Permission granted subject to said Associatio taying within buildings and not directly on the downtown streets. This ruling is set out in the City code f the City of SouthBend. A letter was received from the City Plan Commission recommending the vacation of Locke Street and it was re ferred to the Engineering Department for further investigation and recommendation. Building Commissioner, Verner L. Lane, appeared before the Board and requested permission to attend the annual Building Commissioner's Official Conference in New Orleans from May 5 through May 9, 1957. Permission granted. Mr. Lane also reports that the sound control system:at the Bendix Corporation is now underway. The plans and specifications as submitted to the Board by Mr. Lang for the Olive Street improvement from Washington Street to Linden Avenue are hereby approved and signed by the Board this 25th day of March, 1957. I Howard D. Rerick and Michael J. Barany hereby submit to the Board an Appraisal Report of the property of Joseph A. Toth D.D.S. and Helen Toth located at 1005 West Indiana Avenue. Accepted and placed on file in the office of the Board of Public Works & Safety. Beth Riley Construction Company submitted to the Board a form to be approved which would enable said Compa to have the benefits of the exemptions from the federal transportation tax provided by Revenue Ruling 55-16 !in connection with the materials which will be incorporated into the work on Sample Street improvement and re consigned to the City of SouthBend, Indiana. Board approves subject to Rieth Riley submitting to the Bo ;indemnity to cover vandalism, or loss or shortages of material store on the job site. Ar. Robert L. Miller, Attorney hereby requests to purchase certain real estate owned by the City of South Send and located along the right-of-way line of the Michigan Central Railway Company lying south of Angela 3oulevard and northerly and westerly of the West line of the Right-of-way of State Road No. 31. Board now advises Mr. Miller that The City will need this property for future use as a street and therefore the prop- 3rty is not for sale. letter is directed from the Board to the Board of County Commissioners with reference to effecting the iydraulic Street bridge. R. S. Andrysiak is authorized to meet with Bert McClellan to work out a solution on the possibility of replacing the bridge. The time now being after 10:100 M. (CST) it was so announced and the bids for the Street department were now opened. Proofs of publication in the South Bend Tribune with an affidavit signed by C. G. Livengood an, in the Record with an affidavit signed by W. DeCanio were submitted to the Board for examination and found sufficient. The Clerk of the Board having shown sufficient proofs of publication and no remonstrators having appeared and no written remonstrances having been filed with the Clerk, it was moved, seconded and unanimously carried that 1the said Resolution be finally adopted and said walk be vacated. is .The Engineering Department is directed to prepare an assessment roll showing the assessment of benefites and; a he award of damages to the surrounding properties.
