Rausch, 2111 Miami Street, appeared before the Board and protested • against the preliminary assessment roll adopted by the Board September 8, 1952 for the improvement of the alleys between Donald Street, Fox Street, Dale Avenue and Miami Street, claiming water stands in the alley following a rain, and in his opinion "the alley is worse than before it was paved", and "it wasnft laid properly." The City Engineer replied that in his opinion, "it was laid properly" and proceeded to explain the engineering problem which was involved. Dr. Rausch then made complaint concerning the bank building and banking business presenting considerable inconvenience to neighboring residents. The City Engineer explained this was due to a mistake in city planning occurring many years past. Mrs. R. F. Rausch, 1030 E. Donald Street, com- plained of broken sidewalk, caused by the paving contractorts operations, and that entrance to the alley is "unfinished". Mrs. James W. Batig, 1021 Fox'Street, offered • similar complaint. ivirs. Sylvia Weber, 1018 E. Donald Street, complained that a depression in the alley back of her garage causes water to stand there for a long perio after every rain. Mrs. Maude Worley, 1024 E. Donald Street, offered the complaint that the pavement of the alley at the Donald Street entry "is lower than the approach", and is, accordingly, unsatisfactory. John & Blanche Janowiak, 1001 Fox Street, asked that the City Engineering Department "see what they can do to correct the unsatisfactory features of this paving job." 171 • The Board thanked the group for having offered their comments. Wilbur H. Gartner, of Wilbur H. Gartner & Associates, Civil Engineer, being present, assume the Board that the alleys in question represented a first class paving improvement and the best engineering possible in view of the topography of the location. RESOLUTION ADOPTING FINAL ASSESSMENT ROLL RESOLUTION NO. 2703 - 1952 After hearing all persons interested who appeared and the clerk of the Board of Public Works and Safety having proofs of publication of the notices to property owners and the same having been found sufficient, therefore BE IT RESOLVED, By the Board of Public Works and Safety of the City of South Bend, Indiana, that the Primary of Preliminary Assessment Roll adopted by the Board on the 8th day of September, 1952, for the improvement of ALLEYS BETWEEN DONALD STREET, FOX STREET, DALE AVENUE AND MIAMI STREET be and the same is in all things confirmed. Crothers, Clerk The Board next took up the matter of the resurfacing of Hydraulic Avenue and were in agreement to call for bids for the performance of this improvement in accordance with specifications under consideration by the Board. The Clerk was directed to proceed with the required legal advertising. Copy of a letter sent Haines & Haines contractors for the Gertrude Street local sewer, notifying this firm, under date of September 26, 1952 that penalty will be invoked if construction is delayed any longer, was read by the Board and placed on file. A letter, under date of September 22, 1952, from Consoer-Townsend & Associates RE: Contract 2-B, Thos. D. Nolan, Contractor, requesting a change in alignment for a portion of the remaining 670 feet (approximately) of 48" sewer on Niles Avenue to be completed, was read and considered by the Board. The Board approved this re -location, which will effect a definite saving thru the elimination of two manholes, and directed the Clerk to so notify Consoer-Townsend & Associates. STREET DEPARTMENT: H. M. Tomlinson, Street Commissioner, being present, reported that diligent search involving considerable digging by the Sewer Department at the location in the 1900 block South Chapin Street failed to discover the house tap indicated on Engineering Departmentts map of this area. Report was accepted by the Board for deferred consider ation. The Street Departmentts need for a self -feeding material spreader was brought to the Boards attention. The Board directed the Clerk to proceed to obtain quotations on this piece of equipment from three manufacturers of this type of machinery. Specifications for the material and installation required for the extension of the Street Department Office heating system to supply heat to the old office building now used by Thos. D. Nolan, Contractor, were examined and the Clerk was directed to adverti for bids in accordance with these specifications. Mr. Tomlinson also mentioned Street Departmentts need for processed gravel and asked that the Board advertise for bids in the quantity of 5,000 cu. yards, and/or 5,000 tons. The Board approved and directed the Clerk to proceed to advertise acco Representatives of the Studebaker Corporation next appeared before the Board in the matter of complaint made in the regular meeting of September 8, 1952 by Mr. John Zrinyi; and stated that the equipment used by them, namely, the Schneible Wet Dust Collector, is the best of its type and is the same equipment used for this purpose at the Buick, Chevrolet and Pontiac plants in Michigan. They further pointed out that the remounting of these collectors on concrete foundations at ground level has practically eliminated any noise of operation, and since repeated efficiency tests show these four dust collectors as being 99.8% efficient, the possibility of offensive dust from this source is practically nil. It was also pointed out that this is a heavy industrial section involving coal yards, railroad switching activities and heavy truck traffic, which could be the source of the excessive dust condition complaint. Mr. Andrysiak then announced that all bids were being taken under advisement and contracts will be awarded one week from this date. Pulaski Post No. 357, American Legion, having requested yellow traffic lines painted at the entrance from Chapin Street to the Postts parking lot, the matter receive the consideration of the Board and was referred to the -Traffic Engineer for his in- vestigation and report. The time now being 12:15 M, the Board recessed, and resumed its deliberations at 1: 45 P . M . The next matter taken up by the Board was that of final payment on Contract 4-A, Barna Massa Construction Company, Contractors. Robert D. OtNeal, Secretary and Treasurer of the Barna Massa Construction Company, was present, together with Ralph Moorhouse, Resident Engineer of Consoer,Townsend & Associates. The file of the Board of Public Works containing all statements filed with the Board, as charges against Barna Massa Construction Company, was examined in detail and tentative settlement was arranged for all legitimate claims on file. Contractors Bonds, each in the sum of $1,000.00, for Floyd A. Barrier and Harold A. Heltzel were examined and approved. Excavation Bond in the sum of $1,000.00, for Henry DeWulf of Mishawaka, Indiana, was examined and approved.
