The same to be done in accordance with the profiles, drawings, plans, general detail and specifications of such improvements approved June 12, 1950 and to be adopted by the Board of Public Works and Safety of the City of South Bend, immediately upon the final adoption of these resolutions, and placed on file in the office of the City Civil Engin- eer of Said City, and such improvements are now ordered. The total cost of said improvements, including all incidental costs such as a.dvertis ing, abstracting, inspection and engineering, shall be assessed upon the real estate abut Ling on said MCKINLEY AVENUE; POPLAR STREET; THIRTY-FOURTH STREET; ALLEY BETWEEN C.ALVERT AND DONALD STREET, ALLEY BETWEEN SCOTT STREET AND TAYLOR STREET; THIRTY-THIRD STREET; and KENDALL STREET to be improved, all according to the method and manner provided for in an .Act of the General Assembly of the State of Indiana, entitled, "An .Act Concerning Munici- pal Corporations" approved March 6th, 1905, and in accordance with and pursuant to the provisions of all amendatory and supplemental acts thereto, passed by the General Assembly of the State of Indiana. Assessments, if deferred, are to be paid in ten equal install- ments, with interest at the rate of six (6) per cent per annum. (A bond or bonds shall be issued to the contractor in payment of assessments, as the several owners of real esta upon which they are a lien exercise the right to pay the same in ten equal installments.) Under no circumstances shall the City of South Bend, Indiana, be or be hild responsible for any sum or sums due from said property owner or owners for said work, or for certi- ficate or certificates, bond or bonds, issued to said contractor in payment for such world except for such moneys as shall have been actually received by the City from assessments for such improvements, or such moneys as the City is by said entitled Act and the provi- I sions of all Acts amendatory and supplemental thereto, required to pay. All proceedings had and work done in making of said improvements, assements of properties, collection of assessments and issuance of bonds therefor, shall be as provided for in said entitled Actl and amendments thereto. The 6th day of July, 1950 at the hour of 6:30 o'clock P111-CST is hereby fixed as the time, and the office of the Board in said City as the place, when and where all persons whose property may be affected by such proposed improvements, may be heard as to the necessity for the same, and all petitions and remonstrances received and the Board will, on said day, decide whether the benefits accruing to abutting and adjacent property, and to the City of South Bend, Indiana, will be equal to or exceed the estimated cost of said improvements. The Clerk of the Board is hereby ordered to give notice by two weekly pub- lications, of the time and place of hearingof these resolutions.
