First appeared before the Board, Attorney Irving J. Smith, representing Robertson
Brothers Department Store, and asking permission of the Board to conduct a parade of
Santa Claus and reindeers on Michigan Street, from Bartlett Street to their store, and
cap five parking meters in front of the store, from 10:00 A. M. to 6:00 P.M., Saturday,
Rovember 21, 1953, for the purpose of parking the reindeer truck at the location through-
out those hours:,Inasmuch as this date is the date of the Notre Dame -Iowa football game,
involving a heavy traffic dondition, and an excessive amount of work for the Police
Department, the Board, after hearing Attorney Smithts plea, took the matter under advise-
nent.
Mrs. Burnham, representing the Good Samaritan Army of Chicago, again appeared before
the Board and was granted a hearing. The Board again informed Mrs. Burnham that per-
mission will not be granted for the soliciting of alms on the downtown streets and in the
taverns and other places of business in that area, to this organization.
The Board approved the installation of two traffic signals at Indiana and Prairie
A venue .

A Storm Sewer Plan for that portion of Corby Street, located in McKinley Terrace
Addition, Section "B", bearing the date of November 9, 1953, and certified by Wm. S.
Moore, Engineer, was examined and approved by the Board.
The Certificate of Insurance provided by Continental Casualty Company, by Carl
W. Ginz, Inc., for the protection of the Association of Commerce of South Bend, Indiana
& Michigan Electric Company and the City of South Bend, in the matter of public liability
involving Christmas Decorations for the nine city blocks, as specified in the certificate
for the period of November 14, 1953 to January 31, 1954s was examined by the Board and
ordered placed on file.
A public utilities easement, recorded in the Office of the St. Joseph County
Recorder in Book 521, Page 465, No.91863, granted the City-of.South Bend, by John and
Luella Van Vynckt, Husband and wife, was approved and accepted by the Board, and ordered
f iled.
VACATION RESOLUTION NO. 2766 - 1953
RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, INDIANA*-
That it is desirable to vacate the following:
A PART OF SHERMAN AVENUE DESCRIBED AS FOLLOWS:
BEGINNING AT'THE NORTHWEST CORNER OF LOT 19,
WM. MILLERIS ADDITION, THENCE WEST 14.60 FEET;
THENCE SOUTHEASTERLY A DISTANCE OF 34.03 FEET;
THENCE EAST 6.30 FEET TO THE WEST LINE OF SAID
LOT 19; THENCE NORTH ALONG THE WEST LINE OF
LOT 19,: A DISTANCE OF 33 FEET TO THE PLACE OF
BEGINNING.
The following property may be injuriously or beneficially affected by such
vacation:
Lot Numbered 19, Wm. Miller's Addition
Notice of this resolution shall be published on the 20th day of November and on
the 27th day of November 1953 in the South Bend Tribune and Tri-County News.
This Board, at its office in the City Hall, on the 7th day of December 1953, at
11:00 A. M. will hear and receive remonstrances from all persons interested in or
affected by these proceedings.

VACATION RESOLUTION NO. 2767 - 1953
RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, INDIANA:
That it is desirable to vacate the following:
THE PUBLIC UTILITY EASEMENT BETWEEN LOTS NUMBERED ?5
AND 76 IN EDISON PARK ADDITION, FROM THE NORTH COMMON
CORNER OF BOTH LOTS TO A POINT SEVENTY (70) FEET SOUTH
ALONG THE COMMON PROPERTY LINE OF BOTH LOTS.
The following property may injuriously or beneficially affected by such
vacation:
Lots numbered 75 and 76, Edison Park Addition.

Next appeared before the Board, Councilmen, Wm. A. Hahn and Walter Glass, bringing t
;;the Boardts attention, the deliberate blocking of East Colfax Avenue, from Ironwood
Drive to Tuxedo Drive, bythe use of a bulldozer to make this thorofare impassable. The
1jcouncilmen were informed by -the Board that suit is pending to obtain a declaratory
judgment to establish easement for the thorofare, and failing in this, East Colfax
• ;Avenue can be opened by exercising the right of eminent domain.

The time being 11:25 A. M. the Board then recessed to take up further business at
:00 P. M.
Reconvening at 1:00 P. M., the Board took up the matter of the petition made by
Attorney Irving J. Smith on behalf of Robertson Brothers Department Store. In view of
the serious traffic problem presented, the Board rejected the petition and forbids the
capping of the five parking meters and the blockading of this space with the reindeer
exhibit planned by the petitioner.
There being no further business to come before the Board, the meeting was adjourned]
at 1:15 P.M.

IMPROVEMENT RESOLUTION NO. 2759 - 1953
Certificate of Completion was furnished by civil engineer, Wilbur H. Gartner, of
the contract between the City of South Bend, Indiana, Owner, and the Reed Construction.
Company, Inc., Contractor, for the construction of the Pavement improvement on LAWTON
STREET, from the west line of Olive Street to the east line of Washington Street, under
Improvement Resolution No. 2759, - 1953, in accordance with the plans and specifications
for this project.
RESOLUTION ACCEPTING FINAL ESTIMATE
RESOLUTION NO..2759 - 1953
BE IT RESOLVED, by the Board of Public Works and Safety of the City of South Bond,
Indiana, that the Final Estimate and Primary Assessment Roll submitted to the Board by t
the City Civil Engineer or his duly authorized representative on.this 16th day of
November 1953, on the improvement known as the LAWTON STREET PAVEMENT, as described in
Improvement Resolution No. 2759, passed by the Board of Public Works and Safety on
June 29, 1953, and confirmed by said Board on August 32 1953, be and the same is hereby
adopted, and the Clerk of this Board is hereby request to give notice of the hearing of
Special Benefits on said improvement, as required by Section N.111 or 120 of an Act
entitled, "Am Act Concerning Municipal Corporations" approved March 6, 1905.
