Contractorts Bonds, each in.the sum_of-$11,000.00, binding Leonard F. Pry and Charles
E. Stafford d/b/a South Bend Building Construction Company, were examined and approved
by the Board.
An occupancy bond in the sum of $5,000.00, binding upon the Trisco Waterproofing
Company, and bearing the approval of the City Controller, was examined and ordered
filed.
• There being no further business to come before the Board, the meeting adjourned
at 11:30 A. M.

The first matter taken up by the Board was the petition filed by the Studebaker
Corporation for vacating street and alley described as follows:
Beginning at a point which is the northeast corner of Lot 87
as shown on the recorded Plat of South Bend City as platted by
Samuel Morrison, now a part of the City of South Bend, located

in the northeast quarter (1) of the northeast quarter (1) of
Section 14, Township 37 north, Range 2 east; thence due west a
distance of 107.50 ft.; thence due south a distance of 264.00
ft. thence due east a distance of 107.50 ft.; thence due south
a distance of 14.00 ft.; thence due west a distance of 107.50 ft.;
thence due south a distance of 17.67 ft-; thence due west a distance
of 14.00 ft.; thence due north a distance of 362.37.; thence due
east a distance of 20.00 ft.; thence due north a distance of 10.10 ft.
thence due east a distance of 101.50 ft.; and, thence due south a
distance of 62.80 ft. to the point of beginning.
Petition and accompanying drawings were examined by the Board and the matter was
then referred to the City Plan Commission for their consideration and report.
VACATION RESOLUTION NO. 2740 - 1952
R. S. Andrysiak, City Engineer, filed primary assessment roll showing the awards ,
of damages and the assessments of benefits in the matter of the vacation of THE WEST
30 FEET OF ERNSBERGER STREET FROM THE ST. JOSEPH RIVER SOUTH TO A POINT WHERE SUCH
FORMER STREET INTERSECTS IRONWOOD DRIVE, UNDER Vacation Resolution No. 2740.
In the above named assessment roll, the. Board hereby orders that it will -meet in •
the City Hall at 11:00 A. M. on the 29th day of December 1952 for the purpose of
hearing and receiving remonstrances from all persons interested in or affected by said
vacation, and the Board further orders that notice of said hearing, together with the
amount of damages awarded and benefits assessed be addressed to the property owners by
publishing same on'the 5th day of December, on the 12th day of December and on the 19th
day of December 1952, in the South Bend Tribune and the Tri-County News.
A request for increased fares on the part of Northern Indiana Transit, Inc., under
date of November 29th was next examined by the Board, ordered placed on file, and the
matter taken under advisement.
STREET DEPARTMENT: 1j .
Street Commissioner, Harry M. Tomlinson, being,present, first brought to the atten-
tion of the Board, the condition of Fellows Street in the 3200 and 3300 blocks due to
settling of clay fill-in job of sewer contractor. It was the consensus of opinion
that.two loads of gravel would suffice to temporarily remedy the condition and make
the street passable until spring, when the contractor will be able to make satisfactory
repair of the street.
The reported two large mud -holes in first alley south of Lincolnway West and west
of Elliott Street were next considered. The Commissioner stated this alley is to be
given his department's immediate attention.
TRAFFIC DEPARTMENT:
Considerable discussion took place concerning a complaint registered by the S. S.
Kresge Company, against the maintaining of the news -'stand at the corner of Michigan and
Jefferson, which was referred to as "an eye -sore". The fact that it provides a,living
for the 78-year old vendor was given.,consideration. It was also pointed out that two
more stands are to be constructed of the improved,type, and will be available soon,
and it was decided to hold the matter of the removal of the Michigan and Jefferson
news-stand in abeyance until the two new stands are installed. It was believed that
S. S. Kresge Company may be persuaded td withdraw their removal request, by the im-
proved appearance of these -new news -vending stations.

. The Board met at -the regular time. All members were present. Due to matters of
exceeding importance, demanding the presence of Messrs. Ziegler and Andrysiak, on
motion made by Mr. Ziegler and duly sustained, the meeting was ordered deferred until
10:00 A. M. Wednesday, December 10, 1952 and all matters to come before the Board at
this meeting are to be acted upon in the deferred meeting.
The meeting was, thereupon, adjourned.
