In the above named assessment roll, the Board hereby orders that it will meet in
the City Hall at 11:00 A. M. on the -3rd. day of Nouembe-r3,1952 for the purpose of
hearing and receiving remonstrances from all persons interested in or affected by said
vacation, and the Board further orders that notice of said hearing, together with the
amount of damages awarded and benefits assessed be addressed to the property owners by
publishing same on the loth day of October and on the 17th day of October, 1952,/in
the South Bend Tribune and the Tri-County News. and 24th day of October, 1952.
Contractorts Bond in the amount of $1,000.00, of W. H. Sharp, Jr. was examined
and approved by -the Board.
There being no further business to come before the Board, the meeting adjourned
at 12s00 o'clock noon.

• i A special meeting of the Board of Public Works was held Tuesday, October 14, 1952
at 2:00 P. :M, to take required action on certain matters advertised for hearing on
October 13th, which was a legal holiday and no regular meeting was held. All members
were present.
RESOLUTION ADOPTING FINAL ASSESSMENT ROLL NO. 2719 - 1952
After hearing all persons interested who appeared and the Clerk of the Board of
Public Works and Safety having proofs of publication of the notices to property owners
and the same having been found sufficient, therefore
BE IT RESOLVED, By the Board of Public Works and Safety of the City of South Bend,
. Indiana,.that the -Primary of Preliminary Assessment Roll adopted by the Board on the
22nd day of September, 1952, for the improvement of ALLEY BETWEEN ADAMS STREET AND
11 COLLEGE STREET be and the same is in all things confirmed.

• 1+ CERTIFICATION OF COMPLETION - IMPROVEMENT RESOLUTION NO. 2720 - 1952
Certification of Completion was furnished by the civil engineer, Wilbur H. Gartner,
accompanied by Contractorts Completion Affidavit of the contract between the City
of South Bend, Indiana, Owner, and the Rieth-Riley Construction Company, Contractor.,
for the construction of the Pavement Improvement on ELWOOD AVENUE from the west line
of OtBrien Street to the east line of Elmer Street under Improvement Resolution No. 2720
has been completed in accordance with the plans and specifications for this project.
RESOLUTION ACCEPTING FINAL ESTIMATE No. 2720 - 1952
• Be it Resolved, By the Board of Public Works and Safety of the City of South Bend,
Indiana, that the Final Estimate, and Primary Assessment Roll submitted to the Board
by the City Civil Engineer or his duly authorized representative on this 14th day of
October, 1952 on the improvement known as the ELWOOD AVENUE PAVEMENT as described in
Improvement Resolution No. 2720, 1952, passed by the Board of Public Works and Safety
on June 16th, 1952, be and the same is hereby adopted, and the Clerk of this Board is
hereby requested to give notice of the hearing of Special Benefits on said Improvement,
as required by Section N.111 or 120 of an Act entitled, "An Act Concerning Municipal
Corporations" approved March 6, 1905.

PLANS REPORTED
Wilbur H. Gartner and Associates, Civil Engineers, reported to the Board, Profiles,
Drawings, Plans, General Details, Specifications, Estimates and Preliminary Improvement
Resolution for the improvement of TUXEDO DRIVE from the center line of Washington
Avenue to a point 190 feet south of the center line of McKinley Avenue by constructing
a local sewer.
The Board approved the reports and passed Improvement Resolution, authorizing this
public improvement, and the 3rd day of November, 1952 at the hour of 10:00 A. M. is
hereby fixed as the time, and the office of the Board in said city as the place when
and where all persons whose property may be affected by such proposed improvement,
may be heard as to the necessity for the same, and all petitions and remonstrances
received and the Board will, on said day, decide whether the benefits accruing to
abutting and adjacent property, and to the City of South Bend, Indiana, will be equal
to or exceed the estimated cost of said improvement. The Clerk of the Board is hereby
ordered to give notice by two weekly publications, of the time and place of hearing of
Resolution No. 2738, adopted October 14, 1952 and to be published on October 17th and
October 24, 1952.

RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, INDIANA: •
That it is desirable to vacate the following..

THE ALLEY RUNNING NORTH AND SOUTH FROM
MISHAWAKA AVENUE TO THE GRAND TRUNK WESTERN
RAILROAD RIGHT OF WAY SITUATED BETWEEN LOTS
NUMBERED 713 and 714 WHITCOMB AND KELLER'S
THIRD SUNNYMEDE ADDITION TO SOUTH BEND.
The following property may be injuriously or beneficially affected by such
vacation: •
Lots Numbered 713, 714 and 715, in Sunnymede
Third Addition to the City of South Bend,
Indiana.
Notice of this resolution shall be published on the loth day of October and on the
17th day of October, 1952 in the South Bend Tribune and Tri-County News.
This Board, at its office in the City Hall on the 27th day of October, 1952 at
11:00 A. M. will hear and receive remonstrances from all persons interested in or
affected by these proceedings.
