The Board next read the Building Commissioner's letter of January 21, 1955, con-
!cerning protest made against the commercial use of property at 3514 Mishawaka Avenue,
which letter informs the Board such use will terminate on February 1, 1955. The Board
directed that this letter be placed on file.
PLANS REPORTED - JEFFERSON BOULEVARD TRUNK SEWER
Wilbur H. Gartner and Associates reported to the Board, Profiles, Drawings, Plans,
General Details, Specifications, Estimates and the Preliminary Improvement Resolution
for the improvement of JEFFERSON BOULEVARD - 34th Street - Washington Street.- 35th
Street from approximately two hundred feet east of 26th Street to Logan on Jefferson
Boulevard; from Jefferson Boulevard to Washington Street on 34th; from 34th Street to
35th Street on Washington Street and from Washington Street to Oakcrest Drive on 35th
Street by constructing a trunk sewer extension.
The Board approved the report and passed Improvement Resolution No. 2801, author-
izing this improvement, and the 9th day of February, 1955, at the hour of 6:30 P.M. CST.
is hereby fixed as the time, and the office of the Board in said City as the place,
when and where all persons whose property may be affected by such proposed improvement,
may be heard as to the necessity for the same, and all petitions and remonstrances
received and the Board will, on said day, decide whether the benefits accruing to
abutting and adjacent property, and to the City of South Bend, Indiana, will be equal
to or exceed the estimated cost of said improvement. The Clerk of the Board is hereby
ordered to give notice by two weekly publications, of the time and the place of hearing
of this resolution, No. 2801, adopted this 24th day of January, 1955, and to,be`pub-
lished on the 28th day of January and on the 4th day of February, 1955.
Copy of letter, dated January 18, 1955, to B. F. Seeberger, Agent, N. Y. C. R.R.
from Ernest H. Miller, Traffic Engineer, calling attention to condition of planking
at railroad crossings, particularly the Leer Street crossing, was examined and ordered
placed on file.
STREET DEPARTMENT:
H. M. Tomlinson, Street Commissioner, being present, reported on a minor auto-
mobile damage not exceeding $25.00, which claimant blamed to Sanitation Department
vehicle being operated on wrong side of the street. The matter was placed in the hands
of the City Attorney f(Dr settlement.
'Excavation Bonds, each in the sum of $1,000.00, for the following three
contractor were examined and approved:
Louis Seago, Jr d/b/a Seago Plumbing & Heating Co.
E. A. Strohm, d/b/a Strohm Construction Company.
Edward J. White, Inc.
There being no further business to come before the Board, the meeting was adj
at 11:35 A. M.

SPECIAL MEETING - January 28, 1955
A special meeting of the Board of Public Works was held Friday, January 28, 1955,
:at 2:30 P. X. All.members were present. The Board has been advised by special counsel,
,Russell C. Kuehl, that all of the requirements of the indemnifying and saving harmless
;the City of South Bend, from and against all loss and damage to any property whatsoever,
fall loss and damage on account of injury to or death of any person whomsoever, and all
;claims and liability for loss and damage and cost of expense thereof caused by or growing
gout of, or in any way connected with the construction of the Toll Road, has been supplied
to special counsel, Russell C. Kuehl.
Further all other conditions in nature of immediate costs and future costs as set
1forth by the City of South Bend, have also been recognized and satisfied, therefore the j
';Board of Public Works, City of South Bend, Indiana, grants right of entry to the Indiana
'!Toll Road Commission to a parcel of land, which is a part of the right of way of the pro-1
;posed Toll Road extending West from the St. Joseph River in St. Joseph County, Indiana,
;;a distance of 350 feet and also a '50 foot wide access road thereto.
There being no further business to come before the Board at this time, the meeting
