There being no further business to come before the Boards the meeting was adjourned at 11:00 a.m. ATTEST: BOARD UBLIC g RCS ec SAFE SPECIAL MEETING July 6, 1950 A Special Meeting of the Board of Public Works was held on Thursday, July 6, 1950 at 9:00 a.m. All members were present. This being the date set for hearing remonstrances against and for considering the new contract between the City of South Bend and the Northern Indiana Transit Compapy, in corporated, said hearing was held. Comes now Mr. George N. Beamer, Attorney for the Northern Indiana Transit Company, Incorporated, and files proof of publication of notices in the Mirror Press and the South' Bend Tribuae, and the posting of notices in ten public places in the City of South Bend according to State Statute, the Board accepted the filing of proof for record. No tax payer having appeared before the Board to make remonstrance and no other per son wishing to be heard, the Board took the matter under advisement and will make their decision at a later date. There being no further business to come before the Board, the meeting was adjourned at 11:30 a.m. ATTEST: SPECIAL MEETING July 8, 1950 A Special Meeting of the Board of Public Works washeld on Saturday, July 8, 1950 at 110:00 a.m. All members were present. I 1 This meeting was called for the purpose of approving a contract between the City of ''South Bend, Indiana, and Northern Indiana Transit, Incorporated for a change in bus fares. The contract was approved subject to certain conditions contained in a letter this day received from Northern Indiana Transit, Incorporated and made a part of these minutes, land subject to the ratification of the Common Council. The Board of Public Works and Safety of the City of South Bend South Bend, Indiana Gentlemen: At an informal discussion between members of your Board and Mr. R. R. Smith, Presi- dent of Northern IndianaTrensit, Inc., arequest was made by you that Northern Indiana Transit, Inc. state its position relative to future service. At this meeting Mr. Smith revealed that the revenue derived from Sunday and late evening operations is insufficient to pay the wages of the drivers and maintenance men, to say nothing of the other costs of operation. He also stated that the number of pas- sengers hauled in the summer is greatly reduced over the number hauled during the other seasons of the year. j He stated it was the intention of the bus company to put into effect on July 15, 11950, a new schedule which 4 11 increase slightly the length of time elapsing between runs "in the early morning hours and late evening hours on Sunday and the late evening hours !during the week but will in no way effect the present schedules otherwise. It is difficult "to set out in a letter just what these changes are because they vary on different lines, :,but the proposed changes on the various lines conform mi th the schedule �h ich we have dis_ I cussed with you. At this meeting it was agreed by Mr. Smith that this schedule would rem8i n in force only during the summer months and that on September 2, 1950, when the new schedule is ;posted they will restore service to that which is now being given, unless after discussion. of the problem with the Board it is agreed that a revised schedule shall be put into effect. At this time we want to assure you that it is the intention of the company to furnis adequate service at all times and should any emergency or condition arise that will just- ify increased service it will be immediately given. The Contract approved by the Board is in the following words and figures: C O N T R A C T THIS CONTRACT, Made and entered into this 8th day of July, 1950, by and between the CITY OF SOUTH BEND, INDIANA, acting by and through its Board of Public Works and Safety, hereinafter called the First Party, and NORTHERN INDIANATRAN SIT, INC., a corporation or- ganized under the laws of the State of Indiana, its successors and assigned, hereinafter called the Second Party. WITNESSETH: The parties hereto agree that the certain contract made between the parties and con- firmed by Ordinance of the Common Council of the City of South Bend, on or about the 13th day of May, 1940, as amended by a contract entered into on the 13th day of February, 1948 between the parties and thereafter confirmed by the Common Council, shall be and is here- by amended in each of the following respects: All provisions in said contract, as amended, regarding the charges for token fares are hereby deleted. All provisions in said contract, as amended, as to cash fares and transrl- -rs shall remain the same. The Second Party shall furnish service to the public over the routes now presently established. Said contract made between the parties on the ,'the contract of February 13, 1948, as hereinabove .,nued in full force and effect. 13th day of May, 1940, as amended by amended, shall be and is hereby conti- Execut4d in triplicate by the parties on the day first above mentioned.
