MEETING - DECEMBER 6, 1943
A regular meeting of the Board of Public `.'corks was held on Monday, December 6,
1943 at 9:00 A,Yil, All members were present. Tainutes o- the last meeting were read
and approved. Claims of the following suppliers in the amount of $7,902.01 .were

STREET DEPAR1t�ENT: Mr. Anthony Zmudzinski, Street CorLmissionar, was present and matters
pertaining to his department were discussed.
The Board informed I1r. Zmudzinski that appraisers had been appointed for the sale
of certain property belonging to the City Street Department.
ENGIhl=RING DE PARU.,TENT:, The Engineering Department presented a sketch pertaining to
the petition . for the construction of a sewer on Duey Street from Howard Street to
South -Bend Avenue. It was recommended that due to the scarcity of materials and also
due to- the fact that.the sewer would serve properties already being utilized, that
this be considered a post-�,rar project. The Board, upon motion duly made, seconded,
and unanimously carried, authorized the Clerk to notify the principal petitioner of
this recommendation.
Excavation bonds were approved and ordered filed for the following: Emmett Shaul,
Emil Spromberg, Phillip Cohn, Albert 74. Smith & Son, Jacob Hawblitzel & Son, Louis.
C. Sto-11 Co. Inc., Mitchell Kahn, Rocco Simeri and. the Sibley Heating & Plumbing Company

Notice of the foregoing, resolution having been published, the board of Public
Works and Safety met to hear and receive reimonstr•ances from all persons interested in
or affected by the said proceedins, at its office in the City Hall on the 6th day of
December, 1943, at 10:00 A.Y.- (C.'','.T. ).
One remonstrance was received, in words and figures as follows:

December 4, 1943
To the Board of Public 'ti`lorks and Safety of the City of South Bend, Indiana: ,
RE. Condemnation Resolution No. 2525.
1 The undersigned property owner, being interested or affected by the proposed opening
and paving of Chippewa Avenue, said City, from the East line of illichigan ,Street to the
North and South center line of Section 25, Township 37 North, Range 2 East, and the
opening and paving of Fellows Street from the North line of said section South a dis-
tance of 653.7 feet, remonstrate against said proposed opening and paving for the
reason that said opening and paving will occasion more damage than the benefits will
amount to and/or that said opening and paving will not be of public benefit or utility.

The Board of Public 01orks and Safety being fully advised in the premises and con-
sidering the aforementioned remonstrance and all other facts and matters relating to
these proceedings, did, then and there, enter the following order: It is ordered and
decreed that the properties described in Condemnation Resolution No. 2525, be, and the
same are hereby, appropriated for the use of the Lity of South -Vend, Indiana; that the
Engineer of said City be directed to prepare and file a list of the owners of the pro-
perty and interests affected by the said appropriation and that all necessary further
pr-oceedin„s shall be taken. Entered this 6th day of December, 1943, b- the Board of
Public �,Vorks and Safety.
After a general discussion of the condemnation of the 'Chippewa Avenue right of
way, East of Michigan Street, it was decided by the Board to direct that construction
should commence immediately so that the necessary grading might be accomplished in
the year 1943, and the route used by the Public prior to the completion cf the pavement
CEMETI-,RY DEPAIJUKENT: Mr. Stanley Leszczynski, Sexton, was present and matters pertain-
ing to his department were discussed.
A .letter requesting that the City take over the Bovaman Cemetery as a City maintain
ed Cenatery was received and was taken under advisernient.
There being no further business to come before the Board, the meeting was adjourn
at 10:30 A.M.
