Upon recommendation by the Traffic Engineer, Ernest H. Miller, the Board approves the installation of the ,following traffic signs: No Parking THIS SIDE signs installed on Almond Court, north side, from Notre Dame Avenue to dead end of Street. NO PARKING THIS SIDE signs installed on north side of LaSalle Street from Lincoln - way West to first alley east STOP SIGN installed on Elwood Avenue, northeast corner, at Portage Avenue STOP SIGN INSTALLED on Cleveland Road, southwest corner, at Riverside Drive STOP SIGN installed on Donald Street, both sides, at William Street. A letter is hereby received from Mr. Louis Wilcox of Robertson's Department Store requesting permission to use two parking spaces on the south side of Wayne Street and just west of Carroll Street ( in front of 653 • • • 0 • • 01 This being the date set, hearing was held on the matter of taxi cab driver's license for a one Paul Lile of LaPaz, Indiana. Upon evidence as submitted by the Police Department and also confirming the report of the City Controller, the Board now finds it necessary to deny the request of said Paul Lile, for the license. In the matter of the Peitition of the Bowman Cemetery Association of St. Joseph County, State of Indiana, for the city of South Bend to accept the transfer of said cemetery, the Board having held a public hearing on the 9th day of September, 1957 and there appearing no remonstrators in regards to same and the Board having made a thorough investigation and satisfied that there are some 110 graves of individuals who have been in different -branches of the service and finding it necessary to take over and rhaintain said graves, the Board heretofore accepts the Quit -Claim Deed of the Bowman Cemetery Association which the Secretary of the Board is directed to record, further an Affidavit as submitted by Cecil D. Walz, Secretary which the Secretary of the Board is directed to record, and also the Assignment unto the City of South Bend, St. Joseph County, Indiana, all of the Bowman Cemetery Assocations's right, title and interests in a cer- tain Trust Agreement dated the 7th day of Octobers 1939 be and between said Association and the St. Joseph Bank and Trust Company which the Secretary of The Board is directed to record also. The City Controller is now authorized to make the necessary arrangements with the St. Joseph Bank & Trust Company in regards to the transfer of funds. The Board now wishes to thank Mr. Cecil D. Walz and Robert K. Rodibaugh for bringing up to date facts necessary to expedite our investigation. IMPROVEMENT RESOLUTION NO. 2854, 1957 IMPROVEMENT RESOLUTION AWARDING CONTRACT After due investigation of all bids and being duly advised on the premises, the Board of Public Works and Safety of the City of South Bend, Indiana decides that the bid of the Reed Construction Company for the construction of the improvement knows as the Vassar Avenue Pavement Improvement according to Improvement Resolution No. 2354, 1957 is the lowest and best bid and that the contract to do said work be awarded to the Reed Construction Company for a Class "C" Type 1 Cement Concrete Pavement. IMPROVEMENT RESOLUTION NO. 2358, 1957 REFERRING BIDS TO ENGINEER The Bids for the improvement of South 34th Street from East Jefferson Boulevard to East Washington Street by constructing an established grade, catch basins, and accepted curbing received on September 9, 1957 in accordance with Improvement Resolution No. 2353, 19579 passed by this Board on August 5, 1957 and confirmed by this Board on August 19, 1957, are hereby referred to your for examination and tabulation and to report to this Board with recommendations. Smith ENGINEER'S REPORT In the matter of the Bids for the Improvement of South 34th Street from East Jefferson Boulevard to East Washington Street by constructing an established grade, catch, basinn, and accepted curbing in accord- ance with Improvement Resolution No. 2858, 1957 passed by the Board of Public Works and Safety on August 51 1957f and confirmed by said Board on August 19, 1957, we hereby report that we have tabulated and ex- amined the several bids submitted to the Board on September 9, 1957 and find that the McIntyre & Jones Construction Company has the lowest and bid. We recommend that the bidd of the McIntyre & Jones Construction Company be accepted. i Clyde E. Mr. J. K. Sheehan, Manager of the Green Arrow Parking Inc. herewith requests permission to change the rates on the following Parking Lots in the City of South Bend, Indiana: k Lot #22, located at 125 E. Jefferson, from 35¢ for the first hour and 10¢ each additional hour, to 354 for the first hour and 15¢ for each additional hour. Lot #17, located at 121 North Main Street, from 25¢ for the first hour and 10� each additional hour, to 35� for the first hour and 15¢ for each addi- tional hour. Lot #20, located at 307 North Michigan Street, from 35� all day and 50� all night, to 25¢ for the first hour, 10� for each additional hour, 50� all day and 75� all night parking. Mrs. H. R. Larimer requests permission on behalf of the Mother's of World War II to conduct a Tag Day on the 8th and 9th days of November, 1957. Permission granted. The Chamber of Commerce hereby requests permission to conduct a parade on the 27th day of September, 1957 on behalf of the Metropolitan Opera Concert Permission granted. This being the date set, hearing was held on the matter of the order issued to the Alby's Steak House, 1040 W. Western Avenue. Appeared at this time are Nick ClIolis, Attorney; representative of the Midwest ` Aluminum Sales, Inc; and Verner L. Lane, Building Commissioner.The matter discussed now in regards to an order issued to Alby's Steak House khereby they are in violation of Ordinance No. 2243, commonly known'; as the Building Code of the City of South Bend inasmuch as the front of said building which is being re- faced with a 4 inch stone enroaches upon public property. The Board now requests that a complete invest igation as to the correct property line be made and report submitted to the Building Commissioner for hearing next Monday, September 23, 1957. Also, on the matter of the orders issued to the S & W Fruit Market, 2025 S. Michigan Street and the ownr j of the property at 2023 South Michigan Streets whereby said owners failed to comply with the orders of the Building Commissioner, the Board now authorizes Mr. Lane to refer the case to Norman Kopec, Attorney.; Further, on the recommendation of the Building Commissioner the hearing scheduled for today which in- volves the property at 138 South Dundee Street will be continued for 2 weeks. Hearing to be held on the 30th day of September, 1957. A petition is hereby received from Mr. Edmund Berk and several others asking for the vacation of Hartman Drive, in Wooded Estates from the easterly right of way line of Oak Ridge Drive east 100 feet. Petition referred to the City Planning Commission for investigation and recommendation. The Petition of Belleville Investment Company is submitted to the Board for the improvement of Lombardy Drive from the south line of Linden Avenue southward a distance of approximately five hundred eighty feet (the exact lobation of which said desired improvement is for greater ckarity of understanding out- lined in red on the attached engineering drawing of a portion of said Lombardy Drive) by the construct- tion of a concrete pavement thirty-six feet in width. Petition referred to the City Engineering Depart- ment for investigation and report. PETITION TO VACATE ALLEY Comes now Irvin F. Sikorski, who first being duly sworn upon his oath, according to law, deposes and says: That he and his wife, Gertrude E. Sikorski, are the owners of Lot Numbered One Thousand Ten (1010) of La Salle Park Second Addition to the City of South Bend, Indiana, and the owners of the South Eighty (80') feet of Lot Numbered One Thousand Nine (1009) on the recorded Plat of LaSalle Park Second Addition to the City of South Bend, Indiana. That the partial plat, incorporated herein and markdd "Exhibit A" for reference, discloses th t between said Lot Numbered 1010 and the south eighty (80) feet of Lot Numbered 1009 is a fourteen (14'� public alley that seperates the real estate owned by the petitioners herein. That running north and south along the west side of the south eighty (80) feet of Lot 1009 is a part of the North -South public alley that does not extend to Western Avenue because the north -south portion immediately west and adjacent to Lot 1010 was vacated, pursuant to Vacation Resolution 1809. That the east -west portion of the alley sep- arating the petitioner's real estate does not extend through to Sheridan Street but instead Makes a turn along the west end of petitioner's real estate. Your petitioner would further state that he has for some years last past operated a commercial enterprise known as Trudy's Drive -In and that the expansion of the business has been such that the Said south eighty (30) feet/ of Lot 1009 are now required for purposes of parking of vehicles, service trucks and other equipment incidental to the operation of the business. That your petitioner respectfully submits to the Honorable Board that he would dedicate a fourteen (141) public alley on the north side of the south eighty (80) feet of Lot Numbered 1009 if the Board deems a public alley necessary in this area if the Board will vacate the present east -west public alley between Lots 1010 and 1009 that now separate.c the real estate owned by the petitioner and that portion of the north -south publicalley that is adjacent; to and west of the aforesaid south eighty (80) feet of Lot Numbered 1009, WHEREFORE, your petitioner respectfully :;requests favorable consideration of this petition. The Board now refers said petition to the office of the City Plgbning for investigation and recommendation 'I A • • • - 0 P_ 654 ENGINEER'S REPORT In the matter of the Bids for the Improvement of North South alley between Main Street and Michigan St. from West Calvert Street to Dayton Street by constructing a permanent type 7" concrete pavement in a - ccordance with Improvement Resolution No. 2859, 1957 passed by the Board of Public Works and Safety on August 5, 1957 and confirmed by said Board on August 19, 1957, we hereby report that we have tabulated and examined the several.bids submitted to the Board on September 9, 1957 and find that the McIntyre & Jones Construction Company has best and lowest bid. We recommend that the bid of the McIntyre & Jones Construction Company be accepted. Clyde E. Williams & Associates IMPROVEMENT RESOLUTION AWARDING CONTRACE After due investigation of all bids and being duly advised on the premised, the Board of Public Works and Safety of the City of South Bend, Indiana decides that the bid of the McIntyre & Jones Construction Company for the construction of the improvement known as the North South Alley between Main and Michi- gan Streets Improvement according to Improvement Resoolution No. 2859, 1957 is the lowest and best bid and that the contract to do said work be awarded to the McIntyre & Jones Construction Company. IMPROVEMENT RESOLUTION NO. 2860, 1957 REFERRING BIDS TO ENGINEER The bids for the improvement of Brookfield Street from approximately 170 feet south of Lathrop Street to Bergan Street by constructing a local sewer received on September 92 1957, in accordance with Im- provement Resolution No. 2860, 1957, passed by this Board on August 5, 1957, and confirmed by this Board on August 199 1957, are hereby referred to your for examination and tabulation and to report to this. Smith ENGINEER'S REPORT In the matter of the Bids for the Improvement of Brookfield Street from approximately 170 feet south of Lathrop Street to Bergan Street by constructing a local sewer in accordance with Improvement Reso- lution No. 2860, 1957 passed by the Board of Public Works and Safety on August 5, 1957, and confirmed by said Board on August 199 1957, we hereby report that we have tabulated and examined the several bids submitted to the Board on September 9, 1957 and find that the Niles Excavating Company has the lowest and best bid. We recommend that the bid of the Niles Excavating Company be accepted. Clyde E. 'Williams & Associates IMPROVEMENT RESOLUTION AWARDING CONTRACT After due investigation of all bids and being duly advised on the premises, the Board of Public Works and Safety of the City of South Bend, Indiana decides that the bid of the Niles Excavating Company for the construction of the improvement known as the Brookfield Street Sewer Improvement according to Im- provement Resolution No. 2860, 1957 is the lowest and best bid and that the constract to do said work be awarded to the Niles Excavating Company. IMPROVEMENT RESOLUTION NO. 2861, 1957 ' REFERRING BIDS TO ENGINEER The bids for the improvement of Northside Boulevard from Twyckenham Drive to Sample Street by construct ing a Class "B" Pavement received on September 9, 1957, in accordance with Improvement Resolution No. ri 2861, 1957, passed by this Board on August 5, 1957, and confirmed by this Board on August 19, 19579 are hereby refe red to you for examination and tabulation and to report to this Board with recommendations. Smith ENGINEER'S REPORT In the matter of the Bids for the improvement of Northside Boulevard from Twyckenham Drive to Sample Street by constructing a Class "B" Pavement in accordance with Improvement Resolution No. 2861, 1957 and confirmed by this Board on Augsut 19, 19579 we hereby report that we have examined the several bids submitted to the Board on September 9, 1957 and find that the McIntyre & Jones Construction Co. has the lowest and best bid for a Class "B" Type 1 pavement and that the Rieth Riley Construction Co. has the lowest and best bid for a Class "B" Type 3 pavement. We recommend that the kind of pavement placed on the above street be Class "B" Type 3 Pavement. Clyde E. (COST) and publicly openad and considered all bids for the improve ment of Northside Boulevard from Twyckenham Drive to Sample Street by constructing a Class "B" Pavement in accordance with Improvement Resolution No. 2861, 1957 passed by this Board on August 5, 1957, and con- firmed by this Board on August 19, 1957, therefore, BE IT RESOLVED, that the Roadway of said street be improved by paving with Class "B" Type 3 pavement. Proofs of Publication in the South Bend Tribune with an affidavit signed by C. G. Livengood and in the Record with an affidavit signed by W. Ruby McManon were submitted to the Board and found sufficient. The bids received read as follows: INDIANA EQUIPMENT COMPANY, INC.
