Witucki, Pastor of St. Casimir Church, presented a letter relative to a bad hump.in the pavement on the Northwest corner of 'South Walnut and.Ford' Streets. This was referred to the City Engineer and the Ztreet Department; CEMETERY DEPARTMENT: Mr. Stanley Lesze ynski, Sexton, was present and matters per- taining to his department were discussed, Tar. Leszczynski presented his annual report for the year 1947, There being no further business to come before the Board, the meeting was adjourned'at 10:00 A,M. Minutes of the last meeting were read and approved. There were no claims of suppliers to be approved. TRAFFIC DEPARTMENT: Mr, Ernest Miller Traffic Engineer, was � L , g' , present and matters pertaining to.his department were discussed. i I� TAXI -CABS: Mr, Feeney and Mr. Stratigos, Attorneys, representing the.Veterans Cab.Company, came before the Board to petition for a cab stand in front of the Odd Fellows Building, and also to ask for a temporary cabstand until the new i taxi -cab ordinance has been passed by the Common Council. No action was taken. i BIDS: Mr. Pajakowski having asked for bids on an adding machine, the following bids were opened and publicly read: Underwood Corporation $238.50 Burroughs Adding Machine Co. 264.60 Victor Adding Machine Co.. 220,50 !j The Board accepted the bid of the Underwood Corporation, their bid being, in the .11 Boardis opinion, the lowest and best bid received. I ENGINPEERING DEPART MENT: Tar. Ralph Allen, representing the StudebakerCorporation, came before the Board.to petition for the installation of two more railroad tracks parallel with and adjacent to the tracks now in use crossing Chippewa Avenue near �I the Studebaker Aviation Plant, The Board took the _matter under advisement'. It WHEREAS$ a quit -claim deed is now presented to the Board releasing the follow- ing described tract.of land to the City of South Bend for alley purposes: q • • A tract of land in the Southeast Quarter of Section 18, Township Thirty-seven North, Range.Three East, described as follows Beginning at -a point 16 feet North of the Northwast corner of Lot Numbered 1 Roseland Park Addition; thence West with the North line of a public alley 689 feet to the West line of Hoke Street; thence North 4 feet; thence .past 689 feet to the Vilest line of Ironwood Drive; thence South 4 feet to the place of beginning. This ,quit -claim deed is filed in the records of the Board .of ;XIorks and ,,oafetY of the City of South Bend in Row #21, Drawer #4 and recorded in the Recorderts c,_._... office of St. Joseph County in Book # Page # . NOW, THEREFORE, be it resolved by the Board of Public ':'forks and Safety of the City of South Bend, Indiana, that the tract of land dedicated to the public use in said quit -claim deed is herel� ac�epted and approved by said Board for and on be- half of the City of South B'u ., I diana. STREET DEPARTMENT: Mr. Melton 0, Brannan, Street Commissioner, was present and matters pertaining to his department were discussed. Mr. Gadbury of the Butler Manufacturing Company and Tar. R. Jordan and Mr. Ullery of the Miller Steel and Supply Company came before the Board to discuss various types of temporary buildings for the Street Department. They were asked to send specifications of their buildings to the Board. 348 CEMETERY DEPARTMENT: Mir, Stanley Leszczynski., Sexton, was present and matters per- taining to his.department were discussed. There being no further business to come before the Board, the meeting was ad- journed at 10:00 A.M. ATTEST: G Clerk j January 24, 1948 i A special meeting of the Board of Public Works was held on Saturday, January 24, 1948 at 0:30 A.M, All members were present. i i A petition having been filed by Northern Indiana Transit, Inc, which sets forth, and a showing having been made by said company, that the fares permitted to be charges for bus transportation under a contract made with the City of South Bend, Indiana, on or about the 13th day of May, 1940, are confiscatory, and a request having been made by said company that it be permitted to charge rates for service rendered to the pub- lic which will by fair and reasonable to all parties concerned, ands the Statutes of Indiana (Sec, 48-7303 Burns Indiana Statutes, 1933) requiring the amendment of said contract -to be undertaken in.the manner herein followed, this.Board now takes the following action: This Board, in compliance with said statute, has tentatively determined the exact form in which the amendment to said contract is to be finally adopted, to be in the following words and figures: C O N T R A C T THIS CONTRACT, made and entered into this day of ,1948, by and between the. City of South Bend, Indiana, acting y and tEr-ough its Boa d of Public Works and Safety, hereinafter called the First Party, and Northern Indiana Transit, Inc., a corporation organized under the -laws of the State of Indiana, its successors and assigns, hereinafter,called the Second Party,-uIITNESSETH: The parties hereto agree that that certain contract made between the parties and confirmed by Ordinance of the Common Council of the City of South. Bend on or about the 13th day of Vlay, , 1940, shall be and is hereby amended in each of the following respects: All provisions in said contract regarding the charge for token fares are hereby deleted, ai.d Second Party, upon approval of this contract by the Common Council of this City, shall sell to the users of its service, mpon request, five tokens for forty-five cents (each token giving a passenger the right to one ride or trip on h bus). All provisions in said contract as to cash fares and transfers shall re- main the same. Second Party shall furnish service to the public over the routes now presently established, Said contract made between the parties on the 13th day of May, 1940,.as here- inabove amended, shall be and is hereby continued in.full force and -effect.
