this 3rd. , day of July, 1928, hereby makes a final order for sheet asphalt light
traffic pavement as the type of pavement with which said street shall be improved -
and
awards the contract for said improvement to Albert onstruction Co.,, at their
low bid of 5,I61.60 for light traffic sheet asphalt pavement.
No petitions having been filed for the change of the

of Johnson 'treet from Vassar Avenue to Elwood kvenue under Improvement iteso lut i on
No.2033, the Board this 3rd. , day of Ju3,y, 1928, hereby, ma kes a final order for sheet:

be improved and awards the contract for said improvement to Albert Oonstraction o.,
at their low bid of 15,849.62 for sheet asphalt pavement light traffic.
City 4igineer, H. G. Wray, submitted the following report
on the petition for a change in the type of pavement other than that specified in
the preliminary order for the pavement. of Adams Street from Lincoln Flay "est to
Humbolt 6treet under Improvement yes olution No.2027:
"There are 68 res dent property holders on this improve
meat, 37 of whom have signed the petition for a concrete pavement, this being a
certain k`nd of the kinds of pavement for which were received. This number consti-
toes a majority of the resident property owners, I would therefore recommend that
a final order be issued ,for concrete pavement on the above improvement. signed

The Board, therefore, approved ibr. sAJray's recommendation
And .hereby makes a final order for concrete pavement heavy traffic as the type of
pavement with which said street shall be improved and awards the contract for said
improvement to C. M. FLdred at his low bid of 17,743.50.

In the above named vacation resolution, the Board, hereby;
orders hat on. the 25th. , day of July, 1928, this Boardwill meet in their office

whose property may be affected by said proceedings. The Board further orders that
notices of said hearing shall be publishe on the 6th., day of July and on the I3th

No.1983.-
• In the above named assessment roll, no remonstrators appeared and no written
remonstrance was filed and the Board, being fully advised in the premises, finds that
the evveral lots and parcels of land primarily assessed for said improvement have been
benefited in the amounts named on said assessment roll. The Board therefore, takes
final action on said assessment roll filed July 27th., 1924 and declares same in all
things
ratified, confirmed and approved and the proceedings closed. The Board now
orders said assessment roll delivered to the Department of Finance.
At the request of Schuyler Ackerman and the American Surety Co., of New York
the Board signed a release from further liability on the $I,000,00 bond dated June
Ist.,,1923. This release effective only as to liabilities after this 3rd.,
day of
July 1928.
•The Board signed the contract with Harry N. Barnes for the improvement of
Streets in Summit Place Fifth Addition under Improvement Resolution 11o.2078. The Board
also approved the construction bond of same for 100% of the contract price signed by
the United States Fidelity and Guaranty Co.
The Board signed the contract with Snyder Construction Co., for the pavement of,
the first alley west of Miami Street from Broadway to Indiana Avenue under Improverpent
Resolution No.2065. The Board also approved the construction bond of same signed by
Federal Surety Co.
The Board approved the recommendation of Wm. F. Qualls, authorising the lights
in Co-quillard Woods Addition.
The Board approved Lit. Wray's recommendation that all action be rescinded on
Improvement Resolution No.2070 for the pavement of the alley south of Haney Avenye
from Fellows Street to Rush Street as the remonstrance filed... June 26th.
1928, shows a majority of property owners against said improvement. The Board, there
fore, rescinds all former action taken on said improvement resolution null and void
and the proceedings closed.
The Board approved Yr. Wray's recommendation that all a-atione be rescinded on
the resolution for the pavement of the first alley west of Lafa�ette Street from
Parkovash to Ostemo StreetunderImprovement Resolution No.2069,, as the remonstrance
filed June 29th., 1928, shows a large majority of property owners against said
• j improvement. The Board, therefore rescinds all former action taken on sald improvement
resolution and declares same null and Void and the proceedings closed.
This being the date set, hearing was had on Improvement Resolution No.2096 fof
the Elwood Avenye Trunk Sewer.
In the above named improvement resolution, no remonstrators appeared and no
written -emonstrance was filed and the Board, being fully advised in the premises
finds that the area or district to be frained is properly bounded and that the special
benefits to the property within such district or area, and the benefits, if any, to the
City, will be equal to the estimated cost of said improvement as reported by the City
• Engineer. The Board, therefore, decides to take final action on said improvement
Resolution No.2096 and declares same in all things ratified, confirmed and approved
without modification.
This being the date set hearing was had on Improvement Resolution No.2097
for the Humboldt Street Trun- fewer.
In the above named improvement resolution, remonstrators appeared and a written
remonstrance was filed. After hearing all persons interested in said improvement,
the Board finds that the area or district to be drained is properly bounded and that
the special benefits to the property within such district or area, and the benefits,
if any, to the City, will be equal to the estimatedcost of same as reported by the
City Engineer. The Board, therefore de&ides to over rule said remonstrance, and
declares said improvement Resolution No.2097 in all things ratified, confirmed and
approved without modification.
In the matters of improvement Resolution No.2096 On* the Elwood Avenue Trunk
Sewer and Improvement Resolution No.2097 for the Humboldt Street trunk Sewer, the
Board hereby orders that on the 17th., day of July 1928, this,, Board will receive, open
and read sealed proposals for the construction of said trunk sewers up to 10:00 A. V-0
The Board further orders that notices of said proposals shall be published )n the 6thoil
day of July and on the I3th. , day of July 1928, in the South Bend News Times and Tribunq
according to law.
-City Engineer, H. G. Wray, submitted a copy of the contract for heavy sheet

asphalt pavement improvement on Brookfield Street from south line of Vassar.Avenue
1! to north line of Humboldt Street, in accordance with the terms of the contract between
the City and the, Albert Construction do., contractors, under Improvement Resolution

No.2031. The Board .signed..and- approved same in the amount of 8,095.31.
City Engineer, H. G. Wray, submitted a copy of the contract for
heavy traffic sheet asphalt pavement improvement on 36th., Street from Mishawaka, Avenue
to North Side Blvd., in accordance with the terms of the contract between the, City and the
Albert Construction Company, contractors, under Improvement Resolution No.20N. The
Board approved and signed same in the amount of 17,734.10.
City Engineer, H. G. dray, submitted a copy of the contract for the
heavy traffic sheen asphalt pavement improvement on College Street from -otOxh one of
Vassar Avenue to the north line of Humboldt Street, in -accordance with the terms of the
contract between the City and the Albert Construction Oompany, dontractors, under:
Improvement Resolution No.2029. The Board signed final approved same in the amount of
7,575.75.
City Engineer, H. G. �7 ay, submitted partial e stirra to No.1 for the
light traffic as haltic concrete pavement improvement and sewer improvement on Woodlawn
Boulevard from alley east of Inglewood Place to Riverside Drive; on Parkview Pla-ce and
Hollywood Place from �ooc3lawn Blvd. , to Oakwood Boulevard, .and on south bald of Ook-wood
Boulevard from west line of Riverside Boulevard to Portage Avenue, in accordance with
the terms of the contract between the City and the Williston Construction Company,
contractors, under Improvement Resolution No.2025. The Board signed and approved same
in the amount of 50,536.07.
City Engineer, H. G. Wray, submitted partial estimate No.I for
the light traffic concrete pavement improvement on Ewing Avenue from west line of Leer
Street to Ernesperger street, in accordanee with the ter-ns of the contract between the
City and Alex Buk=ski, contractor, under Improvement Resolution No.2076. The Board
signed and approved same in the amount of 5,362.65.
City Engineer, H. G. Wray, filed plans, specifications and estimtte
and the Board adopted said plans.and specifications together with the following Improve

be paved. amd also the roadway. of certain portions of the streets and alleys which

or portland cement c oncrete pavement/ The foundation shall be po rtland cement
concrete six (6") inches thick for the sheet asphalt, apphaltie conerete, and brick.
Curb wall, concrete walk and concrete curb shall be c_onstructedalong said streets
and alleys where same is necessary. jjanholes, storm water inlets and conduits shall
be constructed where necessary. Also water and ' sewer connections shall be constructed
from the different mains to a point six (6") inches inside the curb lines, where
necessary. All manhole tops and storm water inlets shall be set to the proper grade.
Concrete marginal curb shall be constructed at all street and alley intersections
where necessary; all as is more particularly shown and all in accordance with the
plans, profiles, detail drawings a d specifications on file in the office of the
.department of Public Works, of the pity of South Bend, Indiana.
The cost of _tlae improvement herein provided .for, shall be apportioned
in accordance with Track. -Elevation Act, appproved, March I, 1923, as shown in Burns
