All members were present. Minutes of the previous meeting were read and approved. Salary claims, in the total amount of $36,855.26, were approved. Werntz & Son, Inc. 35.53 The Board first examined and approved Dedication of Public Utility Easement, Swanson ;Park Fourth and Fifth Additions, and the accompanying drawing, bearing the Engineer's . Certificate of Wilbur H. Gartner and Associates, and directed that the recording of this easement be made forthwith. Then appeared before the Board a Reverend Hatchett, asking permission to conduct a tag day on the downtown streets for the purpose of raising funds for a Church building ,;enterprise. The Board pointed out that permits are confined to national organizations, (mainly for the benefit of war veterans, and the Board cannot extend this privilege, inasmuch as the tag days involving only national organizations are now excessive. Permit .was accordingly denied. A delegation of twenty or more persons next appeared before the Board, the spokesman 'for which was Mrs. Victor Reamer, 1136 Byron Drive, Broadmoor. Mrs. Reamer stated that . residents of this area are cora'ronted with the problem of transportation for forty-three school children, and asked that the Board obtain for them a change in the Bus routing ,of the Northern Indiana Transit lines to include Broadmoor and provide the needed trans- portation to the James Ta!onroe School. The situation was very thoroughly covered and the suggestion offered that for the immediate handling of the problem, the group could enter :into a temporary arrangement with one of the taxicab companies. The Board assured the delegation that the matter will be given prompt consideration and a report will be re- quested and obtained from the Northern Indiana Transit, Inc., to be available at the next' regular meeting of the Board, covering in detail the feasibility of extending the Miami bus route an additional two blocks to accommodate the Broadmoor area, and in making a re-routing to establish a bus stop at a point close to the James Monroe School. • Next appeared before the Board a group of eight or more persons, the spokesman for whom was P,"rs. Seymour Reisman, 913 Roosevelt Street. Mrs. Reisman informed the Board that this group, and other residents of Roosevelt and Beale Streets, are now confronted .with a serious lack of bus service to provide transportation of school children to and from Muessel and Holy Cross Schools. The situation was thoroughly covered by discussion,; and the group was assured by the Board that their problem will be given immediate and careful consideration, and a report will be requested and obtained from Northern Indiana Transit, Inc., to be available at the next regular meeting of the Board, covering in detail the feasibility of adjusting bus schedules to provide the desired service, includ- ing the return trip for the school children of this area upon their dismissal at 3:30 P.M' • The Board next examined and approved drawing submitted by Wilbur H. Gartner and Assoc- iates, bearing date of September 3, 1954, and entitled LOCAL SEWER IMPROVEMENT - Ease- 'Yhbhts between - Lots 409 and 1_10 in Edison Park Addition. IMPROVEMENT RESOLUTION NO. 2788 - AWARDING CONTRACT Engineer's Report, submitted by 'Wilbur H. Gartner & Associates, having been re- ceived and examined by the Board, in the matter of bids for the improvement of DUNHAM STREET from the west line of Olive Street to the east line of Kaley Street by con- structing a Class C - Pave -rent in accordance with Improvement Resolution No. 2788, 1954 passed by this Board on July 6, 1954 and confirmed by this Board on August 9, 1954-, the bid was awarded to the Reed Construction Company for the sum of $14,589.50. 228 P IMPROVEMENT RESOLUTION NO. 2789 - AWARDING CONTRACT ,I Engineerts Report, submitted by Wilbur H. Gartner & Associates, having been re- ceived and examined by the Board, in the matter of bids for the improvement of SOUTH li BROOKFIELD STREET from the south line of Indiana_Avenue to the north line of Prairie Avenue by constructing a Class C - Pavement in accordance with Improvement Resolution No. 2789, 1954 passed by the Board of Public Works and Safety on July 6, 1954 and confirmed by the said Board on August 9, 1954, the bid was awarded to the Rieth-Riley Construction Company for the sum of j 28, 874.00'. The Board next examined and approved Contract Supplement No. 2 and Contract • Supplement No. 3, dated August 31, 1954 and September 1, 1954 respectively, and pertain-i ing to Contract No. 6; Santucci Construction Company, Contractor. '! STREET DEPARTMENT H. M. Tomlinson, Street Commissioner, being present, brought to the attention of the Board, the condition of the New York Central right-of-wgy on the north side of the New York Central Railroad tracks east from Main Street. The Board directed the Clerk to notify the railroad company of this condition and request that the site be cleaned as quickly as possible. Commissioner Tomlinson then reported a condition existing on the tracks of the Chicago, South Bend and South Shore Railway, in the vicinity of Olive and Washington • Streets, where water stands in two or more low spots after heavy rain, regarding which complaints have been made to his department. The Clerk was directed to bring this matter to the attention of the South Shore, requesting the remedying of the condition. il The Commissioner then discussed with the Board other matters pertaining to his department, including the damaged condition of the Norton Drive Sewer, and the breakage ii of three catch -basins, evidently -caused by heavy trucks. The matters were referred to the City Engineer for his investigation and recommendations. The construction of a '! dry -well at 1005 White Oak Drive was given some discussion, and it was the decision of ±i the Board that this property owner is to buy and pay for the stone required, and also pay the City the cost of delivering the stone to the site, estimated to be approximately+; $5. 00 per hour for actual hauling _`. time . Due to a remonstrance having been filed, objecting to the grade planned by the City Engineert s office for the improvement of alley between Cottage Grove Avenue and Cushing,Street, for which the profiles, drawings, plans and general details, spec ifiea- tions and estimates were approved by the Board in regular meeting June 14, 1954 and i the plans and specifications for which were adopted at the regular meeting of July 12, 1954, it was the decision of the Board to rescind all action taken in this matter, where;! by Improvement Resolution No. 2783 is rendered null and void. The Board next examined the recommendations of the consulting engineers, Consoer, Townsend and Associates, relative to the cost and manner in which sewer at the location it of the Veterans of Foreign Wars Post No. 1167 Home on Lincoln Way East can be reinforced)+ to insure against any possible damage to the sewer due to future building construction • on this site, and directed the Clerk to notify the Veterans of Foreign Wars Post No.1167 accordingly. The Board next took note of a letter from. the Pacific Flush Tank Company, dated September 3, 1954, in Re: Proposal for License - Kraus Interchange Process, according to Paragraph 6 - Section "Ft' and Paragraph 1-H p. C-2(b) - Sewage Treatment Plant and referred this matter to the office of the City Engineer for study and recommendation. '! The Board next considered and approved the employment of Attorneys Charles W. Hahn and Robert A. Grant as legal advisors to the City in the matter of the Street Improve- ment General Bond Issue. Zi is e os o 5.00 to the Parking Meter Funds accordingly. a. i VACATION RESOLUTION NO. 2799 This being the date set, hearing was had on the resolution heretofore adopted by the Board of Public Works and Safety for the vacation of the ALLEY 'NEST OF LELAND AVENUE j from the North line of the east west alley, north to California Avenue, under Vacation Resolution No. 2799. The Clerk of the Board having shown sufficient proofs of publicatign and no remonstrators hsving appeared and no written remonstrances having been filed with;.) the Clerk, it was moved, seconded and unanimously carried that the said resolution be finally adopted and the said alley be vacated. The Engineering Department is directed to prepare an assessment roll covering the assessment of benefits and the award of damages to the surrounding properties. R. S. Andrysiak, City Engineer, filed primary assessment roll showing the awards of damages and the assessments of benefits in the matter of the vacation of ALLEY WEST OF LELAND AVENUE under Vacation Resolution No. 2799. Tomlinson, Street Commissioner, again appeared before the Board and the matter of the payment of overtime to "part time" employees was given discussion, citing particu- larly a current instance. It was the decision of the Board that henceforth no "part time!' • employees are to be called upon to work overtime, but in the particular instance cited, overtime will be paid the employee involved, in accord with the recommendation of the Street Commissioner. A petition, bearing date of August 23, 1954, and carrying four signatures, one of which was that of John F. Vurpillat, having been returned to the Board by the City Plan Commission because of indefinite description of property the petitioners desire to be vacated; was again examined by the Board, and the Clerk was directed to return the petition to ffr. Vurpillat accordingly. A petition dated .'august 30, 1951L, signed by twenty-two residents of Goodland Avenue and the 2900 block of Elwood Avenue, protesting a dust problem, accident hazard and other • unsatisfactory conditions in connection with the operations of The South Bend Sand and Gravel Company, was examined and action held in abeyance, pending investigation of the reported condition. It was brought to the attention of the Board through reliable sources that some "listening -in" has been indulged in by switchboard operators. The Clerk was directed !:to notify the Chief Telephone Operator, who in turn is to notify relief operators that '!this practice will not be tolerated. The property which the Board heretofore decreed in its action of July 26, 1954., to be appropriated for public use, and described in the minutes of the regular meeting of CD the Board, Monday, August 9,'1954,'and the hearing of remonstrances having been continued to this 7th day of September, 1954, now comes before the Board for hearing and no re - ,monstrance or objections having been filed, and'no one appearing in opposition thereto, the said damages to the owners of said property are finally determined as awarded by the Board, and as recorded in the minutes of its meeting of August 9, 1954, and the City Controller is now directed to forthwith make payment of the allowances heretofore de- termined as damages. Martin, President and General Manager of Northern Indiana Transit, Inc. in response to the Boardts request, together with a woments delegation, representing patrons of James Monroe, St. Matthew, Muessel and Holy 11 Cross Schools. Mr. Martin presented maps showing all bus routes currently in operation j in South Bend and Mishawaka, and "Tripper" schedules now in effect on the ten established:] school routes. Mr. Martin explained in detail the problem which confronts the bus ;company in extending their service, and cited their experience over the past two years where test operation over a period of weeks proved definitely extended service into 'rsuburban area would fail to produce profitable revenue and would, in fact, result in substantial loss to the company if continued. A considerable amount of discussion ensued. Mr. Wm. E. Voor, representing the Hilton Construction Company, pointing out the prospect of rapid expansion in the settlement of the Broadmoor area, and estimated not less than seventy-five school childreri are now in the area. City Attorney, I. A. Hurwich, being present, then pointed out that in the main the problem is one in which the School City would be more concerned, and at the same time one of such importance that the Board of Public Works will endorse and approve any reasonable agreement that may be reached between either or both groups of school patrons and the bus company, and arrangements were made thereupon for a meeting of the bus company officials with the Broadmoor group to be held in the office of the Hilton Construction Co., 4104_ Miami Street, at 2:00 P.1,91. Thursday, September 16, 1954- A letter was received from the City Plan Commission recommending the vacation of alley between 1926 South Swygart Street and 2002 South Swygart Street and this was I' referred to the Engineering Department for further investigation and report. i 1 �J • • U •
