Board met in regular session at 7415 P. r. All members present.

Due to the large crowd of interested persons, the meeting. was
held in the Council Chambers.
This being the date set hearin was had on Improvement Resolution
No.2074 for 'Sheridan - Avenue Sub -Trunk Viewer. ( ee files for copy of resolution.)
In the above named improvement resolution, no remonstrators appeared
and no written remonstrance was filed and the Board, being fully advised in the premises,
finds that the area or district to be drained in properly Bounded, that the special
benefits to the property within such district or area will be eeyLal to the estimated
cost of said improvement. The Board, therefore, takes final action on said improvement,
resolution No.2074 and declares same in all things ratified, confirmed and approved. !I
This being the date set, hearing was had on Impgovemen.t_Resolution
No.2070 for the pavement of the alley south of Haney Avenue from ellows 'treet to±

In the above named improvement resolution, remonstrators appeared

finds that the benefits to the several lots and parcels of land liable to be assessed
for said improvement will be equal to.t1v estimated cost of same as reported by the
City Engineer. The Board, therefore, decides to over rule said remonstrance and declar
said improvement resolution No.2070, in all things ratified, confirmed and approved.
The Board now orders City Engineer to give a report on said remonstrance as to resident
property avners whose names appear on the remonstrance.

approved. The Board now orders said remonstrance delivered to the City Engineer for j+

Trunk ' estern Railway remonstrated due to the fact that when. the track elevation
work is reached at this place, 'it will be necessary to tear out the existing walk
and curb from Harris Street to the tracks. The Board; therefore, being fully
advised in the premises, finds that the benefits to the several lots and pardels
of land liable to be assessed for said improvement will be equal to the estimated
cost of same as reported by the ity Nngineer. The Board, therefore, decided,
to modify said improvement resolution to. -omit the improvement from the Grand rank
Westenn Railway Co., to Harris Street. iith this modification, the Board declares
said resolution in all things ratified, confirmed and approved,- as modifkdd ..
This being the date set , hearing was had on Improvement
Resolution No.2043 for the construction of concrete walk on Arnold Street between
Division Street and Sample Street. (See files for resolution.)
In the above named improvement resolution, the Board finds
that when the track elevation is reached at this place, it will be necessary to tear
out th existing walk and curb from Division Street to the Ist., alley. south of
Huron treet. The Board, therefore, being fully advised in the premises, finds that
the benefits to the property liable to be assessed for said improvement will be
equal to the estimated cost of same an reported by the '4ity Engineer. The Board'
�owever decides to modify siad improvement resolution to omit the improvement from
ivis ion Street to the Istl, alley South of Huron. �Iith this modification, the
Board declares said resolution No.2043 in all things ratified, confirmed and approved
asmodified.

tion No;2066 for theset back lines on Division Street from the west line of Taylor
Strut to the east 1 ine of Olive Street .
In the above named set back line resolution, no remonstrators
appeared and no. written remonstrance was filed and the 13oard, being fully advised in
the premises, decides to take final action on said set back resolution No.2066, and
declares same in all things ratified, confirmed and approved.

treet from McKinley Avenue to south line of Lots' 65 and 66 in Jefferson
Heights Addition under Improvement Resolution No.I630.
In all of the above named assessments rolls, no remonstrators
appeared and no written remonstrance was filed and the Board, being sully advised
in the rremises, finds that the several lots and parcels of land which have been
assessed for said improvements, have been benefited in the amounts named on said
roils. The Board, therefore, decides to take final action on said assessment rolls,
and declares same in all things ratified, confirmed and approved and the proceedings;

'Resolved by the Board of . Public ''Works of ;.the City of youth Bend,
County of 8t. Joseph, State of Indiana; - That it is desired And deemed necessary to
construct a sewer all in said City, which from its size and character, is not only
intended and adapted for use by the property holders whose property abuts along the '
line of said sewer, b4t is also intended and adapted for receiving sewage from collatez
drains already constructed or which may be hereafter constructed, bt, and *he same is
hereby ordered constructed in and along the following line in said ity, to -wit:
Beginning at a manhole at the intersection of -'I'Iwood Avenue and
Ilu.ey Street thence west along the center line of Elwood Avenue with a twenty-four
(24") inch pipe sewer to. the center line of Kaley street, thence still west along the it
center line of Elwood Avenue with a twenty-one (2I") inch pipe sewer to the center lined
of Goodland Avenue, together with the necessary manholes, storm water inlets, conduits 1

The cost of an adequate local sewer, built along the line above described, is hereby
estimated and fixed table ner cent of the cost of the main sewer to be built along
said line as above set forth, which proportion, as herein estimated and fixed, shall l
be taken and adopted in all computations requiring a knowledge of the cost of such local
sewer if built along the line where the main sewer is to be built. The cost of the !�
construction of said sewer shall be divided as follows: I. So much of. such cost as
shall be equivalent to the construction of an adequate local sewer not adapted to re-
ceive sewage from collateral drains or sewers, if built along the proposed lines as 11
here6nbefore set forth, shall be paid for by the abutting -property holders and by j!
the ity of South Bend, if it be determined that the said City is benefited by the said!;
sewer, in the same manna acid to the same extent as local sewer are paid for by them,

are to be paid in ten equal annual installments with interest at the rate of six
i percent per ann-7m. � bond or binds will be issued to the contractor in payment for
said work, unless the property owners pay said assessments Yore said bond or bonds
are issued. Under no eurcumstanc es shall the City of South end be or be held
respnnsible for any sum or sums due from said property owner or vners for said work
or for Iihe collection of the same, or for the payment of any bond or bibnds, certifi-
cate or certificates issued to said c antractor in myment fgr such work except for
such moneys as shall ':have been actually received by said t ity from the assessments
for such improvement.
All proceedings had and work done in the donstruction of
said main sewer and its appurtenances, manner of assessment of property, collection
f of assessments .and issuance of bonds therefor shall be as porvidedfor 'in an Aat
,I of the General Assembly of the State bf Indiana, entitled "An Act 0oncerning
Municipal CorDorations", approved March 6th., I905.
Notice of this resolutions shall be published on the 23rd,
day of June and on the 30th. , day of June, I928 in the South Bend News Times and
Tribune according to law..
This Board will give a hearing on this resolution at its

and estimate and the Board adopted said plans and specifications together with the
following improvement resolution:
Humbolt Street Trunk Sewer Improvement Resolution
No.2097.
Resolved by the Boa-d of Public `forks of the City of
South Bend, County of St. Joseph, state of Indiana, That it is desired and deemed
necessary to construct a sewer all in said City which, from its size and character
Is not only intended and adapted for use by the -property holders whose property
abuts along the line of said sewer, but is also int ended and adapted for receiving
sewage from collateral drains already constructed or which may be hereafter construct
ed, be, and the same is hereby ordered constructed in and along the following line
in said City, to -wit:
Beginning at a manhole at the intersection of Humb.olt St
and Huey Street, thence west along the center line of Humbolt Street with a forty-
eight (4811) inch circular sewer to the center line of Goodland Avenue, thence west-
erly along a line thirteen (I31) feet south of the north line of Lincoln Highway
with a forty-eight (48") inch circular sewer to the center line of Nancy Street,
together with the _necessary manholes, storm crater inlets, conduits and house connect-
ions to the curb line along the line of said improvement, and to be built in accord-
ance with the profile, specifications, detail pi,dns, map and estimates now on file
in the office of the Department of Public fforks of said City, which include an
estimate of the proportion that the cost of an adequate local sewer, built along
the above line, bears bo the cost of the main sewer, to be built as follow$: the
cost of an adequate local sewer, built along the line above described, is hereby`
estimated and fixed to be per cent of the cost of the main sewer to be built
along said line as above set forth, which proportion, as herein estimated and fixed,
shall be taken and adopted in all computations requiring a knowledge of the cost of,
such local sewer if built along the line where the main sewer is to be built. The
cost of the construction of said sewer shall be divided as follows: I. So much of
such cost as shall be equivalent to the construction of an adequate local Mewer not
adapted to receive sewage from collateral drains or sewers, if built along the
proposed lines as hereinbefore set forth, shall be paid for by the abutting property
holders and by the city of outh Bend, if it be determined that .the said City is
benefited by the said Sewer, in the same manner and to the same extent as local sewer
are paid for by them, under the statute in such cases mantle and provided. 2. The.
excess of cost, over and aiDove what would be equivaleEi to the cost of a local sewer,
if built along said line, shall be assessed against each piece of property in the
district or area to be drained, and against the City, if it -be determined that the
said city is benefited by the said sewer, according to the manner and method prescrib
ed by law, all of which said property beneficially affected lies xj within
the following described territory in the City of South Bend, st. Joseph county,

office of the Department of Public Works of said City, which among other things, give
the exact course of said proposed main sewerm gverflows, and its appurtenances, and
,the district or area which may be injuriously or beneficially affected thereby, as shown
by heavy boundary lines marked on said map 'and drawings, with proper words and figures
written thereon, clearly indicating what said heavy boundary lines represent, and the
district or area embraced thereby. Assessments, if deferred, .are to paid in ten equal
annual installments, with interest at the rate of six per cent per annum. bond or
bonds shall be issued to the contractor in payment for said work, unless the -property
owners -pay said assessments before said bond or'bonds are issued. Under no circumstancas
shall the City of South Bend be or be held resphnsible for any sum or sums due from
said property owner or owners for said work or for the collection of the same, or for
the-oWment of any bond, or bonds; certificate or certificates Issued to said contractor
in payment for such work, except for such moneys as sliall have been actually received
by said City from the assessments for such-improvement.is
All proceedings had and work done in the construction of said
main sewer and is appurtenances, manner of assessment of property, collection of
assessments and issuance of bonds therefor shall be as provided for in an Act of the
General Assembly of the State of Indiana, entitled "An Act Concerning Y-unicipal Corpor-
ations". approved Varch 6th. , 1905.
Notice of this resolution shall be published on the 23rd
day of June and on the 30th. , day of Jung I928 in the South Bend News Times and Tribune.
This Board will give a hearing on this resolution at its
office in the City Hall 'on the 3rd. , day of July, I928 at I0:00 A. V.

In the matter of the Sub -Trunk Sewer on Sheridan Avenue
under Improvement Resolution No.2074, the Board, hereby, appoints Charles 71. Cole
as engineer on said work to supervise the construction of said sewer and the making
of the assessment roll for said improvement. The Board further orders that Charles
W. Cole be allowed a fee of 5% of the cost of said sewer, which shall be added to
the east-: of -:said- improvement and appear on the _asses-;5ment roll as 7�ngineering fees.
