A regular meeting of the Board of Public Works was held Monday, May 10, 1954, at
10:00 A. M. All members were present. Minutes of the previous meeting were read and

The,Board first took note of the Colpaert Realty Corporation's letter of May 7, 195
withdrawing petition for paving alley west of Gladstone, between Huron and Ford Streets.
The Board next examined and approved drawing submitted by Colpaert Realty Corporation.,
covering alley improvement plan for the alley between Huron and Ford Streets, as prepared; 51
by Engineer P. L. Roelke. I)
The Board then gave consideration to the necessity of acquiring easement rights to
certain tracts of property for the use of the City in connection with the intercepting
sewers, river crossings and lift stations of the sewage disposal system, and adopted the
following resolution:
R E S O L U T I O N (DECLARATORY NO.1 )
WHEREAS this Board has heretofore been empowered by appropriate
ordinances, to build, construct and acquire a sewage disposal plant
with necessary intercepting sewers, river crossings and lift stations,
and
WHEREAS it is necessary for the location and construction of
such river crossings and lift stations that the easement rights to
certain tracts of property be acquired for the use of the City of
South Bend,
NOW, THEREFORE, be it resolved that the easement rights be
acquired by appropriation or condemnation, for the use of the City of

South Bend, for the location and construction of sewer river
crossings and lift stations, in the manner provided in
Chapter 129 of the Indiana Acts of 1905, and Chapter 61,
Acts of 1932 (Special Session), to the several tracts of
property in said City of South Bend, St. Joseph County,
State of Indiana, which may be injuriously or beneficially
affected, described as follows, to -wit:

Easement for sewer at Mill Street and Colfax Avenue, said
Easement to -wit:
Beginning at the Northwest corner of lot 1189" of the Original
Plat of South Bend; thence Southerly along the West line of
said lot 1189" 40 feet; thence Easterly parallel to the North
line of said lot "89" 40 feet; thence Northerly parallel to
the West line of said lot 1189" 25 feet; thence Easterly to
a point in the East line of said lot 1189" 15 feet Southerly
of the Northeast corner of said lot 118911; thence Northerly
along the East line of said lot 1189" 15 feet to the Northeast
corner of said lot "8911; thence Westerly along'the North line
of said lot "89" 76.5 feet to the point of beginning.

Easement for sewer at Mill Street and Colfax Avenue, said
easement is described as follows:
Said easement is bounded on the North by the most Northerly
line of lot 1121" and the North line of lot 1115" of the Original
Plat of South Bend Mfg. Co.ts Subdivision, said lines are also
the South line of Colfax Avenue; bounded on the West by the East
line of lot "89" of the Original Plat of South Bend; bounded on
the South by a line 15 feet South of and parallel to the aforesaid
South line of Colfax Avenue; and bounded on the East by a line
38.46 feet East of the Northwest corner of lot "15" of said
Original Plat of South Bend Mfg. Cots Subdivision and parallel
to the West line of said lot 1115".

Easement for sewer at Monroe Street and Edgewater Drive, said
easement, to -wit:
Beginning at a point on the easterly line of lot "74" of "Edge-
water Place" 82 feet northerly of the southeast corner of said
lot "74"; thence northerly along the easterly line of said lot
"7411 25 feet more or less to the low water mark of the St. Joseph
River; thence westerly along the low water mark of the St. Joseph
River to the westerly line of said lot "74"; thence southerly along
the westerly line of said lot "74" to a point 26 feet northerly of
the southwest corner of said lot "74"; thence easterly in a straight
line to the point of beginning.

Easement for sewer at Colfax Avenue and Sycamore Street, said
easement, to -wit:
Beginning at a point on the North line of lot "11" of Miller
and Greents lst Addition, said point being 238.58 feet West of
the Northeast corner of said lot 11111t; thence West along the
North line of said lot "11"; 150 feet; thence South at right
angles to the North line of said lot "11" 24.50 feet more or
less to the low water mark of the St. Joseph River; thence
Southeasterly along the low water mark of the St. Joseph River
to a line 30 feet South of and parallel to the North line of
said lot "11"; thence East along a line 30 feet South of and parallel

INDENTURE OF DEED
THIS INDENTURE WITNESSETH, that the CITY OF SOUTH BEND, county of St. Joseph,
State of Indiana, grants, bargains, sells, releases, quit claims 'nd conveys to
SOUTH BEND POST #1167, VETERANS OF FOREIGN WARS, INC., for and in consideration
of the sum of Seven Thousand Dollars ($7,000.00) the receipt whereof is hereby
acknowledged, the following described real estate, in the City of South Bend,
St. Joseph County, State of Indiana, heretofore held by the City of South Bend, for
use of its Park Department, to -wit:
"F-2't and "E-2`t as shown on the recorded Plat of
Lots "G-2",
Wenger and Kriegbaumts Vistula Avenue Addition, more fully
described as beginning on the west edge of the St. Joseph
River on the line between lots "G-2" and 'tH-2" as shown on the
recorded Plat of Wenger and Krieghbaums Vistula Avenue Addition,
thence Southwest on the line between said lots "G-2" and "H-2"

The City of South Bend represents and warrants that it has not

above described real estate, or any part thereof, or the
fee simple title thereto may be impeached, charged or encumbered.
This conveyance is made pursuant to an ordinance of the Common
Council of the City of South Bend, adopted on the 13th day of
August, 1951, and entered in Ordinance Book 9, Page 242 in the

• ij The Board next took note of a copy of the Acting Building Commissionerts
letter, dated April 29, 1954, addressed to Robert L. Huff, Secretary of the Board of
Zoning Appeals, relative to an addition to a building on the premises at 3000 E.
j Washington Avenue, having been constructed without a building permit and in violation
{ of agreement between the property owner and the Board of Zoning Appeals; and in
±� violation of the Building Code. Letter was ordered filed.

A letter, dated May
5, 1954, addressed to the Board from Attorney Russell
C. Kuehl, presenting present status of contracts and insurance requirements of
contractors on the sewage works project, was next read by the Board. The Clerk was
directed to notify Ralph Moorhouse, local representative of Consoer, Townsend and
Associates, of the Boardts approval for pipe deliveries to commence, on the site,
• I! by Independent Pipe Company, and to notify the several contractors to commence work
1 within ten days from this date, contingent upon certain requirements having been
!; met by, or before May 20th.

The Board next examined and approved letter supplied by Paschen Contractors,
Inc., under date of May 6th, over the signature of Jacob Paschen, in which they accept
full responsibility for the pipe after it has been laid down on the site by the
Independent Concrete Pipe Corporation, and inspected by the Cityts representative.
A drawing was next presented to the Board, showing a .canopy construction
proposed for the building at 1117 Mishawaka Avenue, and having found upon examination
that the proposed canopy will present no unsightly or hazardous condition, the Board
proceeded to approve the drawing.
VACATION RESOLUTION NO. 2773
This being the date set, hearing was held on the assessment roll showing the
award of damages and the assessment of benefits in the matter of vacation of Streets,
Alleys, and Utility Easements, all in a part of Edison Park Addition to the City of
South Bend, Indiana, as covered by Vacation Resolution No. 2773, except and excluding
those utility easements covering the north four feet of lots numbered 351 to 359
inclusive, under Vacation Resolution No. 2773.
In the above named assessment roll, no remonstrators appeared and no written
remonstrances were filed, the Clerk of the Board submitted proofs of publication of
notices and samd were found sufficient, and the Board, therefore, finds that the i
several lots and parcels of land have been benefited and damaged in the amounts shown
jj on said roll. The Board, therefore, decided to take final action on said assessment
roll and declares same in all things ratified, confirmed and approved without modificati44'
and the proceedings closed, and the portion of the alleys, streets and utility easements!;
vacated upon receipt of the amount of benefit asses-sments from the various property s'
owners so benefited and all proceedings had with reference to said streets, alleys and
'utility easement vacation are hereby sustained.
TRAFFIC ENGINEER:
!' The recommendations of Traffic Engineer, E. H. Miller, for the protection
jof school children crossing Prairie Avenue at Leon Court, submitted by Engineer Miller,
!under date of May 3, 1954, were considered and approved by the Board. {

!; The Board next approved the installation of S-T-O-P signs on Kemble Street
iat Dubail Avenue.
The Excavation Bond of James A. Currie, in the sum of $2,000.00, was examined;
and approved.

The Board first considered the request of V.F.W. Posts Nos. 1167, 3194, 3931, 8748,i�
i! 9720, and 9733 for permission to conduct their annual flower sale on May 20, 21 and 22nd,
The Board, being opposed to increasing the number of solicitation days from the usual I
two days, authorized the dates of May 20th and May 22nd only, denying permit to the
V.F.W. for Friday solicitations.
Next appeared before the Board, David Powers, as spokesman for the Junior Chamber
I
of Commerce, asking permission for that organization to conduct a ''rodeo'', featuring
horses and horsemen on Michigan Street, in front of the Robertson Store, on the two
Saturdays, May 22nd and May 29th, tentatively set at 11:30 to 1a:30 noon. The Board
considered the demonstration would be "in the nature of a parade" and pointed out to !�

Mr. Powers something of the hazard involved and the probable result of the precedent
such a demonstration would establish. A compromise was then settled upon whereby the
two Saturdays are covered by permit for a Junior Chamber of Commerce demonstration of
a rodeo character but minus the horses.
The Hon. Walter Glass appeared before the Board and again took up the matter
j of garbb.ge and trash collection, being performed by the Cityts Sanitation Department.
i Councilman Glass pointed out that the City issues licenses to one -hundred and ninety
five refuse collectors, and the lack of an ordinance to permit the City to engage in the
•
pick-up of rubbish. Councilman Glass was informed by the Board that the misunderstanding•
on ,the part of the public undoubtedly originated by the extension of the "clean-up
week" service, whereby many householders are ofthe opinion the Cityts Sanitation Depart-
ment is committed to pick up all refuse. The Board assured Councilman Glass that this
was not the intent or purpose of the ordinance, nor was the Sanitation Department
i instructed to extend beyond the "Clean -UP -Week" campaign this pick-up of trash service.

Next appeared before the Board, members of the American Legion Post 50, Woments
Auxiliary, asking permission for Post 50 to conduct its annual Poppy Day on Friday and
Saturday, May 21st and 22nd. Permission was so granted.
Next appeared three property -owners, living on Hartman Drive, complaining of
drainage conditions in the area and the fact that water stands in the street up to
