Street Improvement Plans were approved and ordered filed for the construction of
pavement, curb and walk on Sherwood Avenue from St. Joseph Streetto-Fellows Street and
on St. Joseph street from Klinger to Chippewa for Whitcomb and Keller.
The:_•Board._'approved .a Grant of Easement by the Dallas & Mavis Forwarding Company,
Inc., to the Colpaert Realty Corporation and the City of South Bend for the construction
of a thirty (30) inch combined storm and sanitary Sewer along, through and upon apart of
said area described as follows, to -wit: Beginning at a point on the present west line
of Sheridan Avenue 2451.65 feet east acid 1014 feet south of the northwest corner of Sec-
tion 16 Township 37 North, Range 2 East; thence West 453 feet to the east l>ine of Belle
ville Gardens 2nd Unit; thence south on said east line 14 feet; thence east 453 feet to
said west line of Sheridan Avenue; thence north 14 feet along said west line of Sheridan
Avenue, to the place of beginning.
DEDICATION
WHEREAS, a plat with dedication of streets and alleys indicated thereon is now pre
sented to the Board to be known as McKinley Terrace Addition an addition to South Bend,
Indiana, and
This plat and dedication is filed in the records of the Board of Public Works and
Safety in Row # , Drawer # , and recorded in Book , Page , in the Recorderts
Office of St. Joseph -County.
NOW, THEREFORE, be it resolved by the Board of Public Works and Safety of the City'
of South. Bend, Indiana, that all public streets, alley and public places dedicated to
the public use in said plat are hereby accepted and approved by said Board for and on
behalf of the City of South Bend, Indiana.
VACATION RESOLUTION NO. 2678

This being the date set, heving was held on the assessment roll showing the award
of damages and the assessment of benefits in the matter of vacation of ALLEY BETWEEN MAIN
AND MICHIGAN STREETS FROM NAVARRE STREET NORTH TO THE SOUTH LINE OF THE ALLEY NORTH OF
NAVARRE STREET under Vacation Resolution No..2678..
A letter was received from Seebirt, Oare & Deahl, Attorneys for the Indiana & Miclh3-
gar: Electric Company informing the Board that the -said company had received a duly execut-
ed deed.of easement from the Memorial Hospital of South Bend, which covers the installa-'
tion of their facilities in the alley to be vacated. Mr. Holmes of the Indiana hell
Telephone Company informed the Board that the Telephone Company had also received a duly''
executed easement from Memorial Hospital.
In the ahove named assessment roll, no remonstrators appeared and no written remon-
strances were filed, the Clerk of the Board submitted proofs of publication of notices
and same were found sufficient, and the Board, therefore, finds that the several lots
and parcels of land have been benefited and damaged in the mounts shown on said roll,
The Board, therefore, decided to take final action on said assessment roll and declares
same in all things ratified, confirmed and approved without modification and the proceed-
ings closed, and the alley vacated upon receipt of the amount of benefit assessments from
the VTious property owners so benefited and all proceedings had with reference to said
alley vacation are hereby sustained.

RESOLVED BY THE BOARD OF PUBLIC WORKSOF THE CITY OF SOUTH BEND, INDIANA: That it
is desirable to vacate the following:
THE FIRST ALLEY WEST OF SCOTT STREET FROM LINCOLN CLAY 'NEST NORTH TO THE SOUTH
LINE OF THE ALLEY NORTH OF LINCOLNWAY 04rEST.
The folowing property may be injuriously or beneficially effected by such vacation:
Lots Lumbered 1 to 6 inclusive, and Lot No. 16, part of Kent and Garrisonts
Subdivision, and Lots Numbered 17, 18, 213 22, 23 James Kent -Is Subdivision of
B. 0. L. No. 11;� and part of No. 113.
Notice.of this resolution shall be published on the 24th day of August and on the
31st.day of August, 1951, in the South Bend Daily Tribune and the Weekly Record.
This Board, at its office in the City Hall on the loth day of September, 1951, at
10:00 a.m., C.S.T. will hear and receive remonstrances from all persons interested in or
affected by these proceedings.

Whereas, the Board of,Publie Works, did on the 13th day of August, 1951, adopt
Preliminary Orders designating -Class "C" Cement Concrete as the kind of pavements for
the improvement of RANDOLPH STREET from -the east line of Twyckenham Drive to the.west
line of Robinson Street in accordance with Improvement Resolution No. 2643-1950, AND
VINE STREET from the east line of Twenty-sixth Street to the west line of Twenty-seventh
Street in accordance with Improvement Resolution No. 2672, 1951s AND
TWENTIETH STREET from the south line of Mishawaka Avenue to the south line of Hammond &
Whi.tcomb's Addition in accordance with Improvement Resolution 140. 2673-1951, passed by
this Board on June 251 1951, and confirmed by this Board on July 23, 1951,

Therefor Be It Resolved, By the Board of Public Works and Safety of the City of South '
Bend, Indiana, that the bidsof the Rieth-Riley Construction Company for the construction
of the improvements described in Improvement Resolutions Nos. 2643-1950, 1672 and 2673-
1951, passed by this Board on June 25, 1951, and confirmed by this Board on July 23, 1951!
be and the same are hereby adopted and that the City of South Bend, Indiana, thru its
Mayor and Board of Public Works and Safety enter into a written contract with said Rieth-
Riley Construction Company for the faithful executor of such work, according to said bids
the detailed plans and specifications and the terms of said Resolutions, provided that be
fore entering upon the performance of said contracts, said Rieth-Riley Construction Co.,
shall give bond, in the amount equal to one hundred (100) per cent of the contract price
for such work, with a Surety Company legally authorized to transact business in the State
of Indiana, as Surety, to the approval of this Board, to secure the performance of such
contracts, and shall jive a Maintenance Bond in the amount equal to fifty (50) per cent
of the contract price for- such work, with a Surety Company legally authorized totransact
business in the in the State of Indiana, as Surety, to the approval of this Board to
warrant and quarantee the work, -material and condition of the pavements for.a period of
0
three (3) years, and to hold the City of South -Bend, Indiana, harmless from .payment of
any debt or damage by reason of any act of suchcontractor, and to secure the payment
of all claims for labor and material used in such improvements.

Be It Resolved, By the Board of Public Works and Safety of the City of South Bend,
Indiana, that it is deemed necessary to improve HILL STREET from the north line of Corby'
Street to the south line of Howard Street by constructing a Class "C" pavement, AND
ILLINOIS STREET from the south line of Western Ave., to the north line of Huron St., by
constructing a Class "C" pavement, Al`
ST PETER STREET from the north line of South Bend Ave., to the south line of Corby St.,
by constructing a Class "C" pavement, AND
WELLINGTON STREET from the south line of Huron Street to the north line of Ford St., by
constructing a Class "C" pavement, AND
NORTH SHORE DRIVE from the west line of Michigan St., to the east line of Lafayette Blvd,',
by constructing a bituminous concrete (AH) re -surface pavement.
The same to be done in accordance with the profiles, drawings, plans, general detail
and specifications of such improvements approved August 20, 1951, and to be adopted by
the Board of Public Words and Safety of tb.e City of South Bend, imn-iediately upon the
final adoption of th&se resolutions and placed or, file in the office of the City Civil
Engineer of Said City, and such improvements are nowordered.
The total cost of said improvements, including all irnidental costs such as advertisl=
ing, abstracting, inspection and engineering, shall be assessed upon the real estate abu�-
ting on said HILL STREET, ILLINOIS STREET, ST. PETER STREET, WELLINGTON STREET, AND NORTI
SHORE DRIVE to be improved, all according to the method and manner provided for in an 1'
Act of the General Assembly of the State of Indiana, entitled, "An Act Concerning Municill
pal Corporations" approved March 6th, 1905, and in accordance :rith and pursuant to the
provisi@ns of all amendatory and supplemental actsthereto, passed by the General Assembly
of she State of Indian a. Assessments, if deferred, are to be paid in ten equal install- j
ments, with interest at the rate of six (6) per cent per annlu-. (A bond or bonds shall

lUnder no circumstances shall the City of South Bend., Indiana, be or be held responsible
,for any sum or sums due from sand property owner or owners for said work, or for certifi-
cafe or certificates, bond or bonds, issued to said contractor in payment for such work,
except for such moneys as shall have been actually received by the City from assessments
for such improvements,,or such moneys as the City is by said entitled Act and the provi-
sions of all --cts amendatory and supplemental thereto, required to pay. All proceedings
had and. work done in rna1"-ing of said improvements , assessment of properties, collection
of assessments and issuance of bonds therfor, shall be as provided for in said entitled
Act and amendments the-; eto.

The llth day of September, 1951, at the hours of 6:30 otclock PIA -CST is hereby fixed
as the time, and the office of the Board i�? said City as the place, when and where all
persons whose property may be affected by such proposed improvements, may be heard as to
- the necessity for the same, and all petitions and remonstrances received and the Board
will, on said day, decide whether the benefits accruing to abutting and adjacent proper-
i ty, and to the City of South Bend, Indiana, ��ill be equal to or exceed the estimated cost
of said improvements. The Clerk of the Board is hereby ordered to give notice by two week
