May 31, 1951
A Special Meeting of the Board of Public Works was held Thursday, May 31, 1951 at
6:30 P.M., C.S.T. Mr. Baer was absent. The meeting was called for the purpose of public
hearings on the following Improvement Resolutions:
No. 2665 WILBER STREET from the north line of Fassracht Avenue to the southerly
line of LaPorte Avenue
No. 2666 KENMORE STREET from the north line of Western Avenue to the south line
of Linden Avenue
No. 2667 WELLINGTON STREET from the north line of Western Avnue to the south lime
of Linden Avenue..
Property owners whose property is effected by the above resolutionswill have a ten
(10) day period of which to file remonstrances against the improvement resolutions.

ENGINEERING DEPARTMENT: Contractors' Bonds were approved and ordered filed for Alfred
J. Gish; Dick and Dale —Holcomb; Alvin Linn; and Ernst Sigamund Petzke.
A petition was received asking for the improvement of VINE STREET from 26th Street
to 27th Street by the ®nstruction of a pavement. This was referred to the city engineer.
?; A petition was received asking for the improvement of SHERIDAN STREET from Western
Avenue to Sample Street by the construction of a pavement. This was referred to the City

DEDICATION
WHEREAS, a plat with dedication of streets and alleys indicated thereon is now pre-
,sented to the Board to be known as Hartmants Twyckenham Plat an addition to South Bend,
Indiana, and
This plat and dedication is filed in the records of the Board of Public Works and
Safety in Row #, Drawer # , and recorded in Book # 18 , Page "H" , in the Recorder's
Office of St. Joseph County,
NOW, THEREFORE, be it resolved by the Board of Public Works and Safety of the City
of South Bend, Indiana, that all public streets, alleys and public places dedicated to t:
public use in said plat are hereby accepted and approved by said Board for and on behalf
iof the City of South Bend, Indiana.
VACATION RESOLUTION NO.. 2671
This being the date set, hearing was held on the assessment roll showing the award
�of damages and the assessment of benefits in the matter of vacation of THAT PART OF EAST
iMATION STREET BOUNDED AS FOLLOWS: Beginning at a point 201 feet east of the north-west
jcorner of Lot 130 in the original Plat of South Bend; thence north 15 feet; thence east
parallel to the south line of Marion Street to the writ line of the St. Joseph River;
thence southwesterly along the west line of the St. Joseph River to the south line of
Marion Street; thence west on the south line of Marion Street 343.28 feet more or less
to the place of beginning, said 15 foot strip of East Marion Street being that part of
said street lying north of the north property line of Lot 118 in the Original Plat... of
;South Bend and a part of vacated St. Joseph Street immediately west thereof, under Vaca-
tion Resolution No. 2671.
Now In the above named assessment roll, no remonstrators appeared and no written remon-
strances were filed., the Clerk of the Board submitted proofs of publication of notices
and same were found sufficient, and the Board, therefore, finds that the several lots and
• parcels of land have been benefited and damaged in the amounts shown on said roll. The
Board, therefore, decided to take final action on said assessment roll and declares same
In all things ratified, confirmed and approved without modification and the proceedings
.closed, and the part of street vacated upon receipt of the amount of benefit assessments
1jfrom the various property owners so benefited and all proceedings had with reference to
jsaid street vacation are hereby sustained.
L. C. Chapleau, Attorney, Mr. Leffler, Plant Manager, and Mr. Redrick, Superintenden
of Maintenance, representing the Oliver Corporation, and Mr. Joseph;S6bezyk, and,Mr.
ILemanski representing the property owners in the vicinity of the Oliver Plant appeared
;before the Board to discuss the complaints lodged agtinst the Oliver Corporation. Mr.
;Leffler informed the Board that the whistle the people had objected to, had been moved to
• la point further away from the street and that the drop -hammers have ceased operating at
110 o'clock each night excepting for the use of one hammer. Mr. Leffler further stated
that he would investigate the operation of the drop -hammer to see if it is being properly
;operated to further cut down the noise. He, also, stated that they were willing to co-
operate in any way so as to satisfy the surrounding property owners, but could not pro-
jmiseto cease using the drop -hammers at night altogether, as in the event of a rush order,
'they would have to work three shifts. Mr. Sobczyk and Mr. Lemanski, both expressed satis
(faction with the Oliver Corporationts effort to eliminate the nuisance and will meet with
Mr. Leffler at a later date to further discuss the matter.

After hegring all persons interested who appeared and being fully advised on the pre

ty owners and same having been found sufficient, the Board decided that the benefits to
the property liable to be assessed for said improvement are equal to the estimated cost
of the same as reported by the City Civil Engineer, Therefore
Be It Resolved, by the Board of Public Works and Safety of the Ctty of South Bend,
Indiana, that Improvement Resolutions Nos. 26650 2666 and 26671 1951 duly passed by
this Board on May 7, 1951 for the above improvements, be and the same are hereby in all
things confirmed and the improvements are hereby ordered to be made.

Indiana, that the profiles, drawings, plans, general details, specifications and estimate
approved by this Board on the 7th day of May, 1951, for the improvement `of WILBER STREET
from the north lineof Fassnacht Avenue to the southerly line of Laporte Avenue by constru t-
ing a Class 110 pavement, AND -
KENMORE STREET from the north line of Western Avenue to the south line of Linden Avenue
by constructing a Class t'C" pavement, AND
WELLINGTON STREET from the north line of Western Avenue to the south line of Linden Ave-
uue by constructing a Class "C" pavement.
Be and the same are hereby adopted and ordered placed on file in the office of the Depart
ment of Engineering of this Board.
June 25, 1951s at the hour of 10:00 o'clock AM -CST is hereby fixed as the time,
and the office of the Board of Public Works and Safety in the City Hall of this City, as
the place, when and where the Board of Public Works and Safety will open and consider
bids for the above named improvements, provided all bids for the construction of said
work shall be filed in the office of the Clerk of this Heard before 10:00 otcloek AM -CST
of said day. Each bidder for said work shall enclose with his bid a certified check,
payable to the Treasurer of this City in the sum of two and one-half (2-1) per cent of
the amount of his bid, or a bid bond for two and one-half (2-2) per cent of the amount
of his bid, to insure the execution of this contract, if said work is awarded to him.
The clerk of this Board is hereby ordered to give notice by two (2) weekly.publica-
tions of the time and place, -when and where bids will be received, opened and considered
for the construction of said work.' Said Clerk shall state in said notices, that each
bidder shall enclose with his bid a certfied check or bid bond for above named amount,
to insure the execution of this oontract.

Notice is hereby given, that the Board of Public Works and Safety of the City of
South Bend, Indiana, on the 25th day of June, 1951, at the hour of 10:00 AM -CST at the
office of the Board, in the City Hall, in said City, will open and consider sealed bids,
and designate by preliminary order the kind of pavement to be used, for the following
described street improvements, as provided for in Improvement Resolution No. 2665,/1951,
duly passed by.said Board on May 7, 1951, and confirmed on June 4o 1951, to wit: 2666,2
WILBER STREET from the north line of Fassnacht Avenue to the southerly line of Laporte
Avenue by constructing a Class "C" pavement, AND
KENMORE STREET from the north line of Western Avenue to the south line of Linden Avenue
by constructing a Class "C" pavement, AND
WELLINGTON STREET from the north line of Western Avenue to the south lineof Linden Ave-
nue.by constructing a Class 110 pavement.
Provided, all bids for the construction of said work, shall be filed in the office
of the Clerk of the Board of Public Works and Safety of said City before 10:00 o'clock

Mr. Miller was directed to place barricades on Dale Avenue from Milton Street to
Dayton Street from 10 :00 o'clock a;.m. , to 10 : 00 o4 clock a.m., from Junell to June 25,
1951, exclusive for the purpose of a play -street for the bible school.
TAXI CABS: Patrick Brennan and Joseph Pawlowski, attorneys filed an affidavit for Taxi
Cab License for the United Taxi Cab Company, Incorporated. This was referred to the
Controller's Of fice.
ENGINEERING DEPARTMENT: An Excavation Bond was approved and ordered filed for Raymond
Goldstein.
A Contractor's Bond was approved and ordered filed for Bror Swanson.
