PARKING LOTS: A letter was received from the Paul W. Sigrist Furniture Company, Inc., i-ndicating a change of rates for parking lot No. 31 located at Monroe and Main Streets, ENGINEERING DEPARTMENT: A letter was received from Consoer, Townsend and Associates relative to the bi s submitted by Barney Massa Construction Company for construction of the 96 inch sewer. The Board approved Work Order #21 Contract 4A for Barney Massa Con- struction Company which included the construction of the Sherman Avenue sewer. DEDICATION WHEREAS, a plat with dedication of streets and alleys indicated thereon is now pre- sented to the Board to be known as Riverview Subdivision an addition to South Bend, Ind- ana, and This plat and dedication is filed in the records of the Board of Public Works and Safety in Row # , Drawer # , and recorded in Book # /fl , Page in in the Recorder Is office of St. Joseph County. NOW, THEREFORE, be it resolved by the Board of Public Works and Safety of the City of South Bend, Indiana, that all public streets, alleys and public places dedicated to the public use in said plat are hereby accepted and approved by said Board for an on be- half of the City of South Bend, Indiana. VACATION RESOLUTION NO. 2696, 1951 RESOLVED BY THE BOARD OF PUBLIC VO RKS OF THE CITY OF SOUTH BEND, INDIANA: That it is desirable to vacate the following; A PORTION OF COLUMBIA STREET DESCRIBED AS FOLLOWS: Commencing at a point ian the west line of Columbia Street at a point 134 feet northeasterly at right angles from the northeasterly line of Lincoln Way East; thence southeasterly across Columbia Street on a line projected southeasterly to the east line of said Columbia Street and which line before projection southeasterly is 134 feet northeasterly at right angles and parallel to the northeasterly line of Lincoln Way East; thence north along the east line of Columbia Street to the river's edge; thence northwesterly along the riverts edge to the west line of Columbia Street; thence south along west line of Columbia Street to place of Beginning; said va- cation being subject to all easements now existing and inuring to the benefit of public utilities operating in the City of South Bend. The following property may be injuriously or beneficially effected by such vacation: Lots numbered 77 and 109, part of Original Plat of South Bend. Notice of this resolution shall be published on the 14th day of December and on the 21st day of December, 1951, in the South Bend Daily Tribune and the Weekly Record. This Board, at its office in the City Hall on the 31st day of December, 1951, at 11;00 a.m., will hear and receive remonstrances from all persons interested in or affect ed by these proceedings. Baer BOARD OF PUBLIC VU RKS & SAFETY VACATION RESOLUTION NO. 2692, 1951 This being the date set, continued hearing was held on the Assessement Roll showing the award of damages and the assessment of benefits in the matter of the vacation of. the FIRST ALLEY WEST OF EDDY STREET from Washington Street north to the south line of the alley running east and west under Vacation Resolution No. 2692. Present at the hearing were Irving Smith, Attorney for the petitioner, and Leo P. Rieder, Attorney for the remonstrator. The Clerk of the Board submitted proofs of pub- lication of notices and same were found sufficient. The Board being;_fully advised in the premises denies the remonstrance and finds that the several lots and parcels of land shown on the Assessment Roll have been benefited and damaged in the amounts shown on said roll. The Board, therefore, decides to take final action on said Assessment Roll and declares same in all things ratified, confirmed and approved without modification and the proceedings closed and the alley vacated upon receipt of the amount of benefit assessment from the various property owners so benefited and all proceedings had with re ference to said alley vacation are hereby sustained. VACATION RESOLUTION N0. 2694, 1951 This being the date set for continued hearing on the resolution hereto adopted by the Board of Public Works and Safety for the vacation of the alley running north and Bout, from Western Avenue to Monroe Street between 'Columbia and Carroll Streets under Vacation I Resolution No. 2694,, hearing was held. The Clerk of the Board having showed proofs of publication of notices and same were found sufficient. Irving J. Smith, Attorney, appear ed for the petitioners. The National Storage, Warehouse Company, Inc., owners of Lot #13 +� and 33 feet over the entire north side of Lot #14 in the recorded plat of Denniston and i! Fellows Addition, appeared, represented by F._ J. Nimtz of DuComb & DuComb and remonstrated vacating the alley immediately east of their -land, but stated that they would have no objection to vacating the rest of the alley. The Indiana & Michigan Electric..Company ap 1 peered by Warren E. McGill of Seebirt Oare and Deahl and stated that they had no objection to the vacation of the alley and that no utility lines would be interfered with by reaso of said vacation. The Board now finds that said alley should be vacated, excepting the north 99 feet of said alley, being that portion of the alley lying to the east of Lot13 and,to the north half of Lot #14 in said addition. It is now ordered that said alley running north and south from Western Avenue to Monroe Street between Columbia Street and Carroll Street be vacated except the north 99 fe6t of said alley 1_ying immediately :3 east of Lot #13 and the north half of Lot #14 and west of Lot #12 and west of the north half of Lot#ll. The Engineering Department is directed to prepare an assessment roll covering the assessment of benefits and the award of damages to the surrounding properties. VACATION RESOLUTION NO.2694, 1951 R. S. Andrysiak,`City Engineer, filed primary assessment roll showing the awards of damages and the assessments of benefits in the matter of the vacation of the alley run. ning north and south from Western Avenue to Monroe Street between Columbia Street and Carroll Street excepting the north 99 fett of said alley under Vacation Resolution No. 26 94. In the above named assessment roll, the Board hereby orders that it will meet in the City Hall at 11:00 a.m., on the 31st day of December for the purpose of hearing and rece ing remonstrances from all persons interested in or affected by said vacation, and the Board further orders that notice of said hearing, together with the amount of damages awarded and benefits assessed be addressed to the property owners by publishing same on the 14th day of December and on the 21st day of December, 19519 in the South Bend Daily Tribune and the Weekly Record. John Robert Sanders appeared before the Board, represented by R. E. Zimmerman, Attor ney,-and filed a Notice of Claim and Intention to Prosecute the City of :South Bend.. The Board ordered the notice to held for further consideration. ' TAXI CABS: A petition was received from United Cab Company, Inc., and Yellow Cab Compan Inc., asking for a two -cab stand on Jefferson Boulevard, east of Michigan Street on the south side of the street at the first two -parking spaces east of Michigan Street. The Board, after discussion with the traffic engineer, granted permission for the establish- ] ment of this taxi cab stand. STREET DEPARTMENT: Melton 0. Brannan, Street Commissioner, was present and matters per- taining to his department were discussed. Mr. Brannan informed the Board that Henry.Zoss was injured while on duty and -was in need of medical attention. The Board directed that Mr. Zoss have such medical attention as was considered necessary.
