HomeMy WebLinkAbout07/22/57 Board of Public Works Minutes (2)All work done in the making of said described public improvement shall be accordance with the terms and conditions of Improvement Resolution No. 2857, 19571, passed by the Board of Public Works and Safety on the above named day, and the Profiles, Drawings, Plans, General Details, Specifications and Estimates to be adopted by the Board of Public Works and Safety of said City, upon the final adoption and confirmation of said Resolution and placed on file in the Office of the Board of Public Works and Safety of said City. The Board of Public Works and Safety will meet in its office in the City Hall on the 6th day of August, 1957 at the hour of 8:00 P.M. for the purpose of hearing and considering all remonstrances, which may have been filed ram which may be presented, and will hear all persons interested or whose property is affected by said proposed improvement, and will decide wheter the benefit that gill accrue to the prop- erty abutting and adjacent to the proposed improvement and to said City, will be equal to or exceed the estimated cost of the proposed improvement as estimated by the City Civil Engineer. Humphrey, Alex Polcyn, Anthony J. Blasko. Excavation bonds were approved for Charles F. Stickler, and Marion M. Hamilton & Sons. Traffic Engineer, Ernest H. Miller, reports installation of the following traffic signs: "No Parking This Side" signs installed on Bulla Street, north side from Portage Avenue to first alley west of Portage. "yield Right of Way" sign installed on Scenic Drive, northwest corner at Ford Street. Contract Supplement No. 1 of Indiana Rvenue Contract No. 1, and Contract Supplement No. 2, of Indiana A nue Contract No. 2 under the 1956 General Street Improvement Program is hereby approved and signed by the Board this 22nd day of July, 1957. The Building Commissioner, Mr. Verner L. Lane, is instructed by the Board to give examinations for master plumbers and journeyman plumbers once a month. .: NORT1JZR.N_r:INDIANA TRANSIT. INC. A petition having been filed by Northern Indiana Transit, Inc. which sets forth a request for change of fares and a showing having been made by said Company that the fares permitted to be charged for bus trans portation under a contract made with the City of South Bend, Indiana on or about the 13th day of May, 194 and amended by a contract dated February 13, 1948, and as further amended by a contract dated July 8, 195 and as further amended by a contract dated March 10, 1952, and as further amended by a contract dated Jan uary 26, 1953, and as further amended by a contract dated February 13, 1956, and a request having been made by said Company that it be permitted to charge rates for services rendered to the public which will be fair and reasonable to all parties concerned, and the statutes of Indiana (Sec. 48-7303 Burns Indiana Statutes, 1950 Repl.), requiring the amendment of said contract to be undertaken in the manner herein followed, this Board now takes the following action: This Board, in compliance with said Statute, has tentatively determined the exact form in which the ame ment to said contract is to be finally adopted to be in the following and figures, which contract is attached hereto and designated "Exhibit A". This Board now fixes the 12th day of August, 1957 at 10:00 A.M. (DST) as the time at which said contract will be finally considered, at the office of this Board in the City Hall, South Bend, Indiana. At said time and place, a public hearing will be had at which any taxpayer may appear and file protest against any or all of the provisions of said contract. IT IS ORDERED that Northern Indiana Transit, Inc. shall, at its own expense, cause the full and complete text of said contract to be published two times, one week apart, at least one week before such hearing, with the time and place of such hearing in the South Bend Tribune, a daily Newspaper, and the Record, a weekly newspaper, (there being only one daily newspaper circulated in the City of South Bend), each of said newspapers being printed in the English language in St. Joseph County, Indiana. IT IS FURTHER ORDERED, that Northern Indiana Transit, Inc., shall likewise post a copy of such contract and notice in ten public places in the City of South Bend, Indiana. CONTRACT AS FOLLOWS: THIS CONTRACT, made and entered into this 22nd day of July, 1957, by and between the City of South Bend, Indiana, acting by and through its Board of Public Works and Safety, hereinafter called the First Party, and Northern Indiana Transit, Inc, a corporation organized under the laws of the State of Indiana, its successors and assigns, hereinafter called the Second Party, WITNESSETH: The parties hereto agree that the certain contract made between the parties and confirmed by Ordinance of the Common Council of the City of South Bend, on or about the 13th day of May, 1940, as amended by a con- tract entered into on the 13th day of February, 1948 between the parties and thereafter confirmed by the Common Council, and as further amended by a contract entered into the 8th day of July, 1950 between the parties and thereafter confirmed by the Common Council, and as further amended by contract entered into o the loth day of March, 1952, and thereafter confirmed by the Common Council, and as further amended by contract entered into on the 26th day of January, 1953 and thereafter confirmed by the Common Council, an as further amended by contract entered into on the 13th day of February, 1956, and thereafter confirmed by the Common Council, shall be and is hereby amended in each of the following respects: All provisions in said contract, as amended, regarding the cash fare of 20�, and the school fare of 10� cash for high school students and the 5� cash fare for grade school students, now existing, are amended as follows: 1. Cash Fare-----------------------25� 2. Token fare --------------- 5 tokens for $1.10 3. Special Children's Fares: a. All children under five years of age, accompanied by a fare I+ paying passenger ------------------------------------------ No charge !I b. All children age 5 years to 12 years, both inclusive, at all times------------------------------------------------------ 10� I. c. School fares for High School and Grade School students over 12 j years of age, attending school between the hours of 6:30 A.M. �' • and4:30 P.M- ---------------------------------------------- 15¢ 1 All provisions in said contract, as amended, regarding transfers, shall remain the same. The Second Party shall furnish service to the public over the routes now presently established. Said Contract made between the parties on the 13th day of May, 1940s amended as hereinabove set forth, and as now amended, shall be and is hereby continued in full force and effect. IMPROVEMENT RESOLUTION NO. 2846, 1957 CONTRACTOR'S COMPLETION AFFIDAVIT IN THE MATTER relating to the Pavemtn Improvement in Lake Street from the North Property line of Jefferson to the South Property line of Washington Avenue made under Improvement Resolution No. 2846, 1956, and the plans and specifications, therefore, comes now who being duly sworn upon oath deposes and says he is fam- iliar with the Reed Construction Company the party to whom was awarded the contract and who performed the work under Improvement Resolution No. 2846, 1956. Concrete Pavement Improvement, as described in Improvement.Resolution No. 2846, 1956s passed by the Board of Public Works and Safety on August 27, 1956, and confirmed by said Board on October 1, 1956 be and the same is hereby adopted, and the Clerk of this Board is hereby requested to give notice of the hearing of Special Benefits on said Improvement, as required by Section No. 111 or 120 of an Act entitled, "An Act Concerning Municipal Corporations" approved March 6, 1905. . i R. Sabo, Clerk I • 0 • �7_ 0 • NOTICE OF HEARING SPECIAL BENEFITS ON PAVEMENT IMPROVEMENT I 1 i Notice is hereby given that the following pavement improvement has been completed and the general character; Hof the improvement, the street, alley or public place on which it has been made, and the terminal points ithereof, are as follows: Class "C" Type 1 (6" Concrete) Pavement on Lake Street from the north prpperty line of Jefferson Blvd. to the south property line of Washington Avenue. There is on file in the Office of the City Controller of the City of South Bend, Indiana, an assessment roll with the names of the owners and description of property subject to be assessed with the amount of the prima facia assessment, and can be seen in the Office of said City Controller. The Board of Public Works and Safety of said City, at the Office of the Board in said City, will on the 5th day of August, 19579 at 10:00 A.M. (DST) receive and hear remonstrances against the amounts assessed agains their property respectively, on said roll and will determine the question as to whether such lots or tracts of land have been or will be benefited by said improvement to the amounts named on said roll, or is greater or less than that named on said roll or in any sum. Sabo, Clerk RESOLUTION ADOPTING FINAL ASSESSMENT ROLL After hearing all persons interested who appeared and the Clerk of the Board of Public Works and Safety having been found sufficient, therefore, BE IT RESOLVED, BY THE Board of Public Works and Safety of the City of South Bend, Indiana, that the Primar or Preliminary Assessment Roll adopted by the Board on the 8th day of July, 1957, for the improvement of Oa crest Drive from 35th Street to Sylvan Glen and Sylvan Glen from Oakcrest Drive to McKinley Avenue, be and the same is in all things confirmed. %ttest: Anthony J. Bruggner 1 petition was received asking for the improvement of West Washington Street from Falcon Street to Kenmore street by the construction of curbing and pavement according to the Barrett Law program. Petition referred o the City Engineering Department. A letter was received from the City Planning Commission favorably recommending the vacation of part of the ;;first north -south alley (140) feet, west of Ironwood Drive, north of Oak Park Drive. :,Petition is now re- +ferred to the City Engineering Department for preparation of a vacation Resolution.
