Under the new statutory requirements that took effect in July 2008, the Commission must, through a deliberate action, direct staff to prepare the appropriate documentation to amend a development plan. In the case of an amendment to the resolution or plan for an existing redevelopment project area, the Commission must determine the following: (1) The amendment is reasonable and appropriate when considered in relation to the original resolution or plan and the purposes of this chapter; (2) The resolution or plan, with the proposed amendment, conforms to the comprehensive plan for the unit Upon satisfactory determination of the above two points, the Commission shall cause to be prepared the following data: (A) Maps and plats showing the boundaries of the area in which property would be acquired for, or otherwise affected by, the establishment of a redevelopment project area or the amendment of the resolution or plan for an existing area; (B) The location of the various parcels of property, streets, alleys, and other features affecting the acquisition, clearance, remediation, replatting, replanning, rezoning, or redevelopment of the area, indicating any parcels of property to be excluded from the acquisition or otherwise excluded from the effects of the establishment of the redevelopment project area or the amendment of the resolution or plan for an existing area; What We Do Today Makes A Difference! (C) The parts of the area acquired, if any, that are to be devoted to public ways, levees, sewerage, parks, playgrounds, and other public purposes under the redevelopment plan; (D) Lists of the owners of the various parcels of property proposed to be acquired for, or otherwise affected by, the establishment of an area or the amendment of the resolution or plan for an existing area; and an estimate of the costs, if any, to be incurred for the acquisition and redevelopment of property. On August 21, 2009, the Redevelopment Commission approved Resolution 2596 which added properties to the AEDA acquisition list. The properties added were clustered into the three following groups: (1) Ivy Tech Project -Sample Street, (2) Air Gas -Lafayette Blvd, and (3) Ignition Park South -Indiana Avenue (Franklin to Taylor). The staff is in the process of purchasing properties in area 1, completed the purchase of Air Gas in area 2, and has purchased several properties within area 3. Staff would like to study additional acquisition target areas in the Ignition Park planning area and would request the Commission to consider and authorize the Staff to proceed on gathering information for the following three planning areas: Area 1: Ignition Park South -Indiana Avenue (Taylor to Prairie) Many parcels within this area bounded by Taylor, Indiana, Prairie and the Norfolk-Western tracks are in various states of distress and staff would like to continue to acquire vacant or abandoned properties within this corridor. Many properties within this area were on the recent tax sale. Additionally, staff would add to the acquisition list the properties acquired from the Burton Family (Waste Management site), and now owned by the City of South Bend, that were located south of the tracks. Area 2: Ignition Park West -Prairie Avenue to Walnut Street As the Staff has worked to develop a plan concept for the areas to the east and south of Ignition Park and have begun strategic acquisition of non-consistent properties, staff would request that the Commission authorize staff to examine the area west of Ignition Park and plan for future redevelopment needs in that area. A need for a plan west of the park was brought to the forefront when a proposed reuse of a vacant parcel was presented and the use has been deemed to be inconsistent with Ignition Park. The proposed use, a wrecker service, might have been a reasonable use on Prairie Avenue in the past, but the proposed use with Ignition Park illustrates the need for a plan for this area. Area 3: Gorny Plaza (1116 South Main Street) Gorny Plaza is located on the southeast corner of Stull and Main. It is presently listed for sale and would be a target acquisition to allow for redevelopment opportunities to advance and continue in that area between the Ignition Park campus and the Ivy Tech Campus. In summary, Staff would request that the Commission authorize the staff to begin the preparation of plans and maps and related property information, in conformance with State Law, for the three areas highlighted above. Once the information is gathered, staff will present the information to the Commission and then, upon approval of the planning information, will present a Declaratory Resolution to the Commission to amend the acquisition list for the AEDA. Separate resolutions will also be required to be approved by the Area Plan Commission and the Common Council before a final public action before the Redevelopment Commission in the form of a public hearing and Confirming Resolution.
