ATTEST: 6� Clerk BOARD OF PUBLIC VFORKS January 24, 1948 • A special meeting of the Board of Public I'lorks was held on Saturday, January 24, 1948 at 9:30 A,M0 All members were present. I� I A petition having been filed by Northern Indiana Transit, Inc, which sets forth, • and a showing having been made by said company, that the fares permitted to be charged) for bus transportation under a contract made with the City of South Bend, Indiana, on I or about the 13th day of May, 1940, are confiscatory, and a request having been made by said company that it be permitted to charge rates for service rendered to the pub- lic which will by fair and reasonable to all parties concerned, and. the Statutes of Indiana (Sec, 48-7303 Burns Indiana Statutes, 1933) requiring the amendment of said I. contract -to be undertaken in,the manner herein followed, this.Board now takes the following action:° This Board, in compliance with said statute, has tentatively determined the exac form in which the amendment to said contract is to be finally adopted, to be in the following words and figures: C O N T R A C T THIS CONTRACT, made and entered into this day of $19480 by and between the. City of South Bend, Indiana, acts g Sy and tErough its Boa of Public Works and Safety, hereinafter called the First Party, and Northern Indiana Transit, Inc., a corporation organized under the -laws of the State of Indiana, its successors and assigns, hereinafter called the Second Party,-WITNESSETH: The parties hereto agree that that certain contract made between the parties and confirmed by Ordinance of the Common Council of the City of South Bend on or about the 13th day of May , 1940, shall be and is hereby amended in each of the following respects: All provisions in said contract regarding the charge for token fares are hereby deleted, aDd Second Party, upon approval of this contract by the Common Council of this City, shall sell to the users of its service, mpon request, five tokens for forty-five cents (each token giving a passenger the right to one ride or trip on Ij b.bus). All provisions in said contract as to cash fares and transfers shall re- main the same. j Second Party shall furnish service to the public over the routes now presently established. Said contract made between the parties on the 13th day of May, 1940..as here- inab ove amended, shall be and is hereby continued in . full force and effect. By President Attest: • • 349 This Board does fix the 9th day of February, 1948, at ten otclock in the forenoon, as the time at which said contract will be finally considered, at the i office of this Board in the City Hall, 224 Nprth Main Street, South Bend, Indiana At said time and place, a public hearing will be had at which any taxpayer may j appear and file protest against any or all of the provisions of said contract. 11 IT I'S ORDERED that Northern Indiana Transit, Inc, shall, at its own expense, �I cause the full and complete text of said contract to be published one time at ' least one week before such hearing, with the time and place of such hearing, in South Bend Tribune, a daily newspaper, and The Mirror, a weekly newspaper, each Iiof which newspapers is printed in the English language in St. Joseph County, Indiana. IT IS FURTHER ORDERED that Northern Indiana Transit, Inc., shall likewise post a.copy_of such contract and notice in ten public places in the City of South Bend, Indiana, Done this day of January, 1948. The Traffic Engineer asked permission for his assistant, Steve Ivankovics and him- self, to attend the Road School at Purdue University February 2nd to 5th inclusive. The Board granted permission for them so to do. • I ENGINEERING DEPARTMENT: The Engineer was authorized to spend February 2nd to°5th in- clusive at the Purdue University Road School. i� The established grade was approved by the Board on Lawrence Street and St. Louis Boulevard between Napoleon and Angela Avenues. li STREET DEPARTMENT: Mr. Melton 0. Brannan, Street Commissioner was present and matters !I pertaining to his department were discussed. Mr. Brannan was authorized to attend the Road School at Purdue University From February 2nd to 5th inclusive. • �i CEMETERY DEPARTMENT: Mr, Stanley Leszczynski, Sexton, was present and matters pertaining to his department were discussed.
