September 27, 1954
A regular meeting of the Board of Public Works was held Monday, September 27, 1954,
at 10:00 A. MI. All members were present. Minutes of the previous meeting were read
and approved. Claims of the following suppliers, in the total amount of $6391.29, were
approved and ordered paid:

First appeared before the Board, Pair. Rawson H. Miurdock, representing rlossberg & Co.
,Inc., and presented to the Board, a petition for the vacating of alley running east and j
west between Sample Street and Tutt Street, starting at Carroll Street and ending at
',Tutt Street, the area being that extending 136 feet east from Carroll Street to 14 feet
west of Lot 7; all in Anderson Subdivision. Petition was referred to the City Plan
aCoinmission for their recommendation.
The Board next examined revised drawings of the Re -Plat of Part of Lincoln Plaza,
Second Addition, covering sewer construction plans for Ryer Street, Iowa Street, and
,Elwood Avenue. The Board approved the revision indicated.
A remonstrance placed with the Board, over the signature of August H. Engstrom and
six other owners of real estate abutting and adjoining the 900 block ?"Jest Donald Street,
against the paving of this block, was examined by the Board and ordered placed on file.
A letter from the contracting firm of Sollitt Construction Company, under date of j
:September 21, 1954s pertaining to roof slabs, was referred to the consulting engineers, 1
Consoer, Townsend & Associates, for their advice and recommendation.
Then appeared before the Board, V'T'rs. John W. VTcCauslin, requesting permission for '
lithe Daughters of Isabella organization to use a booth in front of the Robertston
Department Store in their solicitation of funds on behalf of the Northern Indiana Childrer�Is
HHospital. In view of the precedent this would establish, it was deemed inadvisable to

grant this request, and it was suggested that the organization obtain space for its
ibooths in suitable locations on private property. p
Next appeared two gentlemen, representing the Ambassador Club of Bethel College,
requesting permission to conduct religious services Friday evenings on the sidewalk of
Chapin Street at a point of their choosing, at or south of the intersection of Chapin
and Monroe Streets. The Board granted the request with the stipulation that "a fairly
good lane be maintained for pedestrian traffic", and that no tracts or pamphlets be
distributed in violation of the City .ordinance.
Next appeared Wm. S. Nickell of Michigan City, Indiana, with a view to installing
benches at bus stops in certain locations. Inasmuch as this type of advertising was
recently given thorough investigation and condemned by the Board, Mr. Nickell was so
advised and dismissed.
A petition, dated September 21, 1954, for the vacation of alley between West
Donald Street and West Ewing Avenue in Swygart+s 5th Addition, was examined and referred.
to the City Plan Commission for investigation and report.
Cab -owner Ernest Zick then appeared before the Board, in protest to the Boardts
failure to provide him a cabstand and outlined to the Board his safety record and
experience over a period of years as a taxicab driver in South Bend. The Board set the
next regular meeting at 10:00 A. MI. CST, as a date for a hearing in the matter, and
the Clerk was directed to notify the cab owners and operators, together with Otto More-
house, president of the Cab Driversi Union, accordingly.
:?STREET DEPARMi NT:
H. M. Tomlinson, Street Commissioner, being present, brought to the attention of
Lithe Board, dust complaints and reports of damage to oiled streets, caused by excessive
Muse by the activities of contractors in connection with work involved with the Cityts
;;interceptor sewer system. The Board authorized Commissioner Tomlinson to proceed with
certain grading and cleaning work on public property on Bartlett Street, Riverside Drive,;'!
jand Gertrude Street. The Board directed that upon completion of this cleaning and
,;grading, the contracting firm of Niles Excavating Company is to be billed in the amount
!of $20.00 as their fair share of the cost.
VACATION RESOLUTION NO. 2800 - 1954
This being the date set, hearing was had on the resolution heretofore adopted
by the Board of Public Works for the vacation of the TEN FOOT PUBLIC WALKWAY between
;'Lots 314 and 315 in EDISON PARK ADDITION and TEN FOOT PUBLIC WALKWAY between lots 333 and;;
{334 in EDISON PARK ADDITION and FOURTEEN FOOT PUBLIC ALLEY between Lots 328,329, 330 and
331 in EDISON PARK ADDITION, under Vacation Resolution No. 2800.
Attorney Warren Diehl and Leo Witucki, Division Supervisor of the Indiana & Mlichigar
.,Electric Company appeared before the Board, representing the Indiana & Michigan Electric
(Company regarding existing easements and rights of the Indiana & Michigan Electric Company.
The Clerk of the Board having shown, sufficient proofs of publication and no remon-
strators having appeared and no written remonstrances having been filed with the Clerk,
,:it was moved, seconded and unanimously carried that the said resolution be finally
'adopted and said walkways and alley be vacated, contingent upon public utility easements
and rights being preserved to the -satisfaction of the Indiana & Michigan Electric Company.'
The Engineering Department is directed to prepare an assessment roll covering the 11
• assessment of benefits and the award of damages to the surrounding properties. j
The time now being eleven otclock, it was so announced, and the Board proceeded
with the opening of bids, as follows:

A proposal submitted by Taylor Construction Company for the construction of fifty
concrete posts on Lincoln Way East, the repair of twenty -fide additional posts, and
welding, cupping, and installation of the required 21" steel pipe for the restoration of
the river bank protective fence, as per legal adv&rtisement, was examined and taken
under advisement.

Certificate of Completion was furnished by Wilbur H. Gartner & Associates accom-
panied by Contractorls Completion Affidavit of the contract oetween the City of South
Bend, Indiana, Owner, and the Niles Escavating Company, Contractor, for the construction
of the local sewer improvement on GERTRLTDE STREET from 233 feet south of Prairie Avenue
to the center line of lot 31 in Sumption Prairie Addition unae_ Improvement Resolution
No. 2779, 1951� has been completed in accordance with plans and specifications for this
project.

the City Civil Engineer or his duly authorized representative on this 27th day of

in Improvement Resolution No. 2?79, 1954, passed by the Board of Public Works and Safety
on June 14, 1954, and confirmed by said Board on July 12, 1954, be and the same is here-
by adopted, and the Clerk of this Board is hereby _requested to give notice of the hear-
ing of Special Benefits on said Improvement, as required by Section N.111 or 120 of an

The Board next considered and approved agreement for engineering services to be
entered into between the City of South.Bend and Wilbur H. Gartner & Associates in
connection with the General Street Improvement Program, which hereby becomes a part
of these minutes:
THIS AGREEMENT made and entered into this 27th day of September, 1954, by and
between the CITY OF SOUTH BEND, INDIANA, a municipal corporation, acting by and through
its Board of Public Works and Safety (hereinafter for convenience referred to as "City")
and WIILBUR H. GARTNER & ASSOCIATES, Civil Engineers of South Bend, Indiana, (hereinafter
for convenience referred to as "Engineers").
WHEREAS, the City is contemplating a General Street Improvement Program, which
includes the re -surfacing or replacing of the paved roadway on various arterial streets
in the City, and
WHEREAS, the Engineers are qualified and experienced in the design and constructs
of pavements and the necessary appurtenances therewith and are capable of serving the
City in such matters.
j NOW, THEREFORE, in consideration of certain amounts hereinafter specified to be
• paid to the Engineers by the City, the Engineers agree to do, at their own cost and
expense, all of the engineering work hereinafter specified, to the full satisfaction
of the Mayor of the City, its Board of Public Works and Safety and in complete fulfill-
ment of the legal requirements of the Ordinances and Regulations of the City and . the
Statutes of the State of Indiana applicable to the foregoing described work.
DIVISION A - Designs, Detailed Plans, Construction Drawings, Estimates of Cost,
Specifications and Contract Documents
For the preparation of complete designs, plans construction drawings, speci-

" fications, estimates of cost and contract documents for all work to be done under
the General Street Improvement Program, as prepared under Division A, the fee will
i sum equal to three per cent(3%) of the estimated construction cost of the work.
Services to be rendered under Division A are as follows:
(1) The Engineers shall make all necessary field surveys, and
prepare complete designs, plans, profiles and specifications
for all improvements to be constructed under this program.
The streets to be so improved are to be designated and authorized
by the City.
(2) The Engineers shall prepare detailed estimates, showing the estimated
quantities and estimated construction costs of the various pavements
to be constructed, including other necessary work and appurtenances
essential to same.
(3) The Engineers shall prepare complete specifications for the various phases
of the work, including proposal forms, contract forms, bond forms, and
all other features essential to complete contract documents.
(4) The Engineers shall supply a reasonable number of copies of the plans and
specifications to the City.

(5) The Engineers shall supervise the making of any test borings or test pits
if needed for the purpose of determining sub -grade conditions on the various
streets to be improved. All costs in the making of such test borings or
test pits are to be borne directly by the City, and are not included in the
Engineerst fees as herein set forth.
(6) The Engineers shall assist the City in interesting experienced and qualified
contractors in bidding on the work, and assist the City in receiving con-
struction bids and in the awarding of construction contracts.

(7) The three per cent (3%) fee detignated for work under Division A will
be due and payable upon completion and delivery of detailed plans,
estimates of cost and specifications, to the City.
The amount of the fee so paid at that time shall be based upon the
Engineert' estimated construction cost of the Work, and shall be
subject to the approval of the Board of Public Works & Safety.
DIVISION B - CONSULTING SERVICES AND GENERAL SUPERVISION.DURING CONSTRUCTION
The Engineers will furnish all necessary field engineering to
lay out, supervise, and inspect the work and also will furnish
consulting services during construction.
The fee for this service is to be an additional two per cent(2%)
of the construction cost of the work; provided, however, that
as hereinafter agreed, the total fee shall not in any event
emceed five per cent (5%) of the actual construction cost of
the overall project.
Engineering services to be rendered under Division B shall
include:
(1) To furnish the constructing contractor the necessary
bench marks, lines and grades required for constructing the
improvement.
(2) To furnish the necessary inspection to insure the
installation of the complete work in accordance with the
plans, specifications and contract documents.
(3) To prepare partial and final esti:,-nates of cost for approval
by the Board of Public Works and Safety.
(4) To furnish such consulting services as may be required during
the period of construction.
(5) To furnish the City with final construction "as built"
drawings of each project.
The two per cent (2c%) fee for services rendered under Division B will be
due and payable in monthly increments based upon monthly estimates of construc-
tion work performed. The total amount of the fees for which provision is
made in this contract shall be computed on the basis of total actual con-
struction cost of each contract and the Engineers, shall not be entitled to
receive as full payment from the City more than a total of five per cent (5%)
of such total actual construction cost.
IN WITNESS 117HEREOF, the City of South Bend, Indiana, acting by and through
its Board of Public Works and Safety, and Wilbur H. Gartner & Associates, by
Wilbur H. Gartner, Owner, have signed this agreement this 27th day of September
