All members were present. E. Anderson. I A letter was received from the City Plan Commission recommending the vacation of an alley connect- ed with Johnson Street and it was referred to the Engineering Department for further investigantion and report. A letter was received from the City Plan Commission recommending the vacation of a north -south alley between Lots 97 and 98 in Lincoln Manor Addition from the south right of way of Bonds Avenue south to the north line of the east -west alley of said lots, said alley lying south of Bonds Avenue between Meade Street and Eclipse Place and it was referred to the City Engineering Department for further investi gation and report. On delivery of the deed with reference to the real estate owned by the Indiana & Michigan Electric Company in connection with the Sewage Treatment Plant, the Controller is hereby directed to pay to the Indiana & Michigan Electric Company the sum.of $1000. contractor's bonds in the sum of $1000 were approved for Arthur B. Strasser and Hilton Construc- tion Company. Excavation bonds were approved for James A. Currie and Hilton Construction Company. The bond of the Indiana Bell Telephone Company with the City of South Bend, Indiana was approved and accepted by the Board. Mr. Virgil D. Woodworth, Chaplain representing the V.f. W. requested permission to hold their an- nual poppq day sale on May 18 and May 19, 1956. Permission granted, same being to all post of the V.F.W. The Avalon Grotto requested permission to hold a house to house paper drive for the benefit of • the Crippled Children s Hospital on May 19, 1956. Permission granted. Stop Signs were installed at the following locations: Dubail,.both sides, at Brookfield street. Dubail, both sides, at Nash street. Dubail, both sides, at Walnut Street. A petition was received asking for the vacation of an alley extending from North Chicago Street East to North Illinois Street. Referred to the City Planning Commission for investigation and recommend- ation. VACATION RESOLUTION NO. 2832 i R. S. Andrysiak, City Engineer, filed primary assessment roll showing the awards of damages and the assessment of benefits in the matter of the vacation of the ALLEY WEST OF OLIVE STREET FROM LINCOLN- WAY WEST, SOUTH TO THE NORTH LINE OF THE ALLEY SOUTH OF LINCOLNWAY WEST under Resolution No. 2832. In the above named assessment roll, the Board hereby orders that it will meet in the City Hall at 10:00 A.M. (DST) on the llth day of June, 1956 for the purpose of hearing and receiving remonstrances from all persons interested in or affected by said vacation and the Board further orders that notice of said hearing, together with the amount of damages awarded and benefits assessed be addressed to the prop- erty owners by publishing same on the 18th day of May, 25th day of May and the 1st day of June, 1956, in the South Bend Tribune and The Record. The following property may be injuriously or beneficially affected by -such vacation: Lot numbered 1 in Kaley's Lincoln Highway Addition and all property East of said alley from Lincolnway West to Bonds Avenue owned by Epworth Memorial Methodist Church. RESOLUTION NO. 2797. CONTRACTOR'S COMPLETION AFFIDAVIT i IN THE MATTER relating to the Pavement Improvement on the Alley between Michigan & Main Streets from Marion Street to Madison Street made under Improvement Resolution No. 2796, 1954 and the plans and specifi- ,cations, therefore comes now Kenneth A. McIntyre, who being duly sworn upon oath deposes and says he is ac- quainted with The McIntyre & Jones Company, the party to whom was awarded the contract and who performed th work under Improvement Resolution No. 2796, 1954. That he is familiar with and personally knows the requirements of the contract, plans and specifica- .tions for said improvement and further knows that the said McIntyre & Jones Company in the performance of said work complied with all the terms and conditions of said contract, plans and apecifications in every particular, and that the material used was of the character, kind, quantity and quality required therein an according to and ur%r the direction of the Board of Public Works and Safety of the City of South Bend, Ind - liana. RESOLUTION NO. 2797 ENGINEER'S CERTIFICATE OF COMPLETION We hereby certify that the contract between the City of South Bend, Indiana, Owner, and the McIntyre & Jones, Contractor, for the construction of the Pavement Improvement on the Alley between Michigan Street :and Main Street from Madison Street to Marion Street under Improvement Resolution No. 2796, 1954 has been completed in accordance with the plans and specifications for this project. RESOLUTION NO. 2797 RESOLUTION ACCEPTING FINAL ESTIMATE BE IT RESOLVED, by the Board of Public Works and Safety of the City of South Bend, Indiana, that the (Final Estimate and Primary Assessment Roll submitted to the Board by the City Civil Engineer or his duly authorized representative on this 14th day of May, 1956 on the improvement known as the Alley between Mich 1gan and Main Streets from Madison Street to Marion Street as described in Improvement Resolution No. 2796, 1954, passed by the Board of Public Works and Safety on September 7, 1954, and confirmed by said Board on ,;September 26, 1954, be and the same is hereby adopted, and the Clerk of this Board is hereby requested to ;give notice of the hearing of Special Benefits on said Improvement, as required by Section N. 111 or 120 • of an Act entitled, "An Act Concerning Municipal Corporations" approved March 6, 1905. I, 478 There is on file in the Office of the City Controller of the City of South Bend, Indiana, an asses's- ment roll with the names of the owners and description of property subject to be assessed with the amount I of the prima facia assessment, and can be seen in the Office of said City Controller. The Board of Public Works and Safety of said City, at the Office of the Board in said City, will on the 28th day of May, 1956, at 10:00 A.M. (DST) receive and hear remonstrances against the amounts assess - ed against their property respectively, on said roll and will determine the question as to whether such lots, or tracts of land, have been or will be benefited by said Improvement to the amounts named on said i( roll, or is greater or less than that named on said roll or in any sum. IMPROVEMENT RESOLUTION NO. 2831, 1956 IMPROVEMENT RESOLUTION AWARDING CONTRACT After due investigation of all bids and being duly advised on the premises, the Board of Public Works & Safety of the City of South Bend, Indiana, decides that the bid of the A. E. Anderson Company, 1131 Sunnymede Avenue, South Bend, Indiana for the construction of the improvement knows as the 29th St. paving and curbs improvement according to Improvement Resolution No. 2831, 1956, is the lowest and best bid, and that the contract to do said work be awarded to the A. E. Anderson company, 1131 Sunnymed"e Avenue South Bend, Indiana. IMPROVEMENT RESOLUTION NO. 2831, 1956 FINAL ORDER WHEREAS, the Board of Public Works, did on the 2nd day of May, 1956 adopt a Preliminary Order des ignating a Class "C" Type 1 (6" concrete) pavement and Portland Cement roll type curbs for the improve- ment of 29th Street from the North property line of Northside Blvd. to the South property line of Pleasant Street by constructing a Class "C" pavement and Portland Cement concrete curbs in accordance with Improve- ment Resolution No. 2831, 1956, passed by this Board on March 12, 1956, and confirmed by this Board on April 16, 1956, therefore, BE IT RESOLVED, that the Preliminary Order is hereby, in all things confirmed as adopted and said street be paved with Class "C", type 1 (6" concrete) pavement and that roll -type concrete curbs be con- structed.
