visit to this display of brick panels and they likewise made individual choices, and then
coincided the tastes to unanimously choose the same panel, shown as 901 smooth grey on
the Board and 914 smooth grey on rear of panel.
The two groups of judges worked separately and neither knew the other was making the
choice. i
Immediately prior to adjournment representatives of the V.F.W., Messrs. Fred Weinberg
and Albert G. Grise, appeared before the Board in the matter of the sewer to cross the
river and join the main interceptor sewer on the opposite bank of the river, which they
find will conflict with future construction plans of the V.F.W. "home" now located on
the south river bank on property obtained from the City of South Bend (Department of
Public Parks). It was pointed out that at the time of purchase easement was -secured
for sewer construction. After some discussion of the situation, the Board directed
City Engineer, R. S. Andrysiak, to investigate the possibility of moving further to
the north, such investigation to be conducted in conjunction with the consulting engin-
eers, Consoer, Townsend and Associates.

A regular meeting of the Board of Public Works was held Monday, July 26, 1954, at

;TRAFFIC DEPARTMENT:
The Traffic Engineer's need for 1500 feet of 7-C Solid Wire underground traffic
signal cable was brought to the attention of the Board, and the Clerk was directed to
proceed with the required legal advertising to obtain bids on this material.
The Board next approved the installation of S-T-O-P signs on both sides of Vassar
venue at Huey Street and on both sides of Bendix Drive at Jefferson Boulevard.
Next appeared before the Board Attorney Eli F. Seebirt, representing Nellie W. Vaug
in the matter of a remonstrance against resolution of condemnation adopted by the Board
July 6, 1954, in the belief that Lot 89 of the original plat of the City of South Bend,
of which Nellie W. Vaughn is the owner, would be adversely affected. Mention was also
made of other property, presently in the control of the Office Outfitting Company,
affected by the above mentioned resolution, and this was also given consideration. The
remonstrance being directed against Tract No. 1, and no remonstrances being filed with
or presented to the Board against the proposed condemnation of other property described
.in
the resolution of condemnation adopted July 6, 1954, the Board now continues its
earings as to tracts Nos. 2 and 6 in said resolution until its regular meeting on
August 2, 1954, and takes final action with modifications hereinafter set out as to
Tracts Numbered 3 and 4, and rescinds its former action as to Tract Numbered 5.

Tract 3
It is ordered and decreed, and there is hereby appropriated for the use of the
City of South Bend, Indiana, or its successors, the right to lay, maintain, operate,
alter, repair -and remove a sewer; lift station, river crossing entrance chamber, manholes',
structures, pumping staions and appurtenances, including utility poles and/or guy- wires
connected therewith, through and over the following described real estate in St. Joseph''
County, State of Indiana, to wit:
A parcel of land lying East of the intersection of Edgewater Drive andLi
Monroe Street as shown on the recorded plat of Edgewater Place.Addition,
to the City of South Bend, bounded by a line running as follows, to wit:
Beginning at the intersection of the easterly line of Edgewater Drive and
the southerly line of Monroe Street projected easterly, thence easterly
on the southerly line of Monroe Street projected easterly to the low-water
mark of the St. Joseph River; thence downstream along the low-water mark
of said River to the center line of Monroe Street projected easterly; thence
West along the center line of Monroe Street projected easterly to the East
line of Edgewater Drive; thence South Along the easterly line of Edgewater
Drive to the place of beginning.
Tract 4
It is ordered and decreed and there is hereby appropriated for the use of the
City of South Bend, Indiana, or its successors, the right to lay, maintain, operate,
alter, repair and remove a sewer, lift station, manholes, structures, pumping stations
and appurtenances connected therewith through and over the following described real
estate in St. Joseph County, State of Indiana, to wit:
A parcel of land taken from Lot Numbered 11 in Miller and Green's First
Addition to the Town of Lowell, now the City of South Bend, bounded by a
line running as follows, to wit: Beginning on the South side of Colfax
Avenue at a point 253.93 feet West of the Northeast corner of said Lot 11
in Miller and Greents First Addition; thence West along the North side of
Lot 11 a distance of 14.5 feet; thence South perpendicular with the North
line of said Lot a distance of 4-1 feet; thence East parallel with the
North line of said Lot 11 a distance of 14.5 feet; thence North 4-1 feet to
the place of beginning, which point is 739.65 feet West of the intersection
of the South line of Colfax Avenue and the West line of Niles Avenue in the
City of South Bend, Indiana.
And the Board now orders that a list or roll be prepared of all owners or
holders of property and of valuable interest therein sought to be taken, which list
or roll shall also describe the property either injuriously or beneficially affected.
The Board again took up for consideration the matter of the possibility of
relocating the proposed 24" sewer across the property of the V.F.W. and having been
quoted the cost of such re -location, the Board directed the Clerk to notify the V.F.W.
committee concerning such cost and request their decision as to whether or not they
will assume the necessary expenditure for such re -location.
STREET DEPARTMENT:
Street Commissioner, H. M. Tomlinson, being present, discussion was entered into
at some length concerning weed -cutting operations, the ineffectiveness of the present
ordinance governing, and the need for revision or a new ordinance in this connection.
No definite conclusion was made in the matter.
The Board next examined price list and literature pertaining to the Apeco Auto-
Stat and directed that this data be referred to Mr. Robert Huff for study in conjunction
with his' study of the City+ s need for micro -filming equipment.
Then appeared before the Board, Attorney Russell C. Kuehl with agreements bearing
signatures of the institutional heads of Notre Dame University and St. Maryts College,
relative to the connecting of the sewers from each of those institutions with the
sewage disposal system of the City of South Bend. Agreements were examined, approved,
and signed by the Board for forwarding to the Common Council for further action this
date.
The time now being 11:00 otclock, it was so announced, and the Board then pro-
ceeded with the opening of bids, -as follows:

the Board, informing the Board of a national emergency drive the foundation is launching

the placing of their March of Dimes booth in front of Robertson's, throughout the period.]
The Board offered no objection, and granted permission with the -stipulation that the ii
foundation secures the permission of Robertsons likewise.
The Board next held the hearing as advertised in the matter of Taxicab License
Application of John L. Detzler. Present for the hearing were John L. Detzler, applicant,;;
Otto Morehouse, representing Taxicab Drivers Local No. 141, A. F. of L. Roy Sharp,
Manager and Samuel Shulman,Attorney, representing Indiana, Yellow, South Bend and United
taxicabs. All persons were heard, in considerable detail, and the Board then took the '
matter under rurther advisement. is
VACATION RESOLUTION NO. 2765
The single remonstrator in the matter of the vacation of the ALLEY WEST OF LAUREL
STREET, Mrs. H. J. Sobolewski, having, in writing, withdrawn her remonstrance, the
Board.proeeeded with the hearing.
This being the date set, hearing was held on the assessment roll showing the award
of damages and the assessment of benefits in the matter of vacation of THE ALLEY ZEST
OF LAUREL STREET, FROM THE SOUTH LINE OF THOMAS STREET SOUTH, ONE HUNDRED THIRTY-FOUR
and FIVE TENTHS FEET, under Vacation Resolution No. 27 5.
In the above named assessment roll, no remonstrators appeared and no written
11remonstrances were filed, the Clerk of the Board submitted proofs of publication of
°notices and same were found sufficient, and the Board, therefore, finds that the several
lots and parcels of land have been benefited and damaged in the amounts shown on said
;roll. The Board, therefore, decided to take final action on said assessment roll and
:declares same in all things ratified, confirmed and approved without modification and
the proceedings closed, and the alley vacated upon receipt of the amount of benefit 3
'assessments from the various property owners so benefited and all proceedings had with
'reference to said alley vacation are hereby sustained. •
