A petition having been filed by Northern Indiana Transit, Inc. which,,s,er ts foth a ;request for change of fares and a showing having been made by said Company; that the fare • :permitted to be charged for bus transportation under a contract made with the City of South !Bend, Indiana on or about the 13th day of hay, 1940, as amended by contract'da.ted February 139 1948, and a request having been made by said Company that it be permitted to charge ii rates for services rendered to the public which will be fair and reasonable to all parties concerned, and the statutes of Indiana (Sec. 48-7303 Burns Indiana Statutes, 1933) requir- ling the amendment of said contract to to undertaken in 'the manner herein followed, this IBoa.rd now takes the following .Action: This Board, in compliance with said Statute, has tentatively determined the exact r ;form in which the amendment to said contract is to be finally adopted to be in the follow- ling words and figures: j 00 NTRAGT THIS CONTRACT, made and entered into this day of , 1950, by and between the,: :CITY OF SOUTH BEND, INDIANA, acting by and through its -Board of Public Works and Safety, !hereinafter called the First Party, and NORTHERN INDIANA TRANSIT, INC., a corporation or-' lga.nized'under the laws of the State of Indiana, its successors and assigns, hereinafter ;called the Second Party. WI'TNES SE TH: jThe parties hereto agree that the certain contract made between the parties and con-;' • if by Ordinance of the Common Council of the City of South Bend, on or about the 13th� dayy of May, 1940, as amended by a contract entered into on the 13th;da.y of February, 19�t8' between the parties and thereafter confirmed by,the Common Council, shall be and is here8 by amended -in each of the following respects: All provisions in said contract, as amended, regarding the charges for token fares �are'hereby deleted. .All provisions in said contract, as amended, as to cash fares and transfers shall remain the same. The Second Party shall furnish service to the public over the routes now presently is established. A Said contract made between the parties on the 13th day of May, 1940, as amended by the contract of February 13, 1948, as hereinabove amended, shall be and is hereby conti- hued in full force and effect. By _ This Board now fixes the 6th day of July, 1950 at nine o'clock C.S.T. in the fore- 1noon, as the time at which said contract will be finally considered, at the office of this ;Board in the City Hall, 224 North Main Street, South Bend, Indiana. At said time and {; ;place, a public hearing will be had at which any taxpayer may appear and file protest I against any or all of the provisions of said contract. IT IS ORDERED that Northern_ Indiana Transit, Inc. shall, at its own expense, cause i the full and complete text of said contract to be published one time at least one week before such hearing, with the time and place of such hearing, in the South Bend Tribune, j' a daily newspaper, and:.the'Mirror- &'.weekly newspaper (there being only one daily newspa,p6r 0 128 I1published in the City of South Bend), each of said newspapers being printed in the Engli: ;,language in the City of South Bend, St. Joseph County, Indiana. IT IS FURTHER ORDERED, that Northern Indiana Transit, Inc. shall likewise post a copy of such contract and notice in ten public places in the City of South Bend, Indiana. Done this 16th day of June, 1950. The Board approved stop signs on Marrietta at Indiana .Avenue, both sides. The Board approved the installation of a traffic signal light at intersection of Madison and Michigan Streets, which were placed in operation June 15, 1950. ENGINEERING DEPARTMENT:.._ Contractors' Bonds were approved and ordered filed for Ira E. Wallen, John Wesley Smith, d/b/a Smith Construction Company, Edward Burton, M. E. Walters d/b/a M. E. Walters, Peter Guila, Francis Snider, and Indiana Bell Telephone Company. Petitions were received asking for the construction of a permanent type pavement on ROBINSON STREET from Calvert to Randolph Streets, RANDOLPH STREET to the New York Central Railroad tracks, and.the New York Central railroad tracks to Lincolnwa.y East. These were referred to the City Engineer for investigation and report. The Board approved plans for the erection of a canopy over the sidewalk for a build- ing for Swank Dry Cleaning, 312 West LaSalle Avenue. I Mr. Shearer appeared before the Board to ask permission to erect a stand on the side walk in the fifteen hundred block of Mishawaka Avenue for entertainment. The Board de- nied the request for the erection of a stand, but granted permission for the placing of lights and flags along the store fronts and have roving musicians. Mr. Fread representing the bread Decorating Company appeared before the Board to as permission to place flags and bunting on the street light poles along Michigan Street June 23 to June 25, inclusive, during the Eagles Convention.
