution No.2077, .the

Upon the recommendation of City attorney, I. S. Romig, the Board
approved the release of contractors bond executed in favor of J,. A. Barnes by the
Hartford Accident and Indemni ter company.
Upon the recommendation of City Attorney, I. S. Romig, the Board
signed the following agreement wJth the Chicago, ''outh Bend and Northern Indiana. Rail-
way Company regarding the pavement on Miami Street under, Improvement Resolution No.2060;
A'G R E E M E N T.
This agreement,made and entered into this 24th. , day of July, I928•,
by and between the City of South Bend, Indiana, through its Board of Public 'Iorj�s,
and R. R. Smith, Receiver for Chicago, South Bend and Northern Indiana Railway '-ompany,
a corporation duly created, organized and existing under the laws of the State of Indiana,
`1ITNESSETH:
iMVIREAS, under Improvement Resolution No.20609 of said Board of
Public Worts, approved by said Board on May 2nd. , 192 8, said City is about to pave that
portion of Miami Street lying between Lineolnway Fast and Ewing Avenue; all in the said
city of South Bend: And,
i`JHTRMS,the plans and specifications for said improvement contemplate
the wing by said City of said portion of said street from curb to curb, including the
space between the rails and tracks of a single and double track street railway line of said
Railway Company on the portion of said street lying between Indiana Avenue and Bowman
Street, ,as well as the space outside thereof; And,
!HER.EAS, said Rialway Company has Tnrepared plans and specifications
for the reconstruction of its tracks in the said portion of Miami Street.
NOW. THER 7ORE, it is agreed between the parties hereto that, in con
sideration of the construction (including the furnishing of. rraterial and labor.) and the
completion by said City of that portion of said pavement between and within the rails and
tracks of said company and the space one foot in width adjacent to and outside of each
of said track or tracks, according to the plans and specifications now on file with and
adopted by said BOARD OF -PUBLIC 'WORX3, said railway company hereby agrees to nay that
part of the cost of said pavement hereinaf#er specified. But it is expressly agreed be-
tween the parties that saki railway ';omrany shall be, entitled to and shall pay said part
of said cost on the ten year installment plan as provided by law, on the same bas-is as the
-privilege of said installment plan is extended to property owners abutting upon the line'
of said improvement. And said City hereby agrees to take all such steps, and to do all s
such things as may be necessary to be done by it to enable said Railway Company to pay
said nart of said cost in accordance with said installment plan.
IT IS FINALLY AGREED between the parties hereto that that Tart of such
cost so to be maid by said Railway Company shall be the excess of the cost of the
construction of said pavement in the area within and between said rails and one foot in
width adjacent to and outside of each track or tracks over what the cost of the construct-
ion of a pavement within said area would be if there were no street railway track in the
street.

The above agreement entere,: into after said Ra.ilwav Company received
an order from the United States 'Jistrict Court Northern Dis rict of Indiana. Division
of South Bend, Indiana, for the reconstruction Qf tracks on r`iami `street in the City
of South Bend, Indiana. And the -payment of extra cost incident to the pavement of said
portion of said street oeeassioned by the presence of said tracks.
Claims a--ounting to 12,034.63 signed and approved by the Board.
The Board also approved claims_amounting to 433.33 to be paid out
of track elevation fu&d and hereby order tUe City "ontroller to Tay same.
Upon the recommendation of Jm. F. ual.ls, the Board approved the
installation of a 4000 lumen light at the corner of Roberts Street alAd the alley
south of T'ishawa'a Avenue at a cost of 45.00per year. Same ordered. "
