Milliken, Chairman of the Publicity Committee of the Junior Chamber of I Commerce appeared before the Board with a request for permission to use a banner across +. i Michigan Street advertising the Jayceest Annual Sport Show. The Board explained to Mr. Milliken the policy it has adopted whereby it no longer grants this privilege to 'j any organization and permit was denied. S TREE T DEPARTMENT: Harry Tomlinson, Street Commissioner, was present and reported to the Board that the asphalt plant is now ready to operate. Mr. Floyd Searer, representing C. Harry Swanson, Inc., was present and presented a replat of Tuxedo Park Subdivision, which has been examined and approved by the Planning Commission. The Board approved the replat and directed the Clerk to send the replat to Phe Cga�.ty Recorderts Office for recording. Recorded in County Reeorderts Office Book 18 age. , At 11:00 otclock, this being the time set in the advertisement for bids, the Board proceeded to open bids submitted for the supplying of Street Department materials. Meeting then recessed at 12:00 Noon to reconvene at 2:00 P. M. 1 The Petition for the vacating of a portion of Iroquois Street North of Angela ;Avenue, submitted by Joseph and Louise White, and Harold and Marcella Higgins, under ;date of January 21, 1952, which had been previously referred to the City Planning 11Commission by the Board, was returned to the Board with their approval, subject to `appropriate easements for utility lines. No action was taken on the vacation, except !'that the Clerk was directed to inform the public utilities concerned that the Board ;favors the vacation and will take action approving such vacation at a subsequent (meeting, affording them an opportunity to secure the necessary easements. i Petition of Frank and Helen Magrames to vacate the following alley was approved by the Board - VACATION RESOLUTION NO. 2710 - 1952 (1809) (RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA: That it is desirable to vacate the following: ALLEY LYING BETWEEN LOTS 317 and 264 in SECOND PLAT OF LASALLE j PARK, WHICH ALLEY EXTENDS NORTH FROM THE NORTHERN BOUNDARY OF WESTERN AVENUE TO THE SOUTHERN BOUNDARY OF THE FIRST EAST -WEST ALLEY NOTH OF SAID WESTERN AVENUE. The following property may be injuriously or beneficially affected by such vacation: Lots numbered 317 and 264, Second Plat of LaSalle Park. Notice of this Resolution shall be published on the 15th day of February and the 21st day of February, 1952, in the South Bend Daily Tribune and the Tri-County News. This Board at its office in the City Hall on the 25th day of February, 1952 at 11:00 A. M. will hear and receive remonstrances from all persons interested in or affected by these proceedings. East Washington Avenue froma a point 130 feet East of the East line of Tuxedo Drive East a distance of 458 feet to the West line of Twenty -Sixth Street as laid out and dedicated in the recorded Plat of Tuxedo Park Second Subdivision of lots in Jefferson Heights Addition to the City of South Bend. 2. VACATION RESOLUTION NO. 2700 - 1952 This being the date set, hearing was held on the assessment roll showing the award of damages and the assessment of benefits in the matter of vacation of Bowman' Street from'the West line of Main Street to the East line of the North and South Alley West of Main Street, under vacation resolution No. 2700. In the above named assessment roll, no remonstrators appeared and no written re- monstrances were filed, the Clerk of the Board submitted proofs of publication of notice and same were found sufficient, and the Board,therefore, finds that the several lots and parcels of land have been benefited and damages in the amounts shown on said roll. The Board, therefore, decided to take final action on said assessment roll and declares same in all things ratified, confirmed and approved without modification and the proceedings closed, and the street vacated uppn receipt of the amount of benefit assess- ments from the various property owners so benefited and all proceedings had with reference to said street vacation are hereby sustained. VACATION RESOLUTION NO. 2698 - 1952 This being the date set, hearing was held on the assessment roll showing the award of damages and the assessment of benefits in the matter of vacation of the alley East of St. Peter Street from the South line of the First alley South of Wayne Street to the North line of the Grand Trunk Railroad right-of-way under vacation resolution No. 2698. In the above named assessment roll, no remonstrators appeared and no written remonstrances were filed, the Clerk of the Board submitted proofs of publication of notices and same were found sufficient, and the Board, therefore, finds that the several lots and parcels of land have been benefited and damaged in the amounts shown on said roll. The Board, therefore, decided to take final action on said assessment roll and declares same in all things ratified, confirmed and approved without modifi- cation and the proceedings closed, and the alley vacated upon receipt of the amount of benefit assessments from the various property owners so benefited and all proceedings had with reference to said alley vacation are hereby sustained. VACATION RESOLUTION 4No.2697 This being the date set, hearing was held on the assessment roll showing the award of damages and the assessment of benefits in the matter of vacation of West Colfax Avenue from Brookfield Street to Johnson Street under vacation resolution No. 2697. In the above named assessment roll, no remonstrators appeared and no written remonstrances were filed, the Clerk of the Board submitted proofs of publication of notices and same were found sufficient, and the Board, therefore, finds that the several lots and parcels of land have been benefited and damaged in the amounts shown on said roll. The Board, therefore, decided to take final action on said assessment roll and declares same in all things ratified, confirmed and approved without modification and the proceedings closed, and the street vacated upon receipt of the amount of benefit assessments from the various property owners so benefited and all proceedings had with reference to said street vacation are hereby sustained. Vacation Resolution No. 2699 This being the date set, hearing was had on the resolution heretofore adopted by the Board of Public Works for the vacation of West Victoria Street from IVLichigan Street West to the East Line of the North and South Alley, excepting the 20 feet in the center, which is to be reserved for an alley, under resolution No. 2699. The Clerk of the Board having shown sufficient proofs of publication and no remonstrators having appeared and no written remonstrances having been filed with the Clerk, it was moved, seconded and unanimously carried that the said resolution be finally adopted and the said street be vacated. The Engineering Department is directed to prepare an assessment roll covering the assessment of benefits and the award of damages to the sourrounding properties. R. S. Kuehl appeared before the Board, as legal representative for The Dependable Disposal Co., Inc., and presented Petition for increase in compensation for collection and disposal of garbage for the City of South Bend in the amount of 08,000.00 for the year 1952 over and above the amount provided in current contract entered into November 7, 1949, with the specified termination date of January 1, 1955- Mr. I. W. Cripe also appeared before the Board with Attorney Kuehl in this,matter and the matter was discussed in considerable detail. It was decided by the Board to take the Petition under advisement for prompt attention. Attorney Kuehl will be notified as soon as the Board is in position to act on this petition. Mr. Bert Liss, representing the Indiana Cab Co., and a representative of the Ohio Oil Co. came before the Board in the matter of the gasoline leakage and seepage at their premises which has seriously interfered with the tunneling operations in which the City is engaged on Niles Avenue. Mr. Liss stated that they will proceed within a short time to remove the 10,000 gallon tank from which this gasoline is believed to be escaping. City Engineer, Ray S.
