The bidders ranked as follows: Bidder Base Bid and .Soil Management P1an Alt. $ Alt. 9 1. Gibson -Lewis LLC $ 3,634,000.00 $ 143,000.00 $ 19,000.00 2. Ziolkowski Construction, Inc. Not Complete $ 166,000.00 $ 19,500.00 The Division of Engineering has reviewed all of the bids and noted the following discrepancy. The Ziolkowski Construction, Inc. bid submission did not include an itemized price for the Soil Management Plan. Per Special Provisions XL _. Removal of Contaminated Soils, "the Contractor shall adhere to the Soil Management Plan prepared by WSP for all site earthwork and utility installation and that all work associated with the requirement shall be included in the Soil Management Plan lump sun item". In addition, Part 1 — General Clarifications, Item 11 of Addendum #3, dated September 5, 2017, it states "The final Soil management plan; is attached and is to be included in contract bid as an itemized price". Upon further review and in conversation with Bill Favors, a representative of Ziolkowski Construction, Inc., he stated that "they felt there were too many variables and potential liabilities related to the existing soils and the Management Plan, didn't feel comfortable being responsible for this work, and, therefore, did not include that portion of the project in their bid." Based on this information, and further review by the Board's Legal Counsel, I recommend that Ziolkowski Construction, Inc. be deemed a non -responsive bidder. The Division of Engineering therefore recommends that the Board award the Base Bid, Soil Management Plan, Alternate 8 and Alternate 9 to the lowest responsive/responsible bidder, Gibson -Lewis LLC, in the amount of $3,796,000.00.
