A regular meeting of the Board of Public Works was held Monday, June 225 1953, at 10:00 A. M.
Mr. G. P. Ziegler was absent. Minutes of the previous meeting were read and approved. Salary claims,
in the amount of $$27,879.88, were approved. Claims of the following suppliers, in the amount of $$396.75,
were approved and_ ordered paid:

The Board first examined a petition, dated June 19th, signed by residents of the 700 and 800 blocks
north St. Peter Street, requesting the paving of the street between South Bend Avenue and Corby, and
indicating, in the main, a preference for "black -top". The petition was referred to the City Engineer
for investigation and recommendation.
Then appeared before the Board, Messrs. P. D. Pointer, Howard D. Rerick and Elias W. Strickland,
residents of the 3200 and 3300 blocks, South Michigan Street, asking that the Board again institute an
anti -noise campaign against inadequate mufflers on trucks using this street. Excessive speed of trucks
operated by Bolin Drive -Away Company and Geo. F. Burnett Company, Inc., was also reported by these
gentlemen. Mx. Pointer reported these heavy trucks, upon hitting the slight depressions in Michigan
Street in the 3300 and 3400 blocks, cause sufficient jar to the surrounding area to affect thermostats
in homes in these blocks to the extent of setting home -heating plants into operation.
The Board informed the group that immediate steps would be taken to remedy the conditions complained
of, and investigation and recommended action would be obtained through the Traffic Engineer's office
within the current week.
Councilman Wm. A. Hann next appeared before the Board, calling attention to the availability of
vacant lots at the southeast corner of Cedar Street and St. Louis Boulevard for playground use. It was
f pointed out that removal of brush, grading and possibly other improvement would be necessary to make
the area suitable for this use. The Board directed the -Clerk to bring this to the attention of Street
Commissioner H. M. Tomlinson for his investigation of the premises and report.
ENTRY OF PETITION PRESENTED
The Board of Public Works and Safety hereby receives and places on file the Petition of Ralph W.
Cripe and eight others for the improvement on MISHAWAYk AVENUE (NORTH SIDE) from the east line of
Emerson,Avenue to the west line of Twyckenham Drive.
The above petition was examined by the Board and referred to the City Engineer for recommendation.
The City Engineer being present, made the recommendation that the petition be granted. The Board then
directed that the firm of Wilbur H. Gartner & Associates prepare general details, drawings, specifications.
and preliminary improvement resolution for the pavement improvement to be constructed and the firm was
so notified June 22, 1953.
TRAFFIC DEPARTMENT:
Councilman Wm. A. Hahn and Traffic Engineer E. H. Miller then appeared before the Board with the
request that Center Street, from Michigan Street to I -tills Street, be made a one-way street. Considerable
discussion was given the matter, in which Chief of Police Richard J. Gillen took part and convinced
the Board that the most benefit to be derived from the standpoint of relief from stalling of traffic
on Michigan Street would be the east -bound movement of one-way traffic on Center Street, and the Board
so ordered.
A report to the Board of an overcharge made by a licensed parking lot at 115 South William Street,
submitted by Leon C. Maenhout, 312 Lafayette Building, was read by the Board and referred to the Chief
of Police for investigation and report.

VACATION RESOLUTION NO. 2754 - 1953
This being the date set, hearing was held on the assessment roll showing the award of damages and
the assessment of benefits in the matter of vacation of STREET ARID UTILITY EASEMENTS IN THE RECORDED
PLAT OF BELLEVILIE UNIT "D", AN ADDITION TO THE CITY OF SOUTH BEND, INDIANA, EXCEPTING SUCH PORTIONS
OF SAMPLE STREET AND MAYFLOWER ROAD AS MAY LIE WITHIN THE BOUNDARIES OF SAID FIAT under Vacation
Resolution No. 2754.
In the above named assessment roll, no remonstrators appeared and no written remonstrances were
filed, the Clerk of the Board submitted proofs of publication of notices and same were found sufficient,
land the Board, therefore, finds that the several lots and parcels of land have been benefited and
;damaged in the amounts shown on said roll. The Board, therefore, decided to take final action on said
lassessment roll and declares same in all things ratified, confirmed and approved without modification and
'the proceedings closed, and the streets and utility easements vacated upon receipt of the amount of
'benefit assessments from the various property owners so benefited and all proceedings had with reference
Ito said streets and easements vacation are hereby sustained.
i GRAVEL BID FOR TIE STREET DEPARTMENT
The Bid. of C. D. Smelser, being the only bid received for the supplying of 5000 cubic yards of
y4ushed gravel for use of the Street Department, and the Board noting that this gravel is readily
available and at a satisfactory price, accepted and signed the contract, as submitted.

Wilbur IL Gartner, Civil Engineer, being present, reported to the Board., the condition of sewer the �
in that section of Kemble Street where basements have.been flooded and sewer repair is now under way
by the Niles Excavating Company, in accordance with authorization given by the Board in regular meeting
of June 15th. Engineer Gartner stated that every section of pipe taken up thus far in their operations
has been found to be cracked. He also reported an extensive hollow area under pavement was discovered
at one point. The work having proceeded past the four homes affected, and the basement flooding having !!
subsided, the Board directed that further operations by Niles Excavating Company cease at this point,
and further directed Street Commissioner H. M. Tomlinson to have the Sewer Department, drag this sewer �

The City Engineer being present, made the recommendation that the petition be granted. The Board then
directed that the firm of Wilbur H. Gartner & Associates prepare general details, drawings, specifications,il
and preliminary improvement resolutions for the two pavement Lmprovements to be constructed and the firm
was so notified June 22, 1953. j
Mr. Wilbur H. Gartner next appeared before the Board and reported that nothing has been done on the
part of Tri-State Excavators to complete the work undertaken by them, in accordance with contract awarded

them, in the 1800 block north Huey Street. In view of the accident which occurred owing to the con-

tractor's negligence, involving personal injury, and. the contractor's continued neglect, the Board
directed the Street Commissioner to continue the use of warning lights at night, and directed the clerk
to notify Tki-State Excavatorq to have -the half -block, which at this time remains in dangerous condition,

placed in safe and satisfactory condition for traffic by 4:30 P. M. Wednesday, June 21,,th, otherwise, the
Street Department will proceed with the work of restoring the street to proper condition, all costs to
be charged against Tri-State Excavators. The Board further directed that letter, so notifying this

contractor, is to be presented to them by a police officer.
Maintenance Bond, in the sum of $1965.08. binding Reed Construction Compan-y as principal, and

Indemnity Insurance Company of North America; as surety, pertaining to the maintenance of specifically
described pavement on Miami. Street, was examined and approved by the Board.
Maintenance Bond in the sum of 89,330.50, binding Reed Construction Co., as principal, and Indemnity
Insurance Company, of North America, as surety, pertaining to the maintaining of specifically described
pavement on Byron Drive, was examined and approved by the Board.

Then appeared before the Board-, Mr. 011ie B. Love, complaining of condition of street in the 100
block south Iowa Street. The Board explained in considerable detail that until some paving contractor
is willing to submit a proposal and satisfactory bond for the paving of Iowa Street or any portion of
the Street, the City cannot proceed with any improvement, other than a dust -laying and bonding coat
.of bituminous oil, in which event, it is first required that the home-oomer residents raise a sufficient
,fund to meet the cost of the required quantity of bituminous material. It was pointed out to Mr, Love
that currently there are but two contractors, bidding on paving improvements for the City, and to the
best knowledge of the Board, neither of these firms would offer a bid, were the City to advertise for
the, asphalt or concrete paving of Iowa Street. City Attorney, I. A. Hun -rich, explained the entire !1
procedure for the financing of street improvements for T,tr. Love's complete understanding of the
situation currently presented.
There being no further business to come before the Board, the meeting adjourned at 11:30 A. M. �
