The Clerk of the Board submitted proofs of publication of notic and same were found sufficient. The Board, therefore, finds that the several lots and parcels of land have been benefitted and damaged in the amounts shown on said roll. The Board, therefore, decides to take final action on said assessment roll and declares dame in all things ratified, confirmed and approved without modification and the proceedings closed, and the alley vacated upon receipt of the amount of benefit assessments from the various property oi,-ners so benefitted and all proceedings had with reference to said alley vacation are hereby sustained. Contractors bonds were approved and ordered filed foi� I. D. Lant, New Carlisle, and the Peed Construction Company. A plat of Twyckenham Hills Addition, Section "A", was approved by the Board. A letter was received from the City Plan Commission in which they indicate that they approve the vacation of a portion of South Iowa Street which does not overlap the present location of Vermont Place. Andrysiak BOAIu D OF PUBLIC WORKS AND SAFETY • C7 CJ • 0 0 iNLI ZAMAM C7 • • • U • 0 II-iPROVEI1ENT RESOLUTION 1'70 . 2575 191+8 ' South Bend, Indiana August 9, 1948 Be` It Resolved, By the Board of Public Works and Safety of the City of South Bend, Indiana, that it is deemed necessary to improve Twenty-fifth (25th) Street from north line of of Mishai.,raka Avenue to South property line of lott "A" & "B" in Hastings, Woodward , & Gray Addition by draining, grading and paving the'roadtiray with a Class "C" pavement as follows: Type 1 -'Portland Cement Concrete; Type`2 - Bituminous Compacted Aggregate Base Bituminous Concrete Surface; Type.3 - Bituminous Compacted Aggregate Base, Bituminous Coated Aggregate Surface; Type 4 - Compacted Aggregate Base, Bituminous Concrete Surface; Type 5 - Compacted Aggregate Base, Bituminous Coated Aggregated Surface. The same to be done in accordance with the profiles, drawings, plans, general details and specifications of'such improvement approved August 9, 1948 and to be adopted by the Board of Public Works and Safety of the City of South Bend, immediately'upon the final adoption of this resol- ution, and placed on file in the office of the City Civil Engineer of°sa.id City, and sue hI improvement is now ordered. The total cost of said improvement, including all incidental' costs such as adver- Using, abstracting, inspection and engineering, Shall be assessed upon the real estate abutting on said Twenty-fifth (25th) Street to be improved, all according to the method and manner provided for in an Act of the General Assembly of the State of Indiana, entit- led "An Act Concerning Iiunicipal_..Corporations" approved March 6,'19051 and in accordance with and pursuant to the provisions of all amendatory and supplemental acts thereto, passed by the General Assembly of the State of Indiana. Assessnents, if deferred, are to be paid in ten equal installments with interest at the rate of five (5) per cent per annum. (A bond or bonds shall be issued to the contractor in payment of a.ssessraents, as the several owners of real estate upon which they are a lien exercise the right to pay the same in ten equal installments.) Under no circumstances shall the City of South Bend Indiana, be or be held responsible for any sum or sums due from said property oiT or owners for said work, or for certificate or certificates, bond or bonds, issued to said contractor in payment for such work, except for such moneys as shall have been actually received by the City from assessment for such improvement, or such moneys as the City is by said entitled Act and the provisions of all Acts amendatory and supplemental thereto, required to pay. All proceedings had and work done in making of said improvemen, assess- ment of property, collection of assessnier_ts and issuance of bonds therefor, shall be as provided for in said entitled Act and amendments thereto. Thursday, September 2, at the hour of 7:30.o'clock P.ii. (CDT) is hereby fixed as the time and the office of the Board in said City as the place, when and where all persons whose property may be affected by such proposed i_riprovernent, may be heard a.sl,to the nec- essity for the same, and all petitions and remonstrances received and the Board will, on said day,decide whether the benefits accruing to abutting and adjacent property, and to the ty of South Lend, Indiana, will be cqua.l to or exceed the estiriated cost ' of said improvement. And the Clerk of the Board is hereby ordered to give notice by two weekly publications, of the time and place of 'nearing of this resolution.
