Special Meeting - May 20, 1954
A special meeting of the Board of Public Works was held Thursday, May 20, 1954,
at 2:00 P. M. All members were present. In compliance with a request from Mayor Scott
received this date, Messrs. Tomlinson and Cripe were called before the Board to discuss
garbage collection. The Board unanimously adopted the following order:
In areas where there are no alleys curb pick up is no longer mandatory.
There being no further business to come before the Board, the meeting adjourned .

D E D I C A T I O N
WHEREAS, a plat with dedication of streets and utility easements indicated thereon
is now presented to the Board, to be known as EDISON PARK SECOND ADDITION, an addition
to South Bend, Indiana, and
This plat and dedication is filed in the records of the Board of Public Works
and Safety and recorded in Book # , Page , in the Recorders s Office of St. Joseph
County.
NOW, THEREFORE, be it resolved by the Board of Public Works and Safety of the City
of South Bend, Indiana, that all public streets and utility easements dedicated to the
public use in said plat are hereby accepted and approved by said Board for and on behalf
of the City of South Bend, Indiana.
Contract Supplement No. 1, applying to Contract P-6, American Vitrified Products
Company, Contractor, bearing date of May 20, 1954, was next examined and approved by the
Board.

ENTRY OF PETITIONS PRESENTED
The Board of Public Works and Safety hereby receives and places on file the petitions
of School City of South Bend for the improvement on SOUTH LAKE STREET ( EAST SIDE),
lfrom the south line of Western Avenue to the north line of Ford Street, and the improve
ment on COLFAX AVENUE (NORTH SIDE) from the east line of Greenlawn Avenue.to the west
line of Coquillard Drive.

PETITION REFERRED TO ENGINEER
The Petitions of School City of South Bend for the improvement of SOUTH LAKE STREET
(EAST SIDE) from the south line of Western Avenue to the north line of Ford Street, by
constructing a sidewalk, and the improvement of COLFAX AVENUE (NORTH SIDE) from the
east line of Greenlawn Avenue to the west line of Coquillard Drive by constructing a
sidwalk and curb, was referred to the engineer for investigation and recommendation.
CITY CIVIL ENGINEERtS RECOMMENDATION
The City Engineer being present, made the recommendation that the petition of
School City for the improvement on SOUTH LAKE STREET ( EAST SIDE) AND COLFAX AVENUE
(NORTH SIDE) be granted. The Board then directed that the firm of Wilbur H. Gartner
and Associates prepare general details, drawings, specifications, and preliminary
improvement resolutions for the two improvements to be constructed and the firm was
so notified.
PLANS REPORTED
Wilbur H. Gartner & Associates, Civil Engineers, filed Profiles, Drawings, Plans,
General Details, Specifications, Estimates and the Preliminary Improvement Resolutions
for the improvement of COLFAX AVENUE ( NORTH SIDE) from the east line of Greenlawn
Avenue to the west line of Coquillard. Drive for constructing a sidewalk and curb,
AND SOUTH LAKE STREET ( EAST SIDE) for constructing a sidewalk, under improvement
resolution Nos. 2776 and 2777.

improvements, and the 11_th day of June 1954, at the hour of 10:00 A. M. Central Standard"
Time is hereby fixed as the time, and the office of the Board of Said City as the place
when and where all persons whose property may be affected by such proposed improvements,;;
may be heard as to the necessity for the same, and all petitions and remonstrances
received, and the Board will on said day, decide whether the benefits accruing to
abutting and adjacent property, and to the City of South Bend, Indiana, will be equal
to or exceed the estimated cost of said improvements. The Clerk of the Board is hereby I
ordered to give notice by two weekly publications, of the time and place of hearing of
these resolutions passed by the Board on the 24th day of May, 1954, and to be published
on May 28th and June 4th in the South Bend Tribune.
The Hon. Walter C. Erler appeared before the Board, registering dissatisfaction with
the established system of garbage pick-up and declaring his preference for the curb
pick-up system, formerly in effect in all locations where access to an alley does not
exist.
The Board next examined petition filed under date of May 20, 1954, protesting the
construction of a parking lot and freight unloading zone at the rear of Casimerts
Super Market, 3410 Western Avenue, and heard three spokesmen for the petitioners,
Mesdames Robert L. Martin and Jack Buck, and Mr. Miathew Swizek. The Board referred the
matter to the Building Commissioner, and informed the petitioners, through their rep-
resentatives, that the matter would be given immediate attention.
The Board next examined and approved the construction of a canopy on new store front
at 1519 Portage Avenue, in accord with blueprint,submitted by Mr. & Mrs.. James Borden.
Then appeared before the Board, Attorneys Geo. N. Beamer and Louis C. Chapleau,
representing the New York Central and the Grand Trunk Railroads, and a delegation
representing the Truckers Association, the spokesmen for which were Messrs. J. H.
Ellsworth, George Kessler, and Homer Fitterlir_g. The first matter takne up was that
of the .paving of Sample Street, from, Lake Street to Albert Street.
The City Engineer, R. S. Andrysiak, explained this improvement cannot be effected,
inasmuch as, after two attempts, it has been impossible to secure the financial aid of
the industries and commercial interests from whom the costs of the contemplated paving
would have to be obtained.
A spokesman for the Truckerts Association also called attention to the relief needed
from the standpoint of routing, and in this connection the Board, thereupon, declared
Chapin Street open for truck transportation from Western Avenue to Prairie Avenue. The
Board stressed, however, that under no circumstances is Chapin Street available to
• such transportation north of Western Avenue.
The City Engineer then stated that a complaint had been filed by the trucking
'concerns in regard to the blocking of the crossing at Sample and Olive Streets, and

;and asked for a re -statement of the cooperative efforts made by the railroads and the
!truckers to remedy this traffic problem. After some discussion it was conceded -by the
,truckers that the Grand Trunk Western has cooperated fully in keeping switching oper-
ations involving this crossing to a minimum. Macolm M. Bell of Elkhart, an operations
executive of the New York Central, contended that seventy-five percent of their
;switching operations are confined to the yards west of Olive Street, and that if his
!office is notified, either directly, or through Traffic Engineer, E. H. Miller, as to
time and date, and locomotive number of the offending switching crew, the New York
Central, will be able to bring this problem under control. It was the final decision
in the discussion to further attempt to correct and control the excessive switching
Operations, which have brought about this complaint, thru the established committee
;comprised of Messrs. Seeburger and Thompson of the New York Central and the. Grand Trunk
Western Railroad, E. H. Miller, Traffic Engineer of the City of South Bend, and Yard-
master Hickey of the New Jersey Railroad.
The Board next directed the Clerk to proceed to advertise Notice of Condemnation,
in accordance with resolution adopted at the regular meeting of the Board on Monday,
! May 10, 1954, for the purpose of acquiring easement rights to certain tracts of propert
in connection with the sewage disposal system.
A letter was received from the City Plan Commission,under date of May 22nd,
recommending the vacation of alley between Lot 2 of Susan M. Stokes, Subdivision of
B. 0. L. 96 and Pulaski Park, and this was referred to the Engineer for investigation.
A letter was received from the City Plan Commission, under date of May 22nd,
recommending the vacation of the alley beginning on the south side of Thomas Street
running south along the west line of Lot Twenty -Four (24), between McPherson and Laurel
Streets, a distance of 134.51, and this was referred to the Engineer for investigation.
SANITATION:
H. M. Tomlinson, Supt. of the Sanitation Department, being present, the Board
issued the directive that garbage truck crews are not to pick up any trash, ashes, or
other refuse, but confine their pick up to garbage. The Board further directed that
the Sanitation Department must insist upon compliance on the part of householders with
the Boardts regulation that garbage is to be wrapped in paper before being place in
regulation metal container.
STREET DEPARTMENT:
Street Commissioner, H. M. Tomlinson, being present, took up with the Board the
matter of the oiling of Circle Avenue and the area on Niles Avenue occupied by the
Co -Operative Coal Company, Co -Operative Locker Plant and New York Central Railroad.
The Board approved agreements reached between the Commissioner and the commercial
interests involved, and directed that the Commissioner proceed with the oiling operations.
A petition requesting the oiling of the street in the 400 block of Wellington Stre
was approved by the Board and Commissioner Tomlinson was directed to proceed with this
improvement.
The Board further directed that the Street Department oil that section of Riversid
Drive in the area of construction activities now under way in connection with the
Sewage Treatment Plant and appurtenances thereto.
Mr. Edward Barkowski then appeared before the Board requesting permission for the
erecting of a signboard at Western Avenue and Taylor Street. City Attorney, I. A.
Hurwich informed Mr. Barkowski that upon receipt of satisfactory written agreement that
he would be responsible for the removal of the sign, in the event the City requires the
location for street widening at a later date, the Board is agreeable to permit the
erection of sign in accordance with his request.
VACATION RESOLUTION NO. 2774
This being the date set,, -hearing was held on the assessment roll showing the
award of damages and the assessment of benefits in the matter of vacation SORIN STREET
FROM PRESTON DRIVE TO THE EAST,LINE OF THE RECORDED MCKINLEY TERRACE ADDITION TO THE
CITY OF SOUTH BEND, INDIANA, legally described in Resolution No. 2774, on file in
the Board of Public Works and Safety Office.
In the above named assessment roll, no remonstrators appeared and no written
remonstrances were filed, the Clerk of the Board submitted proofs of publication of
notices and same were found sufficient, and the Board, therefore, finds that the
several lots and parcels of land have been benefited and damaged in the amounts shown
on said roll. The Board, therefore, decided to take final action on said assessment
roll and declares same in all things ratified, confirmed and approved without modi-
fication and the proceedings closed, and the street vacated upon receipt of the amount
of benefit assessments from the various property owners so benefited and all proceed-
ings had with reference to said street vacation are hereby sustained.
TRAPPIC DEPARTN ENT:
Traffic Engineer, E. H. Miller, being present, brought to the Boardts attention
a letter from Mr. H. S. Cover, concerning the practice of night -parking along his
premises, resulting in:the unsightly collection of bottles and empty beer cans, and

suggested the use of a Police Department warning sign. It was the opinion of the Board; !
that the regulation NO DUMPING sign, to be erected by the Street Department would be l
equally effective, but before granting authorization, asked that an investigation of
the condition and location be made by Engineer Miller.

The Board approved the installation of S-T-O-P signs on Haney Avenue at St. Joseph
Street.
Excavatorts Bond, in the sum of $10,000.00, binding Hilton Construction Company, Inc.,
• 1as principal, and Fidelity and Deposit Company of Maryland, as sureties, was examined
;;and approved by the Board.
Contractorts Bond, in the sum of $1,000.00, was examined and approved by the Board
for Alvin Lynn.
