Miller, between the State of Indiana, through the State Highway Depart- ment of Indiana and the City of South Bend, Indiana: THIS AGREEIENT TRADE AND ENTERED INTO by and between the STATE OF INDIANA, through the State Highway Department of Indiana, and the City of South Bend, through its duly authorized and undersigned officials hereinafter referred to as the "City" witnesseth: WHEREAS, the City ha purpose of regulatin and Sheridan Avenue; (Prairie Avenue) and Street; and U. S. 31 and s requested that signal equipment be installed for the traffic at the intersection of S. R. 2 (Western Avenue) S. R. 2 (Western Avenue) and Taylor Street; S. R. 123 Indiana Avenue; U. S. 31 (Michigan Street) and Garat (Michigan Street) and Chippewa Avenue within said City, WHEREAS, the State Highway Department deems the regulation of traffic by means of signal devices, as hereinafter designated, to be beneficial to traffic on said S. R. 2, S. R. 123, and U. S. 31 to the extent of the cost of the materials and equipment. IT IS THEREFORE AGREED BY AND BETWEEN the State, through said Department, and said City, that such traffic facilities shall be installed under terms and conditions as follows: (1) The City, with its own forces, inconsideration of the benefits to traffic using said streets, shall perform, all work of installation of such facilities and the State, through said Department, hereby grants said City permission to enter upon said S. R. 2, S. R. 123, and U. S. 31 for the performance of such work. (2) That the work of installation to be performed by the City shall be so performed in accordance with the rules and regulations of the Department, and said work shall be so performed under the supervisic`A��and to the satisfaction of the Department. (3) The major electrical signal materials and major electrical signal equip- ment required in said traffic signal installations shall be furnished and paid for by the State Highway Department. (4) On and after the completion of the work of installation, the signal devices so installed shallbe the property of, and subject to the control of the State, through said Department, under rules and regulations of the Department and laws of the State now in force or hereinafter enacted, and the maintenance of such equipment and signal facilities shall be at the expense of the State, through said Department. (5) The electric energy required to operate the signal facilities shall be furnished by the City. (6) The City shall begin installing the traffic signal equipment not later than sixty (60) days after receiving the plans :and specifications from the Department for said signal installations. • A letter was received from the City Plan Commission, accompanied by blueprint, outlining a 7 acre tract of land west of Hickory Road (Logan Street) and south of Edison Road, for which Land Developers Co., Inc. have petitioned for annexation to the City of South Bend. The Board directed the Clerk to notify the City Plan that 34 lit meets with their approval and would not create any additional expense to the City. The Replat of Belleville Unit "D", an addition to the City of South Bend, Indiana (submitted by Colpaert Realty Company, was examined and approved by the Board. A petition, under date of June 23, 1953, signed by four property owners on Navarre Street, petitioning to vacate building in rear of 505 West Marion Street, South Bend, ,Indiana, said building being used by W. J. I A claim, in the amount of $p158.40, was received from the Hamilton Body Company, !covering repairs to a 1941 Pontiac,owned by Virginia Kalebic, which was d6maged when it•hit an improperly installed manhole on Huey Street. This was referred to Mr. I. A. i Hurwi.eh for proper disposition. An application for Taxicab License, under date of June 23rd, was received from IMr. Geo. M. Bernath, 2527 Dixie Highway North, was examined and referred to Chief Gillen 'for investigation and report: Messrs. Beck and Hines, Field Examiners, submitted the following for the Boardts ;information, which was taken from a bulletin to Field Examiners by the State Board of Accounts, - "NEW LAWS AFFECTING ALL UNITS" "Chapter 32 - SB 43; EFFECTIVE FEBRUARY 24, 1953• Amends 1945 PURCHASE ■ LAW: Permits purchases up to $1,000.00 on the open market without giving notice or receiving bids. The old law was limited to $500.00. Amends Ch.99, Acts 1945; Burns 53-501. Requires all purchases to be on a unit I basis Prohibits purchases of materials or equipment in excess of $lYOOO.00 on open market under two or more contracts." I Street Commissioner, Harry M. Tomlinson, being present, requested permission of the Board to close his department Friday, July 3rd. Permission was granted. A letter,under date of June 26th, was received from Consoer,Townsend and Associatesi regarding the analysis of test pile operations and foundation operations. This was ;read by the Board and ordered placed on file. The Clerk of the Board was directed to notify Is. Wm. S. Moore, Engineer, that the survey for the sit-' of Sewage Disposal Plant be completed and submitted to the Board of Works and Safety at the earliest possible date. IMPROVEP,TENT RESOLUTION NO. 2757 - 1953 FORD STREET - SCEIvTIC DRIVE - LOl,�ARDY DRIVE Engineerts Report, submitted by 1,ATilbur H. Gartner & Associates, having been re- ! ceived=and examined by the Board, in the matter of bids for the improvement of FORD STREET - SCENIC DRIVE - LOMBARDY DRIVE in Belleville Addition, in accordance with Improvement Resolution No. 2757, and confirmed by this Board on June 8, 1953, therefore Be It Resolved, that the Preliminary Order is hereby, in all things confirmed and said street ordered paved with a Class B - Type 1 Cement Concrete Pavement, and bid i awarded to Rieth Riley,Constructed Company as they submitted the lowest and best bid ;for Class B- Type 1 Cement Concrete Pavement, for the sum of $39,486.80. Gartner and Associates, Civil Engineers, reported to the Board, Profiles, Plans, General Details, Specifications, Estimates and the Preliminary Improvement Resolution for the improvement of TUXEDO DRIVE, from the north line of Washington Avenue to the south line of McKinley Avenue by constructing a Class "C" Pavement, under 'Improvement Resolution No. 2758 AND LAWTON STREET FROM THE 111EST LINE OF OLIVE STREET TO THE EAST LINE OF WASHINGTON i1 STREET, by constructing a Class "C" Pavement, under Resolution No. 2759, AND • MISHAWAKA AVENUE ( NORTH SIDE) FROM THE EAST LINE OF E RRSON AVENUE TO THE WEST j LINE OF TVTYCIENHA1 DRIVE by constructing a Class "C" - Type %a Pavement, under i Resolution No. 2760. The Board approved the reports and passed Improvement Resolution, authorizing j these public improvements, and the 21st day of July 1953, at the hour of 6:30 P.M.
