SUPPLEMENTAL AGREEMENT NO. 1
THIS SUPPLEMENTAL AGREEMENT NO. 1 is made and entered into this 0, \ day of
2017, by and between The City of South Bend, acting by and through its proper officials
"LOCAL PUBLIC AGENCY" or "LPA", hereinafter referred to as the "LPA", and Troyer Grout, Inc., 550
Union Street, Mishawaka, Indiana 46544, hereinafter referred to as the "CONSULTANT".
WITNESSETH
WHEREAS, the LPA and CONSULTANT did enter into a contract on April 26, 2016 for the consultant
to provide Engineering Services for the Safe Routes to School near LaSalle Intermediate and Marquette
Primary project, Des. No. 1600076, and,
WHEREAS, the LPA has requested certain additional services necessary for the completion of this
contract, and
WHEREAS, the CONSULTANT has agreed to perform the additional services necessary for the
completion of this contract,
NOW, THEREFORE, the parties hereto agree that said contract shall be amended as herein
described:

The following is a description of the revisions to the Fee Summary:
a. Survey:
• Survey for additional sidewalk and approach replacement along Bergan St., Brookfield St., and
Hamilton St. outside of the original scope of work.
• Survey for Additional sidewalk, curb ramps, and drive approaches outside of the original scope of
work.
h. Stage 3 Plan Submission:
• Additional Design of Sidewalk and Approach replacement along Bergan St., Brookfield St., and
Hamilton St. outside of the original scope of work.
• Additional Design of sidewalk, curb ramps, and drive approaches outside of the original scope of
work.
j. Geotechnical:
• iNDOT has determined that a Geotechnical report will be necessary and will need to be submitted
with Stage 3 plans.
VI. Modification:
This Supplemental Agreement, in the amount of $25,834.50, changes the contracted maximum
not to exceed amount for this contract from $185,108.00 to $210,942.50.
The undersigned attests, subject to the penalties for perjury, that he is the contract party, or that he is the
representative, agent, member or officer of the CONSULTANT that he has not, nor has any other
member, employee, representative, agent or officer of the firm, company, corporation or partnership
represented by him, directly or indirectly, to the best of his knowledge, entered into or offered to enter into
any combination, collusion or agreement to receive or pay, and that he has not received or paid, any sum
of money or other consideration for the execution of this Contract other than that which appears upon the
face of the contract.

Performing up to 25 exploratory test borings to a depth of 5 ft each. In addition, hand auger
borings will be performed as deemed necessary. The actual location, depth, and number
of borings will be dependent on the soil conditions encountered. Standard Penetration Test
(SPT) sampling will be performed at 2'/2-ft intervals. We anticipate that the borings will be
performed with truck -mounted equipment and backfilled at completion of the field work with
auger cuttings and bentonite chips. EEI will locate the test borings using measurements
from existing site features shown on the plans. We will also contact Indiana 811 to arrange
an underground utility line location check. At this time, no pavement cores are planned.
2. Performing appropriate laboratory tests consistent with INDOT requirements including
visual soil classification, hand penetrometer readings, pH, sulfate content, moisture
content, grain size analysis, and Atterberg limit determinations;
3. Preparing a technical report which will include a summary of our findings and
recommendations for geotechnical considerations regarding:
a. Subgrade preparation and improvement, as necessary, for support of the sidewalk;
b. Re -use of onsite soil for fill; and
c. Potential construction problems due to the subsurface conditions encountered
(e.g., soft subgrade difficulties, etc.).
SCHEDULE
We are typically able to mobilize to the site within two to three weeks of notice to proceed and
coordination of our field activities with underground utility owners, the city, and OGE. The field
work will require two to three days to complete. After the field work is completed, the laboratory
testing could take up to two weeks to complete. We anticipate submitting a geotechnical report
within two weeks after the laboratory work is completed.
COST
We propose to provide our services on a time and expense basis in accordance with the attached
unit rates. With that, we estimate the total cost for completing the geotechnical services to be
$14,600. Please recognize that the fee is based on the scope described herein and current INDOT
guidelines. If any significant variations develop during the course of our evaluation, we will advise
you so that our efforts can be effectively directed.
