March 24, 1952
A regular meeting of the Board of Public Works was held Monday, March 24, 1952 at
10:00 A. M. All members were present. Minutes of the previous meeting were read and
approved. Salary claims in the amount of $18,711.10 were approved and ordered paid.
Claims of the following suppliers in the total amount of 062797.78 were approved and
ordered paid.

A petition for the cleaning of the sewer on North Meade Street from Western
Avenue to the New York Central Railroad tracks was read by the Board and referred to
Street Commissioner Tomlinson for early attention.
The Board next considered the transfer of funds, allotted to tree -trimming in the
• I budget, for the City Cemetery, to the fund set up for Repairs of Buildings and
Structures. The Board decided to present this transfer to the Common Council, when
and as soon as another transfer is requested, thereby reducing required advertising
costs. Additional funds are needed for repair of the iron fence surrounding the
Cemetery.
A resolution adopted by the River Park Business Ments Association was read by the
Board and referred to the Board of Water Commissioners for further consideration and
study.
The Board next examined drawings of the proposed new Colip Brothers, Building
at 114 W. Wayne Street, involving construction of basement under the walk in front
of this location. The Board approved the construction, subject to waiver by the
owner of the property to any claim for damages in the event of the widening,.of Wayne
Street at that location at any future date.
Attorney Russell C. Kuehl appeared before the Board on behalf of the Dependable
Disposal Co., and presented a new corrected contract in line with the suggestion
of the Board, following the hearing on this matter February 18, 1952.
The new contract contains one important stipulation, not appearing in the
previous contract, to -wit: The City shall have the option of terminating all contracts
with the contractor upon the giving of a six monthts notice in writing. The Board
approved the contract and it was delivered to the City Clerk, in person, for
presentation to the Common Council.
ENTRY OF PETITIONS PRESENTED
The Board of Public Works and Safety hereby receives and places on file the
Petition of ELMER H. DURHAM and twenty-eight others for thePAVE'MENT IMPROVEMENT on
KENMORE STREET from the sou'h line of Western Avenue to the north line of FORD STREET
AND
Petition of JAMES W. BATIG and fourteen others for the PAVEMENT IMPROVEMENT on
ALLEYS BETWEEN FOX STREET, DONALD STREET, DALE AVENUE AND MIAMI STREET, AND

Petition of KERMIT D. FISH and thirty-six others for the PAVEMENT IMPROVEMENT on SOUTH
ILLINOIS STREET from the north line of WESTERN AVENUE to the south line of WASHINGTON
S TREE T AND
Petition of WHITCOMB & KELLER INC. for the PAVEMENT IMPROVEMENT on KLINGER STREET
from the east line of MICHIGAN STREET to the west lineofCHARLES STREET and
Petition of GEORGE DEVIEW and sixteen others for the PAVEMENT IMPROVEMENT on ALLEY
BETWEEN BROOKFIELD STREET AND JOHNSON STREET from the north line of VASSAR AVENUE to
the south line of HUMBOLDT STREET.-

,The above five petitions were examined by the Board and referred to the City
Engineer for recommendation. The City,Engineer being present., made the recommendation
that the petition in each instance, be granted. The Board then directed that the
firm of Wilbur,H. Gartner & Associates prepare general details, drawings, specificationst
and,preliminary improvement resplution for the five,pavement improvements to be con-
structed and the firm was so notified March 24, 1952.
GHTS & MEASURES DEPARTMENT:
A letter from the Director of the Weights and Measures, Indiana State Board of
Health, in regard to, the annual conference of Inspectors of Weights and Measures to
be held April 17, 18, 19th, was read and the Board approved and authorized the
attendance at this conference of Charles J. Burns, Inspector of Weights and Measures
for the City of South Bend.
VACATION RESOLUTIONS NOS. 26972 26982 2699, 2700, 2701,2710,2711.
-This being the date set, hearings were had on the resolutions heretofore adopted by
;he Board of Publie Works for the vacation of streets and alleys described under Vacation
Resolutions Nos. 2697, 2698, 2699, 2700, 2701, 2710,.and 2711. The Clerk of the Board
having shown sufficient proofs of publication and no remonstrators having appeared and
no written remonstrances having been filed with the Clerk, it was moved, seconded, and
unanimously carried that the said resolutions be finally adopted and the said streets
and alleys be vacated.
The assessment rolls having been filed by the City Engineer showing the awards of
damages and the assessments of benefits in the matter of vacation of streets and alleys
under Vacation Resolutions Nos. 2696, 2697, 2698, 2699, 2700 and 2701.
In the above named assessment rolls, the Board hereby orders that it will meet
in the City Hall at 11:00 A. M. on the 21st day of April, 1952 for the purpose of
hearing and receiving remonstrances from all persons interested in or affected by said
vacations, and the Board furthers orders that notice of said hearings, together with
the amount of damages awarded and benefits assessed be addressed to the property owners
by publishing same on the 28th day of March, on the 4th day of April, and on the llth
day of April, 1952 in the South Bend Tribune and the Tri-County News.
The action taken by the Board described in the foregoing three paragraphs was
due to an error in the original publication of hearing dates.
The Contractor's Bond of Donald W. Zimmerman, in the amount of $1,000.00 was
examined and approved by the Board.
There being no further business to come before the Board the meeting adjourned
at 12:45 P.M.
