A regular meeting of the Board"of Public Works was held Monday, July 12, 1954, at
,10:00 A. M. All members were present. Minutes of the previous meeting were read and
approved. Claims of the following suppliers, in the total amount of $47,306.80, were
approved and ordered paid:

The first business given the attention of the Board was that of the conveying to
Ernest L. Longwa.y and Eva L. Longway, for the consideration of $2900.00, the following
...described real estate:
Lot Numbered 7 and a lot or parcel of land 28 feet in
width, North and South, taken off of the entire South
• side of Lot Numbered 6, as shown on the recorded Plat
of Coquillard Woods Addition (Section "A") to the City
of South Bend, St. Joseph County, Indiana.
Warranty Deed was, accordingly, signed and notarized, and all papers pertaining to
the City's title were delivered to the City Attorney, for the consummation of the con-
veying of title.
A letter from Rev. C. J. Witucki, seeking permission for the barricading of streets,
at night only during festival operations, throughout the dates of July 18th to 25th
inclusive, and for the conducting of the Saint Casimir Church Annual Festival on those
dates insofar as the public streets are involved, was read and considered by the Board.
It is understood that Saint Casimir Church will provide public liability insurance to
• protect the parish and the City of South Bend, as heretofore provided for this annual
aff air. The Board granted authorization and directed the Clerk to so notify Rev. Witucki::
The Taxicab License Affidavit of John L. Detzler was next given the Boardts con-
sideration. The Board set the hearing in this matter for I:Ionday, July 26, 1954, at
11:00 A. M. D.S.T. and ordered notice of hearing to be published in the South Bend Tribune,
Friday, July 16th. i.
The Mayor having ordered the repair of the sidewalk and curb immediately in front of
the City Hall, and a -. satisfactory quotation for the prompt installation of this urgently
needed improvement having been submitted for the Board's consideration, the Clerk was
. directed to proceed at once to accept the quotation and order the work to be done.
The Board read and concurred fully with letter written to the Executive Vice President
of the University of Notre Dame under date of July 9, 1954, over the signature of the
Chairman of the Board which reads as follows:
"This letter is pursuant to our several meetings with you and your
Attorney, 1;r. Louis Chapleau, in regard to an agreement of charges to
be made to the University for treating the University's sewage at our
Sep^✓age Treatment Plant located at Pin 1-1ook Park in South Bend, Indiana.
The University will furnish to the City a quarterly average adjusted
count, that is, a population count will be due on each
•population
January 15th, April 15th, July 15th, and October 15th of each year.
The City Sewage charge billing clerk will use the national institutional
water usage average of 80 gallons per capita per day multiplied by the
population count furnished by the University of Notre Dame to arrive at
a. total quarterly sewage volume. From this calculated volume a charge
based on the O dinancets established rate ,will be levied for such sewage
treatment.
Billingwill start the _month after the City of South Bend puts its Sewage
Treatment Plant into operation, provided however, that at such. time the
•
University sewers have been connected to the City's interceptor sewer system."
The delay in the repair of the Ironwood Drive Bridge next came to the attention of
the Board, and the Clerk was directed to notify Engineer Wm. S. Moore that his proposal

;for the repair of this bridge must be presented to the Board not later than Julyl9th.
The delay in repair of the protective 'fence along the river bane from. Twyckenhar,
(Bridge to the Grand Trunk Railroad viaduct was _referred to, and some consideration given
;the matter.
Contract Supplement No. 4, under date of July 7, 1954, submitted by Consoer, Town-
Isend and Associates, was examined and approved by the Board.
VACATION RESOLUTION No. 2787
R. S. Andrysiak, City Engineer, filed primary assessment -roll showing the awards
of damages and the assessments of benefits in the matter of the vacation of THE PASSAGE
WAY FROM THE EAST SIDE OF ST. JOSEPH STREET TO THE WEST SIDE OF JANES DAONROE SCHOOL
PLAYGROUND, SAID PASSAGEWAY LYING BETWEEN LOTS NM,, BERED 386 and 387 a.s shown on the plat
of Beverly Heights Tenth Addition, under Vacation Resolution No. 2787.
In the above named assessment roll, the Board hereby orders that it will meet in the
City Hall at 11:00 A. M. DST on the 9th day of August 19% for the purpose of hearing
and receiving remonstrances from all persons interested in or affected by said vacation,
and the Board further orders that notice of said hearing, together with the amount of •
damages awarded and benefits assessed be addressed to the property owners by publishing
same on the 16th day of July, on the 23rd da.y of July, and on the 30th day of July, 1951,
in the South Bend Tribune and Tri -County News.

estimated cost of the same as reported by the City Civil Engineer, therefore

Department of Public Yorks and Safety.
July 26, 1954, at the hour of 10:00 A. C.S.T. is hereby fixed as the time and
the office of the Board of Public Works and Safety in the City Hall of this City,
as the place, when and where the Board of Public Works and Safety will open and consider
bids for the above named improvements, provided all bids for the constructinn of said
work shall be filed in the office of the Clerk of this Board before 10:00 otclock A.Pd:.
G.S.T. of said day. Each bidder for said work shall enclose with his bid a -certified
check, payable to the Treasurer of this City in the sum of two and one-half percent
of the amount of his bid, or a bid bond for two and one-half percent of the amount of
his bid, to insure the execution of this contract, if said work is awarded to him.
The Clerk of this Board is hereby ordered,
of the time and place, when and where bids will -
the contruction of said work. Said Clerk shall
shall enclose with his bid a certified check or
insure the execution of this contract.

An. excavation Bond in the sum of $5,000.00, binding Edward Sidorowicz, d/b/a Sidts
Plumbing & Heating, as principal, and the Continental Casualty Company, as sureties,
was examined and approved by the Board.

A special me'ekng of the Board of Public Works tiaras held at 10:00 A. M. DST.
Mir. Orrie E. Parker was present and submitted drawing for replat of Lots Numbered 14
through 37, and vacated alleys in Parker & Allen1s Addition to the City of South Bend,
Indiana. Mr. Parker also filed with the Board Cause No.95120 in the St. Joseph Circuit
Court, which decree covers vacation proceedings of the original plat which reads as
follows:

Comes now the plaintiff, Colpaert Realty Corporation, by its attorneys, Parker
& Parker; and comes also the City of South Bend, Indiana by its attorney, Irving
Hurwich; and come also Blanche 1.1. Dice and Helen Culver.by their attorney, George
Rulison, and Louise Cannady, Herschell Hartzell and wife, and Dren_man G. Tatman and

issue upon plaintiff's petition and the answers of The City of South Bend, Indiana

And the Court, having heard said petition, together with argument of counsel and
the evidence thereon, and being duly advised in the premises, finds:
1. That the allegations of plaintiff's petition are true with the exception that
the Lot Numbered Thirty-two (32) in said Parker & Allen Addition as originally pla.tte
is owned by Blanche 14. Dice and Helen Culver, and that plaintiff has no interest in
ten (10) feet off the North side of said Lot Numbered Thirty-two (32) as alleged in
its petition.
2. That plaintiff's purpose of increasing the size of the lots in said Parker
& Allen Addition so that all lots are accessible from the street line is consistent w th
the purposes of good planning in said City and is to the best interests of the
community. That the omission of alleys from said Addition relieves the burden of
