M. All members were present. A petition having been filed by Northern Indiana Transit, Inc. which sets forth I a request for change of fares and a showing having been made by said Company, the the fares permitted to be charged for bus transportation Linder a contract made with • the City of South Bend, Indiana on or about the 13th day of May, 1940, as amended by a contract dated February 13, 1948, and as further amended by a contract dated July 8, 1950, and a request having been made by said Company that it be permitted to charge rates for services rendered to the public which will be fair and reasonable to all j parties concerned, and the statutes of Indiana (Sec.1+8-7303 Burns Indiana Statutes, 1950 Repl.) requiring the amendment of said contract to be undertaken in the manner herein followed, this Board now takes the following action: This Board, in compliance with said Statute, has tentatively determined the exact form in which the amendment to said contract is to be finally adopted to be in the following words and figures: 1�CONTRACT i THIS CONTRACT, made and entered into this day of , 1952, by and between the City of SOUTH BEND, INDIANA, acting by and through its Board of Public Works and Safety, hereinafter called the First Party, and NORTHERN Ir3DIANA TRANSIT,INC., a corporation organized under the laws of the State of Indiana, its successors and I assigns, hereinafter called the Second Party. WITNESSETH: The parties hereto agree that the certain contract made between the parties and confirmed by Ordinance of the Common GF,ur cjon�tr�ac�,t�eodf South Bend, onorabout the 13th day of P,ay, 191}0, as amended" n�o on e ay of February, 1948 between the parties and thereafter confirmed by the Common Council, and as further amended II by a contract entered into on the 8th day of July, 1950 between the parties and thereafter confirmed by the Common Council, shall be and is hereby amended in each of the following respects: ;I All provisions in said contract, as amended, regarding the 10/ cash fare now existing are amended as follows, to -wit: Cash fare . . . . . . . 15¢ - Token fare .2 tokens for 25� ) • ( Each token giving a passenger the right to one ride or trip on a bus). ! All provisions in said contract, as amended, regarding the 5� school fare, and as regarding transfers, shall remain the same. I By (� President 1j 0 399 This Board now fixes the 10th day of March, 1952, at 10:00 otclock (Central Standard Time) in the forenoon, as the time at which said contract will be finally considered, at the office of this Board in the City Hall, 214 North Main Street, South Bend, Indiana At said time and place, a public hearing will be had at which any taxpayer may appear and file protest against any or -all of the provisions of said contract. IT IS ORDERED that Northern Indiana Transit, Inc. shall, at its own expense, cause the full and complete text of said contract to be published one time at least one • i week before such hearing, with the time and place of such.hearing, in the South Bend Tribune, a daily newspaper, and the Tri-County News, a weekly newspaper (there being jonly one daily newspaper published in the City of South Bend), each of said newspapers being printed in the English language in the City of South Bend, St. Joseph County, Indiana. 0 0 0 • IT IS FURTHER ORDERED, that Northern Indiana Transit, Inc., shall likewise post a copy of such contract and notice in ten public places in the City of South Bend, Indiana. Done this 20th day of February, 1952. There being no further business to come before the Board, the meeting was adjourned at 3:30 P. M. It was decided that the matter should be transacted in the form of Quit Claim Deed, and the preparation for the transfer of title will be handled by the offices of the City Engineer and City Attorney.
