March 15, 1954
A regular meeting of the Board of Public Works was held Monday, March 15, 1954,
at 10:00 A. M. All members were present. Minutes of the regular meeting of March 8th
were read and approved. Claims of the following suppliers, in the total amount of
$1525.65, were approved and ordered paid:

First appeared before the Board Mr. Joseph Lochmondy of Mishawaka, a committeeman
for the Kimmett for Congress democratic organization, requesting permission to use a
public address device for public speeches on the downtown streets and various parts of
the city. City Attorney, I. A. Hurwich, being present, informed Mr. Lochmondy the
Cityts ordinance pertaining to this type of equipment forbids its use for such purpose.
Next appeared before the Board, Mr. C. A. Schille, 2029 Inglewood Place, requesting;
removal of Bus Stop to provide parking space in front of his private property. The
Board informed Mr. Schille an investigation would be made by the City Traffic Engineer,
of the situation presented, and the Board would be guided in their decision by the
Engineer's recommendations in the matter.
Then appeared before the Board Mr. Jules Kimmett, 304 Ardennes Avenue, Mishawaka,
democratic candidate for Congress, informing the Board that he is the applicant for
the P.A. system permit, and stating that his lawyer advised him that the use of such
equipment is permissable for campaigning purposes. Board member, I. A. Hurwich, then
read the city ordinance governing, and gave his opinion that such use is contrary to
the intent of the ordinance. Mr. Kimmett proceeded with the filing of a petition for
permit.
The Board next examined and approved Street Improvement Plan for Pyle Avenue,
from the South line of Edison Road to the northerly line of Rockne Drive, submitted
by Wilbur H. Gartner & Associates and bearing date of February 26, 1954-

RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, INDIANA!
That it is desirable to vacate the following:
is
Streets, alleys and Utility Easements, all in a part of Edison Park
Addition to the City of South Bend, Indiana, as follows:
All of Benedict Avenue East of a line extending from
the southwest corner of Lot No. 351 in said Edison
Park Addition to the northwest corner of lot No.404 in said
Edison Park Addition
All of Delano Avenue North of the northwest line of
Eisenhower Avenue and Victory Avenue, all in said Edison
Park Addition
All of Menorah Avenue South of the south line of Rockne
Drive in said Edison Park Addition
The alley extending from Eisenhower Avenue to Benedict
Avenue and from Benedict Avenue north between lots numbered
354 and 355
The alley extending from Victory Avenue to Menorah Avenue
and from Menorah Avenue west between lots Nos. 367 and 368
All utility easements that affect any part of lots numbered
351 to 405, inclusive and 450 to 485 inclusive as shown on the
recorded plat of Edison Park Addition to the City of South Bend,
Indiana.
The following property may be injuriously or beneficially affected by such
vacation:

VACATION RESOLUTION NO.2768 - 1954
This beinp the date set, hearing; was held on the assessment roll showinj the
award of damaves and the assessment of benefits in the matter of vacation the First
Alley North"of North Side Boulevard from Roberts Street East to the West Line of The

Seven Foot Half Alley East of Roberts Street, under Vacation Resolution No. 2768.
In the above named assessment roll, no remonstrators appeared and no written
remonstrances were filed, the Clerk of the Board submitted proofs of publication of
notices and same were found sufficient, and the Board, therefore, finds that the
several lots and of land have been benefited and damaged in the amounts shown on

said roll. The Board, therefore, decided to take final action on said assessment roll
and declares same in all things ratified, confirmed and approved without modification
and the proceedings closed, and the portion of the alley vacated upon receipt of the
amount of benefit assessments from the various property owners so benefited and all
proceedings had with reference to said alley vacation are hereby sustained.

Thids being the date set, hearing was held on the assessment roll showing the

Alley North of Rupel Street From Brookfield Street West to the East Line of The Alley
West of Brookfield Street, under Vacation Resolution No. 2769.
In the above named assessment roll, no remonstrators appeared and no.written
remonstrances were filed, the Clerk of the Board submitted proofs of publication of
notices.and same were found sufficient, and the Board, therefore, finds that the
several lots and parcels of land have been benefited and damaged in the amounts shown
on said roll. The Board, therefore, decided to take final action on said assessment

A petition, dated February 28, 1954, for the improvement of South 34th Street
from Jefferson Boulevard to Washington , by construction of sidewalks, and bearing
twenty-three signatures of residents of the locality,,, was next examined and referred
to the office of the City Engineer for investigation and report.

Upon the recommendation of the Consulting Engineers, Consoer, Townsend &
Associates, the Board named Yeomans Bros. Company to be suppliersof Items 0-1, 0-2 and
0-6 for the sewage lift stations to be constructed under Contract No. 7, and the
Clerk was instructed to so notify H. W. Hunter, Contractor, Plymouth, Indiana.
An. Execution (Mo.21517) issued by Elkhart Superior Court, s.nd bearing date of
February 25th, was examined by the Board and ordered placed in the Fattore Company
file.
It now being the time set for the opening of bids, announcement was so made and
bids were as follows-

STREET DEPARTMENT:
H. M. Tomlinson, Street Commissioner, being present, took up with the Board,
the disposition of a quantity of obsolete sewer -dragging equipment and other worn-out
and broken parts of Street Department equipment, which is occupying valuable space,
and which, in view of the tonnage involved, should be of value as junk. Board member
I. A. Hurwich, explained the procedure required to negotiate the sale of this type
of material and advised the Commissioner that the City Attorney would proceed in the
matter, through the Common Council,in accord with the statutes.
The Commissioner next called attention to the need for additional temporary
fencing at the land -fill. The Board requested the Commissioner to obtain not less
than three quotations on the quantity and type of fencing necessary for the area to be
protected.
Upon the recommendation of the Chief of Police and the City Controller, in which
the Board unanimously concurred, the taxicab driverts license of Al Brooks, 831 S.
Marietta Street, was revoked by the Board, as of this date, in compliance with Sec.39,
Chapter 26 of the Municipal Code of the City of South Bend.
The Clerk was directed to notify Mr. Brooks accordingly.
Preparatory to applying for license, South Bend Parking Company, Inc. submitted to
the Board a complete.report on their new parking lot to be opened at 220 W. Wayne Street;
with a capacity of 105 cars. The Board examined the report and approved the proposed
facilities and rates.
The request of the Department of Public Health that the Board advertise for bids
to supply that department with a micro -filming machine was approved and the Clerk directE
to proceed with the required legal advertising.
An injury report, dated March 11, 1954, concerning injury sustained by E. E.
Boudreau of the Traffic Engineerts Department, was examined and ordered placed on file.
The installation of S-T-O-P signs at the intersection of St. Peter Street and
Madison Street was given the approval of the Board.
The installation of S-T-O-P signs at the intersection of Longfellow and Sunnyside,
making this a 4-way stop intersections, was approved by the Board.
Contractors Bonds, each.in the sum of $1,000.00, were examined and approved for
the following contractors:

PLANS REPORTED
Wilbur H. Gartner & Associates, Civil Engineers, reported to the Board, Profiles,!;
Drawings, Plans, GeneralDetails, Specifications, Estimates and Preliminary Improvement
Resolution for the improvement of NORTH ELMER STREET, from the center line of Elwood
Avenue to the center line of Keller Street by constructing a local sewer.
The Board approved the report and passed Improvement Resolution no.2771, author-
ising this improvement, and the 5th day.of April, 1954, at the hour of 11:00 A. M. CST
is hereby fixed as the time, and the office of the Board in said City as the place,
when and where all persons whose property may be affected by such proposed improvement,;`,:
may be heard as to the necessity for the same, and all petitions and remonstrances
received and the Board will, on said day, decide whether the benefits accruing to
abutting and adjacent property, and to the City of South Bend, Indiana, will be equal
to or exceed the estimated cost of said improvement. The Clerk of the Board is hereby
ordered to give notice by two weekly publications, of the time and the place of hearing
of this resolution, No.2771, adopted this 15th day of March 1954, and to be published
on March 19th and March 2bth.
There being no further business to come before the Board, the meeting adjourned
at 11:25 A. M.
