of the Nesv York Central Railroad Comrany for track elevation expense and .salary claim

pay same out of the track elevation fund.

In all of the above named improvement resolutions, nor emonstrat
ors appeared and no written remonstrance was filed and the Board being fully advised
in the premises, finds that the special benefits accruing to said abutting -property
are equal to the estimated costs of same as reported by the,City -aigineer. The Board,
therefore, decides to take final action on said resolutions and declares same in all
things ratified, confirmed and approved without modification.
In the matter of Improvement Resolutions No.2090, 2089 and 2084
for local sewers in Huey Street. Hi ldre th Street and Elwood Avenue, the Board, hereby
orders that on the IOth. , day of July, 1928, this Board will receive, open and read
sealed r_. ro _;osals up to IJ:O). A. 1-7. , for the construction of said sewers. The Board
further orders that not tees of said proposals shall be published on the 29th. , day
of June and one the 6th. , day of July, 1928, in the South Bend News Times and Tribune

Improvement Resolution No.2042 for the pavement of l<endall Street from
alley north of OL#chard Street to Dunham Street. (See files for copy of resolution.)
Improvement Resolution No.2083 for the pavement of Miadison Street from
Palmer Blvd., to Harriett Street. (See files for copy of resolution.)
Improvement Resolution No.2076 for the pavement of North Shore give
from a point 150 feet `crest of the west line of Lafayette Street to the west line of

In all of the above named improvement resolutions, no remonstrators
appeared and no written remonstrance was filed and the Board, being fully advised in
the premises, finds that the benefits to the several lots and parcelsof land liable to
be assessed for said improvements, will be equal to the estimated costs of same as
reported by the Cityigineer. The Board, therefore, decides to tare final action
on same and declares said improvement resolutions in all things ratified, confirmed
and approveds without modification.
This being the date set, hearings were had on the following improvement
resolutions:
Improvement Resolution No.2080 for the pavement of Pierce Street from
Cushing Street to Leland Avenue. ( See fi 1 es for resolution.)
Improvement Resolution No.2039 for the pavement of St. Peter Street
from `TTayne Street to the south line of the first alley south of r'layne Stro a t.. ( See

In both of the above named improvement resolutions, remonstrators appear
ed and written � emonstrances were filed. Afterh�earing all persons interested in said
improvement resolutions and being fully advised in the premises, decides to rescind all
former action taken on said improvement resolutions No.2080 and 2039 and. declares s7ame
null and void and the proceedings closed.
This being the date set, hearing was had on Resolution No.1774A, suppleip
entary to resolution No. I774 with reference to Trunk and Suh Trunk Sewer Improvements.

In the above named supplementary resolution No.I774 A, no remonstrators
srpeared and no written remonstrance gays filed, and the Board being fully advised in
j the premises, finds that the area . dir district to be drained is rr ope�rly bounded, that
the. special benefits to the property within Bach district or area will be equal to the
estimated cost of said improvement as reported by the City Eng1neer. The Board, there
fore, takes final action on said resolution No.1774A and declares same in all t'•Iings
ratified, confirmed and approved.
This being the date set, hearing was had on Vacation Revolution No.2058
for the Vacation of a portion of Pine Otreet; of the first alley, south of Yonroe Street
from the west line of Pine ''treet to the east line of Laurel Street; of a portion of th
alley west of Pine Street; and of a portion of Laurel Street . ( See files for copy

Ln the above named Vacation Resolution No.2058no remonstrators appeared
and no written remonstracce was filed and the Board, beingfal ly advised in the premises
decides to take final action on said resolution, and declares same in all things ratifie
confirmed and approved.

i appeared and the Board, being fully advised in -the premises, finds that the several
lots and parcels of land primarily assessed for said improvements have been benefited;
in the amounts named on said rolls. The Board, therefore, takes final action on said;'.
! assessment rolls, and declares same in all things ratified, confirmwt and approved
i and the proceedings closed. The Board now orders said assessment rollsdelivered to

This being the date set, hearing was had on the assessment roll
for the widening and extension of 22nd. , Street from efferson Blvd-:.; to the St.
Joseph River under Condemnatinn Resolution No.2038.
In the above named assessment roll, remonstrators appeared
and•.a written remonstrance was filed by the Grand Trunk "4estern Railroad Co. After
{ hearing all persons interes `;ed in said assessment roll and being fully advised in

benefited and damaged in the amounts shovel on said assessment roll. The Board,
therefore, ta'Kes final action onsaid roll, over ruling the remonstrances and declares
said assessment roll in all thingsratified,- confirmed and approved and the proceedings

assedsed for said improvement and will decide whether the several lots and parcels
of land primarily assessed for said improvement have been or will be benefited in
the amounts shwon on said assessment roll or in a greater or less sum than that

south of Dean Avenue under Improvement Resolution No.I878.
In the above named assessment roll. the Board hereby orders
that on the I8th., day of July, 1928, this Board will meet in their office in the
1 City Hall at 7-I5 P. Y., to hear and receive remonstrances from all persons whose
i property ss been assessed for said improvement and will decide whether the several
lots and parcels of land primarily assessed for said improvement have been or will
be benefited in the amounts shwon on said roll or in a greater or less sum than that

approved march IOth.,,.1927, and therefore, be it resolved by the Board of ''Public
T`lorks of the City of South Bend, Indiana, That it is' desired and deemed necessary
to improve
Terrace Avenue from ,Lincoln Highway to north line of Lot 224; Goodland
.venue from Lincoln Highway to north .i ine of Calhoun street; Aliot Street, Bendix
Drive and _TCaley Street from Lincoln Highway to Elwood Avenue; Calhoun Street and
Humbolt Street from Goodland Avenue to east line of Addition, and u wood Avenue
from Goodland Avenue to east line of Bendix Drive, by the construction of a pave -
vent improvement. Also to imporve Terrace Avenue from Lincoln Highway to north
line of Addition; Goodland Avenue from Lincoln Highway to Calhoun Street; Elliot
Street from Humbolt Street to Elwood Avenge; Bendix Drive and Ka.ley street from
Lincoln Highway to Elwood Avenue by the construction of a local sewer improvement,
in accordance with the rlans,'profiles, specifications, detailed drawaings and
engineer's estimate now on file in the office of the Department of Public `44orks
of the City of South Bend, Indiana, and such improvement is now ordered. The
pvaing material to be used in maing said improvement shall be sheet asphalt.
The cost,of said improvement, including the cost of street and alley
intersections, public places and ineiLdental costs shall be assessed upon the
real. estate abutting on said streets, all in accordance with the method,, and manner
provided for in Chapter 236 of the Acts of the General Assembly of the State of
Indiana, approved pf march IOth. , 1927.
Assessments of ten dollars and more against each lot,if deferred,
are to be paid in ten equal annual installments, with interest at the rate of six
per cent per annum. A bond or bonds will be issued to the contractor to the amount
of such deferred assessments in rro rate payment for such improvement.
Under no circumstances shall the City of aouth Bend be, or be held
responsible for any sum or sums due from said rronerty rnvner or owners for said
work, dr for the collection of the same, or for the payment of any bond or bonds,
certificate or certificates, issued to said contractor in payment for such work,
except such money as shall have been actually received by the City from the assess
ments for sue -a improvment, or such moneys as sadd City is by said entitled Act
and amendments and supplements thereto, required to pay. All proceedings had,
and work done in the ma'cing of said improvmement, assessment of property, collection
of assessments and issuance of bonds, therefore, shall be provided for in said
above entitled Acts.
