Minutes of the previous meeting were read and approved. Payrolls totaling V143.23 were approved. Bath Agency 18.78 7-?7 SEWAGE DISPOSAL: 7.99 Consoer Townsend & Associates 413.79 21.59 SEWER DEPARTMENT: 6.59 Belleville Lumber & Supply Co- 49.28 $4.80 83.64 11.64 A Mr. Scott, representing Kroger Super Marketss appeared before theBoardrequest- ing privilege of advertising an Anniversary Sale by signs placed on an obsolete model automobile to be driven throughout the City Mr. Hurwich cited the prohibitive Ordinance -denying -the use of vehicles on the streets for the principal purpose of ad- I vertising, and request was accordingly withdrawn. Next appearing before the Board was Mr. Valentine Brzezinski presenting a petition from business men and other property owners of the blocks concerned, demanding the. closing -of Western Avenue from Kosciusko Street to Olive Street night and day while street construction operations are underway, because of the excessive dust condition caused by heavy and speeding traffic. Considerable discussion was given the matter. Mr,. Ted Doba, who was present, called attention to the fact that several of the ., signers of the petition, had previously signed a petition requesting that the street be kept open. He agreed, however, that the dust condtion is such as to have brought about the changed position in the matter by these signers. The.Board stated the matter would be placed in the hands of the Traffic Engineer for immediate action. A complaint registered with the Board concerning intolerable condition of the sidewalk in the 600 block on Portage Avenue next received the Boardts attention, and the Clerk was directed to notify all property owners in the block to have their sidewalks restored to satisfactory condition at an early date. A petition, bearing one -hundred -fifty-three signers objecting to the excessive smoke in the area near the Pennsylvania Railroad yards and the Sibley Foundry, was next taken up by the Board. The Clerk was directed to write both the Pennsylvania Railroad Company and the Sibley Foundry & Machine Co., asking them to put into effect immediately such improvements or changes in operation it may be possible to effect that will tend to abate this nuisance. 422 ENGINEERING DEPARTMENT This being the time set in our legal advertisement pertaining to bids for the re -surfacing of Sample Street from the east line of Lincolnway East to the south line of Mishawaka Avenue, including the deck of the Sample Street -Bridge, the Board pro- ceeded with this matter, bids being as follows: Rieth-Riley Construction Co. Both parties 11 • were given ample opportunity to present their case, and it having developed that the �� river bank at this point may not be an actual part of Columbia Street extended, the Ij Board withheld decision in the matter for a period of two weeks, and hearing of the al above resolution is continued to May 5, 1952 at 10:00 A. Gohr, d/b/a Niles Excavating Company was examined and approved by the Board. • 0 • • • Vacation Resolution No. 2697 This being the date set, hearing was held on the assessment roll showing the award of damages and the assessment of benefits in the mater of vacation of West Colfax Avenue from Brookfield Street to Johnson Street under Vacation Resolution No. 2697. In the above named assessment roll, no remonstrators appears and no written remonstrances were filed, the Clerk of the Board submitted proofs of publication of notices and same were found sufficient, and the Board, therefore, finds that the several lots and parcels of land have been benefited and damaged in the amounts shown on said roll. The Board, therefore, decided to take final action on said assessment boll and declares same in all things ratified, confirmed and approved without modification and the proceedings closed, and the street vacated upon receipt of the amount of benefit assessments from the various property owners so benefited and all proceedings had with reference to said street vacation are hereby sustained. Vacation Resolution No.2698 This being the date set, hearing was held on the assessment roll showing the award of damages and the assessment of benefits in the matter of vacation of the Alley East of St. Peter Street from the South Line of the first Alley South of Wayne Street to the North Line of the Grand Trunk Railroad right-of-ways, under Vacation Resolution No. 2698. In the above named assessment roll, no remonstrators appeared and no written remonstrances were filed, the Clerk of the Board submitted proofs of publication of notices and same were found sufficient, and the Board, therefore, finds that the lots and parcels of land have been benefited and damaged in the amounts shown on said roll. The Board, therefore, decided to take final action on said assessment roll and declares same in all things ratified, confirmed and approved without modification and the proceedings closed, and the alley vacated upon receipt of the amount of benefit assessments from the various property owners so benefited and all proceedings had with reference to said alley vacation are hereby sustained. Vacation Resolution No. 2699 This being the date set, hearing was held on the assessment roll showing the award of damages and the assessment of benefits in the matter of vacation of West Victoria Street from Hichigan Street West to the_East line of the North and South Alley, excepting the 20 feet in the center which is to be reserved for an alley under vacation resolution No. 2699. In the above named assessment roll, no remonstrators appeared and no written remonstrances were filed, the Clerk of the Board submitted proofs of publication of notices and same werefound sufficient, and the Board, therefore, finds that the several lots and parcels of land have been benefited and damaged in the amounts shown on said roll. The Board, therefore, decided to take final action on said assessment roll and declares same in all things ratified, confirmed and approved without modification and the proceedings closed, and the street vacated upon receipt of the amount of benefit assessments from the various property owners so benefited and all proceedings had with reference to said street vacation are hereby sustained. The Board, therefore, decided to take final action on said assessment roll and declares same in all things ratified, confirmed and approved without modifi- cation and the proceedings closed, and the alleys and streets vacated upon receipt of the amount of benefit assessments from the various property owners so benefited and all proceedings had with reference to said alleys and streets vacation are hereby sustained. There being no further business to come before the Board the meeting adjourned at 12:00 Noon. ATTEST: Clerk SPECIAL MEETING April 23, 1952 A special meeting of the Board of Public Works was held in accordance with legal advertising Wednesday evening, April 23, 1952 for the purpose of a hearing in connection with the following Improvement Resolutions: No. 2702 - Improvement of Illinois Street by Class "C" Pavement from the north line of Western Avenue to -the South line of Washington St. No. 2703 - Improvement of Alleys between Fox Street, Donald Street, Dale Avenue, and Miami Street by Class t'C" Pavement. No. 2709 - Improvement of Klinger Street by Class "C" Pavement from the East line of Michigan Street to West line of Charles Street. No. 2712 - Improvement of Alley between Brookfield and Johnson Streets by Class "C" Pavement from the North line of Vassar Avenue to South line of Humboldt Street. No. 2715 - Improvement of Kenmore Street by Class "C" Pavement from South line of Western Avenue to North line of Ford Street. Member of the Board, Granville P. Ziegler was absent. The meeting was called to order by Ray S. Andrysiak, chairman of the Board, at 7:30 P. M. Mr. Andrysiak first acquainted the large group of citizens present with the purpose of the meeting, and then explained the fundamentals of the Barrett Law and the various steps in Barrett Law procedure from the petition of the property owners to final completion and acceptance of the improvement from the contractor concerned. • • • •
