A regular meeting of the Board of Public Works was held Monday, May 12, 1952
10:00 A. M. All members were present Minutes of the previous meeting were read
approved. Claims of the following suppliers, in the total amount of $31,467.7.2,

A delegation of residents and property -owners in the general neighborhood of
the 1500 block Swygart Street appeared before the Board relative to their petition
dated April 29, 1952, protesting against truck parking and truck terminal construction
in this area. Mr. Hurwich advised the delegation their petition had been considered
at the previous meeting and referred to the Traffic Engineer for his investigation
and report. Traffic Engineer, E. H. Miller, being present, then presented his report.
It was first pointed out that the Board cannot prevent the building of a truck terminal
in an area zoned for that purpose. Mr. Miller also stressed the point that inter -city
trucks using Swygart Street were doing so contrary to the orders of the trucking
compsnyts.manageraent and stated this was the information given him by Edward J. Sutton,
Manager of Roadway Express, Inc.
Mr. Hurwich, at this point, stated that the Police Department would be instructed
to give special attention to the area with a view to discovering and warning the
truck drivers using Swygart Street contrary to South Bend truck traffic regulations.
Mr. Ziegler suggested the posting of signs against the use of -street for heavy truck-
ing at the proper locations on Szaaygart Street. Michael Karan, 2021 S. Michigan Street
a property owner in the Swygart Street area, called attention to inter -city trucks
using Nash Street, and that the paving of this residential Street will not stand this
heavy trucking. Mrs. Louis Horvath, 1417 W. Indiana Avenue called the attention of
the Board to the poor construction of the terminal buildings, claiming these tar -paper
covered buildings were a positive fire hazard.

Mr. Hurwich then called upon members of the trucking firms present for their views
in the matter. Mr. Forrest -Crowell, President of the Northern Indiana Chapter, Indiana
Motor Truck Association, stated that the trucking management represented by the
Association would comply and cooperate with the Board of Public Works in every way.
The question was raised by the delegation as to when: this area had: been rezoned
as industrial, and being informed by the Board that the rezoning had taken place in
1932 expressed considerable surprise.
The Board also explained the authorized routing of inter -city trucks and that the
requirement of these trucks are to use only those streets providing the most direct
access to -the designated truck routes.
iA member of the delegation brought up an irrelevant matter of smoke -and explosions
from the Walnut Street junk yard, claiming the dense and acrid smoke from the burning
of automobile tires presents a health hazard. 1v1r. Hurwich suggested their recourse in
this matter would be to petition the Board of Health.
Mr. Hurwich next called for the Traffic Committee of Bendix Local No. 9 to
present the problem on which they had asked a hearing at this meeting of the Board.
Mr. Arthur E. Bouchard and Mr. Charles A. VanDeViere appeared before the Board and
called attention to the needed improvement of a section of unpaved street on Bendix
Drive adjacent to the property of the South Bend Sand and Gravel Company, and the
heavy traffic over this road by Bendix employees going and coming from the Bendix
Plant daily. It was pointed out -that this cut-off relieves the city streets of a
considerable amount of traffic and congestion at certain periods of the day. Mr.
Hurwich, speaking for the Board, conceded the need for the improvement and stated that
the improvement had been under consideration. Mr. Andrysiak estimated the probable
,) cost at 65,000.00. H. M. Tomlinson, Street Commissioner, being present, some further
j discussion and consultation took place and the Board announced their approval of the
proposed improvement and stated that an effort would be made to include it in the
current street improvement program and the construction of this particular improvement
will be expedited.
The matter of a petition for the temporary closing of alley south of Western
Avenue, between Pulaski and Koscuiszko,Streets was next taken up and on the basis of
the written report of•the Traffic Engineer, under date of April 22nd, the Board denied
this petition.
Change Order No.2 for Contract N6.8, South Bend Sewers, from Consoer,Townsend &
Associates, -.under date of May 8, 1952, was examined by the Board and approved.
The deleting of Item No. 11 in regard to the re -paving on Hydraulic Avenue under
Contract No. 8 South Bend Sewers, as recommended by Consoer, Townsend & Associates,
in their letter of May 8, 1952, was next considered and approved.
Final inspection having been made and no deficiencies found, the recommendation
of Consoer, Townsend & Associates for the acceptance of work performed by Mancini &
Ventrella, Contract No.8, South Bend Sewers, was approved and accepted. -
STREET DEPARTMENT:
This being the time set for the opening of bids, Ray S. Andrysiak, Chairman of
the Board, proceeded to open the two bids received for the supplying of the Street
Department with a chips and fine aggregate spreader, as follows:

literature to him for a comparative of the two machines offered.Upon the expressed
"i preference and recommendation of Per. Tomlinson, the Board accepted the bid of the
I Indiana Equipment Co., Inc., and the Clerk was directed to issue the purchase order
for bhis equipment, including an extra truck hitch..

Mr. Wilbur H. Gartner of Wilbur H. Gartner & Associates, Civil Engineers, reported
to the Board Profiles, Drawings, Plans, General Details, Specifications, Estimates
and Preliminary Improvement"Resolution for the improvement -of VASSAR AVENUE FROM the
East line of Olive Street to the West line of Elmer Street, AND
NAPOLEON BOULEVARD from the East line of Harter Heights Second Addition to the
West line of Notre Dame Avenue AND
FELLOWS STREET from the South line of Ewing Street to the North line of Altgeld
Street AND

The Board approved the reports and passed Improvement Resolutions, authorizing
these public improvements, and the 4th day of June, 1952 at the hour of 6:30 P.M.
CST is hereby fixed as the time, and the office of the -Board in said City as the
place, when and where all persons whose property may be affected by such proposed
improvement, may be heard as to the necessity for the same, and all petitions and
remonstrances received and the Board will, on said day, decide whether the benefits
accruing to abutting and adjacent property, and to the CityofSouth Bend, Indiana
will be equal to or exceed the estimated cost of said improvement. 'he' Clerk of the
Board is hereby ordered to give notice by two weekly publications, of the time and
place of hearing of the following resolutions:
IMPROVEMENT RESOLUTIONS NO. 2677, 2714, 2716, 2717 and 2719, adopted this 12th
day of May, 1952 and to be published on May 16, and May 23, 1952.
Mr. Harold Reinke appeared before the B oard and called attention to construction
he will soon have under way on Western Avenue between Maple and McPherson Streets.
This is to be a building for the Army and Navy Union, which Mr. Reinke states will be
thirty feet back from the present property line. Mr. Reinke mentioned that permit to
occupy alley while work proceeds will be needed.
�A letter from H. L. Kimble, Division Superintendent, Pennsylvania Railroad, under
date of I,Zay 9, 1952, pertaining to the planned deiselization of yard locomotives
for their South Bend yards was read by the Board and ordered filed.
Contractor's Bonds in the amount of $1,000.00 each were examined and approved by
the Board for the following:

j An Excavation Bond in the amount of $1,000,00 for Earl C. DeVan was examined and
approved by the Board.

There being no further business to come before the Board, the meeting was
