M. and noon on Monday, September 261�1949 so that the Board may be advised of your attitude in this matter and what steps may be taken to correct this problem. s/ Freda G. Noble, Clerk ` A letter was received from Peter Schumaker and Sons requesting permission to close • lithe alleys between Michigan and Main Streets and Madison and LaSalle Street in order to 1build an addition to the Eagle Lodge for a period of approximately 90 days. Permission for the closing of these alleys was granted upon condition that Peter Schumaker and Sons ,;makes such agreement with abuting property owners as will permit the free flow of traffi jat the intersections of the alleys. IISTREET DEPARTMENT: Mr. Melton Brannon, Superintendent, was present and matters pertaini �,to his department were discussed. It was the opinion of the Board that the order for 300 ton of Rock Salt from the ;Cayuga Rock Salt Company should be cancelled and the Clerk of the Board was directed to !;write and cancel said order. • j jl_PARKING METER DEPARTIMiNT: _ _.AZr. ENGINEERING DEPARTLENT: An application for a permit to construct a. driveway enterance and approach for ''the Robertson Brother's Department Store at their warehouse on Monroe Street was re- ferred to the City Engineer. i STATE OF INDIANA ) SS: ST. JOSEPH COUNTY } IN THE MATTER relating to the Improvement made under Improvement Resolution No. 2585, 1949 and the plans and specifications therefor comes now Lee A. Rieth who being duly 'sworn upon oath deposes and says he is acquainted with Rieth-Riley Construction Company the party to whom was awarded the contract and who performed the work under Improvement Resolution No. 2585, 1949. The general character of the Improvement, the street, alley, or public place on which it has been made, and the terminal points therof, as follows: STANFIELD STREET from the south line of Howard Street to the north line of Corby Street by draining, grading and paving the roadway with a Class ttclt 7 Type Four pavement. There is on file in the office of the City Controller of said City an assessment Poll with the names of the owners and description of property subject to be assessed with the amount of the prima fa.cia assessment, and can be seen in the office of said City Controller. • IIThe Board of Public Works and Safety of said City, at the office of the Board in said City, will on the loth day of October, 1949, at 10:00 o'clock A.M.S.S.T. receive and hear remonstrances against the amounts assessed against their property respectively, ' on said roll, and will determine the question as to whether such lots, or tracts of land, have been or will be benefited by said IQprovements to the amounts named on said roll, or is greater or less than that named on said roll or in any sum. The following is part of the minutes of September 19th, 1949 but through error were not included in the minutes. • L C7 • 0 �83 This being the date set,. hearing was held on the assessment roll showing the award of damages and the assessment of benefits in the matter of vacation of part of Alley West of Vernon Street from DuBail Avenue north a distance of 114 feet under Vacation ,Resolution No. 2596. In the above named assessment roll, no remonstrators, appeared and no written rem- onstrances were filed, the Clerk of the Board submitted proofs of publication of notices and; same were found sufficient, and the Board, ,therefore, finds that the several lots; • and parcels of land have been benefited and damaged in the amounts shown on said roll. The Board, therefore, decides to take final action on said assessment roll and declares same in all things ratified, confirmed and approved without modification and the pro- ceedings closed, and the alley vacated upon receipt of the amount of benefit assessments from the various property owners so benefited and all proceedings had with reference to said alley vacation are hereby sustained. DOG' POUND: This being the date set for receiving,bids for the construction of a Dog Pound Building, the following bids were opened and publically read:: Carl J. Rienke & Sons A Non -Collusion Affidavit accompanied bid. 741 31st Street South Bend, Indiana. General Construction of Dog Pound for the City of South Bend, according to plans and specifications of the City Engineer $2985.20 Alternate #1 If Cyclone fence is required add $275.00 to the Base Bid. .Alternate #2 If concrete curb is required under fence, 61, x 1811 add the amount of $95.00 to base bid. • Alternate #3 If Residential steel windows are used, add the sum of u_�5.00 to base bid. Windows figured in the base bid are utility windows of steel. Thomas L. Dickey, Inc., 712 N. Niles Avenue, South Bend, Indiana, The Overhead door gigured in the base bid is a sectional wood door that is metal clad on both sides. If metal is required on just one side, deduct the amount of $66.00 from the base bid. TOTAL BASE BID O,324.00 A Non -Collusion Affidavit accompanied bid. General Construction of Dog Pound for the City of South Bend, according to plans and specifications of the City Engineer $3,599.00 If concrete curb is used under the cyclone fence add $70.00 TOTAL BASE BID $3,669.00 The above contract was awarded. to Carl J. Rienke & Sons, their bid being, in the Board's opinion, the lowest and best bid received. This contract was awarded subject to the approval of the Common Council.
