The following letter was sent to the Hoosier Brewery Company:
Gentlemen:
i The Board of Public Works and Safety is in receipt
�! of a series of complaints from adjacent property ownera>
that smoke, grit and soot emenating from a smoke stack
on your property is causing a nuisance and damaging their

• �� Will you please have a representative of your Com-
pany appear before the Board of Public Works and Safety
between the hours of 10.30 A. M. and noon on Monday,
September 261�1949 so that the Board may be advised of
your attitude in this matter and what steps may be taken
to correct this problem.

` A letter was received from Peter Schumaker and Sons requesting permission to close
• lithe alleys between Michigan and Main Streets and Madison and LaSalle Street in order to
1build an addition to the Eagle Lodge for a period of approximately 90 days. Permission
for the closing of these alleys was granted upon condition that Peter Schumaker and Sons
,;makes such agreement with abuting property owners as will permit the free flow of traffi
jat the intersections of the alleys.
IISTREET DEPARTMENT: Mr. Melton Brannon, Superintendent, was present and matters pertaini
�,to his department were discussed.
It was the opinion of the Board that the order for 300 ton of Rock Salt from the
;Cayuga Rock Salt Company should be cancelled and the Clerk of the Board was directed to
!;write and cancel said order.

ENGINEERING DEPARTLENT:
An application for a permit to construct a. driveway enterance and approach for
''the Robertson Brother's Department Store at their warehouse on Monroe Street was re-
ferred to the City Engineer.

1949 and the plans and specifications therefor comes now Lee A. Rieth who being duly
'sworn upon oath deposes and says he is acquainted with Rieth-Riley Construction Company
the party to whom was awarded the contract and who performed the work under Improvement
Resolution No. 2585, 1949.
That he is familiar with and personally knows the requirements of the plans and
';specifications of said improvement resolution and further knows that the said Rieth-Riley';
Construction Company in the performance of said work complied with all the terms and con-
ditions of said plans and specifications in every particular, and that the material used r:
;was of the character, kind, quantity and quality required therein and according to and
under the direction of the Board of Public Works and Safety.

the plans and specifications for this project.

Notice is hereby given, that the following Street Improvement has been completed.
The general character of the Improvement, the street, alley, or public place on which
it has been made, and the terminal points therof, as follows: STANFIELD STREET from
the south line of Howard Street to the north line of Corby Street by draining, grading
and paving the roadway with a Class ttclt 7 Type Four pavement.
There is on file in the office of the City Controller of said City an assessment
Poll with the names of the owners and description of property subject to be assessed
with the amount of the prima fa.cia assessment, and can be seen in the office of said
City Controller.
• IIThe Board of Public Works and Safety of said City, at the office of the Board in
said City, will on the loth day of October, 1949, at 10:00 o'clock A.M.S.S.T. receive
and hear remonstrances against the amounts assessed against their property respectively,
' on said roll, and will determine the question as to whether such lots, or tracts of land,
have been or will be benefited by said IQprovements to the amounts named on said roll,
or is greater or less than that named on said roll or in any sum. At which time and
place all owners of such real estate nay attend in person or by representative and be
heard.

Notice is hereby given, that the following Street Improvement has been completed.
The general character of the Improvement, the street, alley or public place on which
it has been made, and the terminal points thereof, are as follows: DALE AVENUE from
the south line of Indiana Avenue to the north line of Dubail Avenue by draining, gradi
and paving the roadway with a Class "C" Type Four (4) pavement.
There is on file in the office of the City Controller of said City an assessment
roll with the names of the owners and description of property subject to be assessed -
with the amount of the prima facia assessment, and can be seen in the office of said
City Controller.
The Board of Public Works & Safety of said City, at the office of the Board in
said City, will on the loth day of October, 1949 at 10:00 A. M. C. S. T. receive and
hear remonstrances against the amounts assessed against their property respectively, on
said roll, and will determine the question as to whether such lots, or tracts of land,
have been or will be benefited by said Improvement to the amounts named on said roll,

NOW, THEREFORE, be it resolved b;r the Board of Public Works and Safety of the City
of South Bend, Indiana, that all public streets, alleys and public places dedicated to
the public use in said plat are hereby accepted and approved by said Board For and on
behalf of the City of South Bend, Indiana.
The following is part of the minutes of September 19th, 1949 but through error
were not included in the minutes.

This being the date set,. hearing was held on the assessment roll showing the award
of damages and the assessment of benefits in the matter of vacation of part of Alley
West of Vernon Street from DuBail Avenue north a distance of 114 feet under Vacation
,Resolution No. 2596.
In the above named assessment roll, no remonstrators, appeared and no written rem-
onstrances were filed, the Clerk of the Board submitted proofs of publication of notices
and; same were found sufficient, and the Board, ,therefore, finds that the several lots;
• and parcels of land have been benefited and damaged in the amounts shown on said roll.
The Board, therefore, decides to take final action on said assessment roll and declares
same in all things ratified, confirmed and approved without modification and the pro-
ceedings closed, and the alley vacated upon receipt of the amount of benefit assessments
from the various property owners so benefited and all proceedings had with reference to
said alley vacation are hereby sustained.
DOG' POUND:
This being the date set for receiving,bids for the construction of a Dog Pound
Building, the following bids were opened and publically read::

• Alternate #3 If Residential steel windows
are used, add the sum of u_�5.00 to base bid.
Windows figured in the base bid are utility
windows of steel.

The above contract was awarded. to Carl J. Rienke & Sons, their bid being, in the
Board's opinion, the lowest and best bid received.
This contract was awarded subject to the approval of the Common Council.
There being no further business to come before the meeting, the Board adjourned at
10:00 A. M.
