City Hall -at 11:00 A. M. on the 25th day of February, 1952 for the purpose of hearing
and receiving remonstrances from all persons_ interested in or affected by said vacation,
and the Board further orders that notice of said hearing,.together with the amount of
damages awarded and benefits assessed be addressed to the property owners by publishing
same on the 15th and2lst day of February, 1952 in the South Bend Daily Tribune and
the Tri-County°News.
The Excavation Bond of R. E. Carlton, U4 Fellows Street, South Bend, Indiana was
• examined and approved by the Board.
No further business being brought before the Board the meeting adjourned at 2::45 P.M.

Attorney Russell C. Kuehl appeared before the Board, as legal representative for
The Dependable Disposal Co., Inc.,
and presented Petition for increase in compensation
for collection and disposal of garbage for the City of South Bend in the amount of
$8,000.00 for the year 1952 over and above the amount provided in current contract
entered into November 7, 19491 with the specified termination date of January
1, 1955-
Mr. I. W. Cripe also appeared before the
Board with Attorney Kuehl in this,matter
and the matter was discussed in considerable
detail. It was decided by the Board to

take the Petition under advisement
for prompt
attention. Attorney Kuehl will

notified as soon as the Board is in position
to act on this petition.
Mr. Bert Liss, representing the Indiana Cab Co., and a representative of the
Ohio Oil Co. came before the Board in the matter of the gasoline leakage and seepage
at their premises which has seriously interfered with the tunneling operations in
which the City is engaged on Niles Avenue. PJr. Liss stated that they will proceed
within a short time to remove the 10,000 gallon tank from which this gasoline is
believed to be escaping.
City Engineer, Ray S. Andrysiak, asked that he be notified when removal operations

are underway, in order that he may be present. The suggestion was made by Mr. Liss
that interstate pipe line may be located in that vicinity. Engineer Andrysiak stated,
that to his knowledge, such line exist only in the vicinity of Western Avenue and at
Ireland Road, but he will verify this by checking with the oil companies. Mr. Liss
also suggested that the City would probably want to fill the excavation with grater
after removal of tank, in an attempt to flush the gasoline from the soil.
It was agreed that the City Engineer will be notified and present when removal of
tank takes place.
Mr. Karl Brecht and Mr. Ralph E. Allen, representatives of the Studebaker Corporation,
appeared before the Board and presented a blue print of their proposed parking lot on
the East side of South Michigan Street, North of the railroad viaduct and Bronson Street,,
Traffic Engineer, Ernest Miller, was present and the matter of the entrance and
exit was given special consideration. The plan as submitted, was approved by the
Board, with the stipulation that should a traffic problem arise, the entrance and exit
to the parking lot would be changed to correct the situation.
STREET DEPARTMENT:
Harry M. Tomlinson, Street Commissioner,was present and the matter of street signs
for the new additions was first taken up. After brief discussion, the Board decided
to take this under advisement for further study.
Mr. Tomlinson then brought to the attention of the Board several pieces of
automotive equipment urgently in need of replacement and the Board directed that he
draw up specifications covering his needs in proper form to advertise for bids. Mr.
Tomlinson also mentioned his need for a special body for truck used for trash hauling.
ENGINEERING DEPARTMENT:
City Engineer, Ray S. Andrysiak, again brought up the matter of the Hydraulic
Avenue bridge,.declaring it to be unsafe and too far deteriorated to put any further
expense into repair.
Mr. Tomlinson suggested that the City buy up the water rights of firms still
holding such rights on.property adjoining Hydraulic Avenue. Engineer Andrysiak offered
a plan whereby the mill race could be filled in at the bridge location without affectin
water rights of the two or more holders of such rights on Hydraulic Avenue. The Board
withheld action in the matter, subject to further study.

Petition was presented and filed by John Barkowski and five others for a local sewer
on Cr=.stown Avenue from center line of Lincolnway West to center line of lot No.b
in Lincoln Manor 2nd Addition.

was referred to City Engineer.
City Civil Engineer, Ray S. Andrysiak, recommends petition of John Barkowski and
five others for Crumstown Avenue local sewer be granted.
Wilbur He Gartner & Associates were ordered to prepare plans and specifications
for construction of local sewer on Crumstown Avenue.
NORTH ELMER STREET SEWER
Petition was presented and filed by Better Homes of, South Bend, Inc. and three
others for a local sewer on North Elmer Street from 625 feet South of the center line
of Marquestte Boulevard to 460 feet North of the center line of _Marquette Boulevard.
Petition of Better Names of South Bend, Inc. and three others for a local sewer on
North Elmer Street was referred to City Engineer.
Ray S. Andrysiak, City Engineer, recommends petition of Better Homes of South.Bend,Ind
and three others for North Elmer Street local sewer be granted. 11
Wilbur H. Gartner & Associates were ordered to prepare plans and specifications for
construction of local sewer on North Elmer Street.

Wall Street from the center line of Twyckenham Drive to 220 feet West of West line of
Greenlawn Avenue.

I a Guardian's Deed.and Blue Print pertaining to a portion of Lot G-1 of Forest Hill
Addition, which is to be dedicated as a part of Farneman Avenue and a portion of
said Lot G-1 to be dedicated as a part of the East and West alley between Donmoyer
Avenue and Farneman Avenue. The Board decided to hold this matter in abeyance until
the next regular meeting.

A Petition was received and examined by the Board, calling for installation
• of 'a.catch basin at the corner of Olive and Keller Streets. The Board took the
matter under advisement pending a report on the sewer situation at that intersection.
The Annual Report of the Traffic Division for the year 1951 and the Annual
Report of the Police Department (1951) were received by the Board, examined and
j ordered placed on file.
