A regular meeting of the Board of Public Works was held on Monday, December 3, 1951
at 930 A.M. Mr. Baer was absent. Minutes of the last

A petition was received from C. Harry Swanson, Inc., asking for the vacation of
a portion of East Washington Avenue; a portion of Twenty-sixth Street; a portion of
Twenty-fifth Street; the first north -south alley east of Tuxedo Drive from Washington 1
Street North a distance of 410 feet to Colfax Avenue; Twenty-fifth Street from the Northj
line of Colfax Avenue North a distance of 133 feet; Twenty-sixth Street from the north iI
line of Colfax Avenue North a distrance of 133 feet; the first north -south alley East of
Tuxedo Drive from Colfax Avenue north a distance of 133 feet; the first -north -south allejf
east of Twenty-fifth Street from the North line of Colfax Avenue north a distance of i
133 feet. This was referred to the City Plan Commission for investigation and report. j

The Board approved plans for street improvement on Sylvan Lane from Sample Street
to Scenic Drive.

VACATION RESOLUTION NO. 2689
This being the date set, hearing was had on the assessment roll showing the award
of damages and the assessment of benefits in the matter of the vacation of a part of
Klinger Street as shown on the Recorded Plat of Whitcomb & Keller's Beverly Heights 5th N
Addition described as follows: Beginning at a point on the north line of Klinger Stree t
Fifth (50) feettea� t of the southwest) 2nree o lot number 120 of said addition; thence
easterly oz�/ntgi hsotii�at�'olo� no. 2of said addition; thence South 190 i5r
East, twelve feet to a point due east of the place of beginning; thence west to the place •
of beginning,.under Vacation Resolution No. 2689.
In the above named assessment roll, no remonstrators appeared and now ritten re-
monstrances were filed. The Clerk of the Board submitted proofs of publication of not-
ices and same were found sufficient, and the Board, therefore, finds that the several to rls
and parcels of land have been benefited and damaged in the amounts shown on said roll. 11
The. Board, therefore, decides to take final action on said assessment roll and declares
same in all things ratified, confirmed and approved without modification, and the pro-
ceedings closed, and the street vacated upon receipt of the amount of benefit assessment"
from the various property owners so benefitted and all proceedings had with reference to,
said street vacation are hereby sustained. .
VACATION RESOLUTION NO. 2692
This being the date set, hearing was had on the assessment roll showing the award
of damages and the assessment of benefits in the matter of the vacation of the first
alley tlest of Eddy Street from Washington Street North to the South line of the alley
running east and Wiest, under Vacation Resolution No. 2692.

j The undersigned respectfully shows that she is the owner of the following described
real estate located in the City of South Bend, State of Indiana
. j a part of Large Lot numbered 16 as shown on the recorded plat of Samuel L. Cottrell
First Addition to the Town of Lowell, now a part of the City of South Bend, Indiana, whi
part is bounded by a line running as .follows, viz: Beginning on the South line of said
Large Lot numbered 16 at a point 229 feet east of the southwest corner of said Lot;,
thence running east on the south line thereof 53.1 feet; thence north 198 feet to a publ

be injured and damaged in tralue of not less than Two Thousand Dollars ($2,000.00) wherea
she has been awarded no dollars by this Board.
The undersigned respectfully remonstrances against the failure of this Board to
award to her in the sum of not less than Two Thousand Dollars ($2,000.00).

Also appearing before the Board were Wallace Schwalm, petitioner and his Attorney
Irving Smith. The hearing was continued until Monday, December 10, 1951 at 11:00 A.M.
VACATION RESOLUTION NO. 2693
This being the date set, hearing was had on the assessment roll showingthe award of
damages and the assessment of benefits in the matter of the vacation of the first alley
South of California Avenue f roan Wilbur Street to the East line of the North and South
Alley and from the IA,Test line of .the North and South alley to Adams Street under Vacation
Resolution No. 2693.
In the above named assessment roll, no remonstrators appeared and no written remon-
strances were filed. The Clerk of the Board submitted proofs of publication of notices
and same were found suffucient, and the Board, therefore, finds that the several lots
and parcels of land have been benefitted and damaged in the amounts shown on said roll.
The Board, therefore, decides to take final [action on said assessment roll and declares
same in all things ratified, confirrre d and approved without modification, a nd the pro-
ceedinrts closed, and the alley vacated upon receipt of the amount of benefit assessments
from the various property owners so benefitted and all proceedings had with reference
to said alley vacation are hereby sustained.
VACATION RESOLUTION 2694
This being 'the date set for hearing on the Resolution heretofore adopted by the
Board of Public Works for the vacation of the alley running north and south from Western
Avenue to Monroe Street between Columbia Street and Carroll Street under Vacation Resol-
ution No. 2694, hearing was had.
Comes now, Irving J. Smith, Attorney for the Petitioner, who files a request for a
continuence on the hearing until Monday, December loth, 1951 at 11 00 A.M. The Board
granted the request for continuance.
VACATION RESOLUTION no. 2695
This being the date set, hearing was had on the resolution heretofore adopted by th
Board of Public Works for the vacation of the alley South of Monroe Street from Main
Street West to the East line of the North and South Alley running from Monroe Street to
South Street, under Vacation Resolution No. 2695. The Clerk of the Board having shown
sufficient proofs of publication and no remonstrators having appeared and no written
remonstrances having been filed with the Clerk, it was moved, seconded and unanimously
carried that the said resolution be finally adopted and the said alley be vacated. The
Engineering Department is directed to prepare an assessment roll showing the assessment
of benefits and the award of damages to the surrounding properties..
R. S. Andrysia}X, City Engineer, filed primary assessment roll showing the awards
of damages and the assessment of benefits in the matter of the vacation of the alley Sou
of Monroe Street from Main Street lvvest to the East.line of the North and South alley
running from Monroe Street to South Street, under Vacation Resolution No. 2695.
In the above named assessment roll, the Board hereby orders that it will meet in th
City Hall at 11t00 A.M. on the 17th day of December, 1951 for the purpose of hearing and
receiving remonstrances from all persons interested in or affected by said vacation, and
the Board further orders thatnotice of said hearing, together with the amount of damages
awarded and benefits assessed be addressed to the property owners by publishing same on
the 7th day of December and on the 14th day of December, 1951 in the South Bend Tribune
and the Tri-County News.
WHEREAS, the Crown Development Company, Inc., is causing to be constructed at its
own expense what is known as the McKinley Pumping Station located between the curb line
and the South property line of Corby Street at the Northwest corner of Lot Numbered
Two Hundred Eighty-nine (289) as shown on the recorded Plat of McKinley Terrace Addition
for the purpose of providing aewage service for residents in that immediate area; and
WHEREAS, the plans, specifications and requirements for said pumping station have
submitted to and approved by the South Bend City Engineer,
NOW, THEREFORE, BE IT RESOLVED
That upon the completion of the aforesaid pumping Station at the sole expense of th
Crown Development Company, Inc. in accordance with the plans, specifications and require
ments heretofore submitted to and approved by the South Bend City Engineer, The City of
South Bend, Indiana shall assume the operation and maintenance of said pumping station.
This resolution adopted this 3rd day of December, 1951.

duly sworn upon oath deposes and says he is acquainted with the Reed Construction Compan
Mishawaka, Indiana, the party to whom was awarded the contract and who performed the wor
under Improvement Resolution No. 2679-1951, VI'ELLINGTON STREET PAVEMENT'.
That he is familiar with and personally knows the requirements of the plans and
specifications of said improvement resolution and further knows that -the said REED CONS:
STRUCTION COMPANY in the performance of said work complied with all the terms and con-
ditions of said plans and specifications in every p articul, and that the material used
was of the character, kind, quantity and quality required therein and according to and
under the direction of the Board of Wublic Works and Safety.
